Re: Garage Construction on a Storm Sewer Easement
Dear Mr. Roy:
We, of the County Highway Staff, have reviewed your request to build a
garage on a 30' storm sewer easement.
We cannot authorize permanent construction of any kind on this easement.
The express purpose of the easement is to provide for the necessary space
to install and maintain a storm sewer. Any'.permanent construction over
this violates this purpose.
Currently, East River Road is in the design stage for upgrading, and some
increase in capacity of the existing storm drainage may be necessary, so
there is the chance that another pipe may have to be placed in the easement,
All things considered, the County would be negligent in authorizing construction
on the easement and it would be very unwise .for a property owner to do such
construction. Any permanent construction, therefore, must be done outside
of the easement limits.

office.
