Hail at 7:30 P.M. on Tuesday, August 25, 1970 to consider the following matter: A request for a variance of Section 45.073, 1B, Subparagraph 2; -to seduce the lot area requirement for a four family dwelling from 15,000 square fest to 13,287 square feet to permit the property -owner to cell thic land with the understanding that a four family dwelling can be built on it. ERS SENT: Miinish, Ahonen, Drigans, O' on, S dheimer OTHERS PRESENT: Al Bagstad-Building Official MMON by Ahonen to approve the minutes of the August jl1, 1970 meeting as written. Seconded by Sondheimer. Upon a voice vote, there beim no nays, the motion carried unanimously. Chairman Mlinish reported to the Board the action taken by the Council on the August 11, 1970 Board of Appeals items. Mr. Johnson was present to present his request. i Mr. Johnson stated he has been trying to sell this land for about 2 years. He now has a prospective buyer for this lot, Mir. Allan Mia�at son, but the sale depends on whether a 4 plea can be constructed on the lot. MirMattson does own other 4 plexs in the immediate area. Mr. Johnson continued this lot is now enclosed by three roads for which he had to dedicate 1 d. Because of these dedications, the land area is now not sufficient to met the present Code requirement for land area for a 4 plea. He stated head paid for sewer and water, paving and storm sewer and he pays around $800. 0 in assessments on this lot and he just can't afford to maintain this lot any onger as he is retired and owns a home that he has to maintain. Mr. Drigans asked if he had talked to any of the Burro ding property owners. Mr. Johnson said that he had and two of them, Mir. Fragsle and Mr. Segner, had told him they would appear in his behalf at this meetitig but apparautiy had not been able to attend. 7 Mr. Mattoon stated that this lot is bigger than his other lots that house 4 plats and he has had no problemswith them. Mr. Q Bannon asked if there was sufficient room for parking. Mr. -Mattoon answered that there was •end he added that 'ince he owns the adjacent 4 plexe if there is any problem with the parking he was'sure he could work it out. 2. Mr, Mattoon said the lot is not very good for anythin but a multiple dwelling as the lot is surrounded by multiples. Mr. Drigans asked how soon the construction would sty, t if the variance was approved Mr, Mattson answered about January of 1171. 4. `here were no objections from any surrounding property owners. Seconded by O'Bannono Upon a voice vote, there being no ways, the motion carried unanlmmsly. ® & s � Wilson were Present to present the request. Mr. Wilson stated the variance asked for was actually more than what would be necessary. The measurement of 6.5 feet was only a Suess and after measuring the fencev we would need only a 1 foot 4 inch variance. The height of the fence is 4 feet and the 'retaining wall under the fence would be the height of 2 standard cement blocks or 16 inches. Pictures of the existing fence and lot were shown to the Board. 0 3. The Minutes of the Board of Appeals Meeting of August 25. 1970 Page Mrs. William Zaier, 6550 Central Avenue, adjacent property owner, stated she was not opposed to the fence as long as it does not disturb the natural drainage or air circulation. She did want to know if the Wilsons had to get a survey of their lot before they put in the retaining wall. Mr. Bagstad said a survey was not required. Mr. Wilson added the original stakes were found and they will make sure the entire retaining wall and fence are on their property. Mr. Thomas Moore, 6550 Central Avenue, adjacent property owner, stated he has constructed a retaining wall between his property and Mr. Wilson's property and it has worked very well. The retaining wall does not detract from the property and it has served both of them equally well, Mr. Origans asked how steep the bank was at its highest point. Mrs. Filson answered that she was told by someone in City Ball that the highest point was 7 feet. MOTION by Sondheimer to close the public hearing. Seconded by Ahonen. Upon a voice vote, there being no nays, the motion carried unanimously. MOTION by O'Bannon to recommend to the City Council approval of the request to increase the fence height from 4 feet to 5 feet 4 inches for the following reas ons ; 1. There is a hardship due to the terrain of the land and the retaining wall is to prevent the land from eroding and ruining his lawn. 2. 'There were no objections from surrounding property owners. Seconded from Sondheimer. Upon a voice vote, there"being no nays, the motion carried unanimously. Mr. Myron Ostlund was present to present the request. A photo 6f the lot and a sketch of the lot showing the existing house and proposed addition were shown to the Board. The Minutes of the Board of Appeals Meeting of August 25, 1970 Page 4 Mr. Ostlund explained he is adjacent to the back side of the Rice Creek School yard and situated on.the dead end of 66th Avenue which has no cul de sac. Mr. Bagstad stated -the reason for the variance is the average front yard setback between the house on the West and the eventuality of a minimal setback on the lot to the East (now owned by the School) is 47.21 and the variance now pr--lcludes any question of legality in the future. Mr. Ostlund stated he would be adding 1O.feet onto the front of the, present garage, 8 feet onto the East side of the house and garage, and 8 feet onto the back of the garage to expand the single car garage into a double garage and add a family room. The house will have a T-shape after the additions are added. A -plan -of the' -house was shown to the Board. - There is a 2.75 foot wide strip of land between Mr. Oslund's property and the School property that is owned by the State of Minnesota and is legally described as Lot 21, Revised Auditor's Subdivision No. 10. Mr. Oslund said he had talked to his neighbors but they had no objections to the request. MOTION by Drigans to close the public hearing. Seconded by Ahonen. Upon a voice vote, there being no nays, the motion carried ---unanimously. MOTION by Drigans to recommend to the City Council approval of the requests for the following reasons: 1. Mr. Ostlund's home is virtually the last on 66th Avenue and is adjacent to School property so there should be no other -homes built next to him that the additions would interfere with. 2. There were no objections from any of the surrounding property owners. 