OFFICIAL NOTICE CITY OF FRIDLEY PUBLIC HEARING BEFORE THE BOARD OF APPEALS TO WHOM IT MAY CONCERN: R NOTICE IS HEREBY GIVEN THAT the Board of Appeals of the City of Fridley will meet in the Council Chamber of the City Hall at 7:30 P.M. on Tuesday, August 25, 1970 to consider the following matter: A request for a variance of Section 45.073, 1B, Subparagraph 2, to reduce the lot area requirement for a four family dwelling from 15,000 square feet to 13,287 square feet to permit the property owner to sell this land with the understanding that a four family dwelling can be built on it. Dear Mr. Jelevarov: On November 24, 1982, we met with you to discuss the construction of a fence along the southerly boundary of your property at 6471-73-75-77 Riverview Terrace. At that meeting you indicated that a fence could not be installed since you wanted the electrical service line and pole on your property relocated. The City's position was to install as much of the fence as was practical prior to a decision on the electrical service change. I also indicated that I would attempt to expedite the N.S.P. action to relocate the electrical service. The attached response from N.S.P. indicates that they will not relocate the line or bury it unless you pay the full cost and provide necessary underground easements. I assume you will not do this. I am writing this letter to notify the city of a building code violation committed by my neighbor, Mr. R. J. Morkrid, located at 6461 Riverview Terrace (Lot I. D. #2140-15-30-24-42-0011). Mr. Morkrid built an addition to his home and violated the building code ordinance requiring no structure to be built within a distance of twelve feet from the lot line dividing our adjacent properties. His addition was built just five feet from the lot line which is clearly in violation of this building code ordinance. I am deeply concerned about this situation because it has created problems regarding fire hazards and the location of power lines and poles which could cause great danger to my property. Because of the violation there are severe hazards with the location of power lines almost direcly over my porch which creates a great potential for severe personal injury and property damage to me. I believe that Mr. Morkrid and the city of Fridley acted negligently by allowing this building code violation. Therefore, consider this letter as due notification that I am holding the city of Fridley and Mr. R. J. Morkrid directly liable for this situation and any potential hazards it has created. Furthermore, I would like to pursue all legal remedies avalable to me to have Mr. Morkrid's structure altered to comply with this twelve foot building code ordinance. I met with Mr. Chris Zelezarov, owner of the 4-plex at 6477 Riverview Terrace, to explain that in order to perform work on the hydrant, it would be necessary to remove the boulevard tree. It was also explained that the tree was within the City's right-of-way. Before I was given a chance to explain that the tree would be replaced by the City, Mr. Zelezarov stated he did. not want the tree removed but that he had a tree in his backyard which was causing trouble in the line due to roots and that he wanted the City to remove it. The line was checked and no- root problem was found. Mr. Zelezarov would not give permission to remove the boulevard tree unless the tree in the backyard was removed.