3. Mr. Ostlund has presented adequate plans for the additions.. Seconded by Sondheimer. Upon'a voice -vote, there being no nays, the motion carried unanimously. 4. A REQUEST FOR A VARIANCE OF SECTION 45.053, 4B', SUBPARAGRAPH 3 FRIDLEY CITY CODE TO REDUCE THE SIDE YARD SETBACK REQUIREMENT FOR AN ATTACHED GARAGE FROM 5 FEET TO 4 FEET 2 INCHES TO PERMIT THE CONSTRUCTION OF A GARAGE ONTO AN EXISTING DWELLING LOCATED ON LOT 11, BLOCK 2, MELODY MANOR 3RD ADDITION, THE SAME BEING 7424 CONCERTO CURVE N.E., FRIDLEY,• MINNESOTA. (REQUEST BY THE SUSSEL COMPANY_ 1850 COMO AVENUE. ST. PAUL, MINNESOTA.) Mr. Roger Ompvedt, representing Sussel Company, was present to present the request. Mr. Ompvedt explained the request should read from 5 feet to 4.2 feet instead of 4 feet 2 inches. Mr. Ompvedt stated the variance is only on the front (Southeast) corner of the garage. The back of the garage is 5.3 feet from the line. There will be 15 feet between structures. MOTION by O'Bannon to close the public hearing. Seconded by Drigans. Upon a voice vote, there being no nays, the motion carried unanimously. MOTION by Ahonen to recommmend.to the City Council approval of*the variance from 5 feet to 4.2 feet for the following reasons: 1. The actual variance is only 92 inches on the forward portion of the structure. 2. It is in keeping with the neighborhood. 3. There were no objections from the surrounding property owners. A REQUEST FOR A VARIANCE OF SECTION 45.074, 1, FRIDLEY CITY CODE, TO INCREASE THE MAXIMUM HEIGHT BLQUIREMENT FOR A "HIGH RISE" APARTMENT FROM 6 STORIES TO 15 STORIES TO PERMIT THE CONSTRUCTION OF A'104 UNIT "HIGH RISE" APARTMENT TO BE LOCATED ON LOTS 3 AND 4, BLOCK 2, HAYES RIVER LOTS ADDITION, THE SAME BEING 5950 ANNA STREET N.E., FRIDLEY, MINNESOTA. (REQUEST BY N.C.R. CORP., 1811 UNIVERSITY AVENUE N.E., MINNEAPOLIS, MINNESOTA 55418.) Mr. Emil Novak, representing N.C.R. Corporation, presented the request. Mr. Novak stated he has been working with the property owner, Mr. Harold Panuska, and had also talked with the City Engineer and the Fire Chiefs to make sure that the building will comply with all the City Codes. He said what they want to do is to build something unique which will have a greater amount of green area. They hope to give the tenants a view and a prestige symbol, and to also give the City a prestige symbol. Chairman Minish read a letter from the Fire Prevention Chief which stated "High Rise" buildings do not appreciably add'to the problems of the Fire Department. -- Use of combustibles is very severely restricted. --Additional fire fighting appliances are necessary so the additional height of the structure is of relatively small significance." The City Council has approved the ordering of additional fire fighting equipment. Chairman Minish stated there had been some questions on whether our Fire Department had the equipment with which to handle a fire in any of the upper stories of this building, and he felt this letter answered those questions. Mr. Novak stated this building will have fire fighting equipment on each floor z o the Fire Department would fight any upper story fires from the inside of the building. The Minutes of the Board of Appeals Meeting of August 25, 1970 Page 6 Mr. Albert Hoffineyer, architect, stated this building is a Type I building which has the longest life span of any building as the structural framework is constructed of steel or iron with masonry. Mr. Novak showed the Board two very preliminary drawings; one of the typical floor plan and one of the site plan. The building will consist of 104 units made up of 56 two bedroom apartments, 40 ore bedroom apartments and 8 three bedroom apartments. The apartments will rent from approximately $200 to $400, the lower rents being for the bottom apartments. Mr. Drigans asked when construction would begin if the building were approved. Mr. Hoffineyer answered in the spring of 1971 and ready for occupancy approximately 18 months later: Mr. Novak added they don't think a high rise is conducive to a large number of children so there should not be any problems with the schools. Mr. Clifford Bakko, apartment owner, stated his main concern was the traffic patterns as there is a problem in this area at the present time and he wants to make sure something is going to be done to correct it. Mr. Novak stated he had been discussing this with the City Engineer and was informed that the construction to correct this problem will hopefully be completed by the middle of 1972. Mr. O'Bannon asked if there were any reports on how this type of building would hold up during a tornado. Mr. Hoffineyer related a situation that happened in one of the Southern states where there had been a tornado and this type of building was almost totally undamaged and all other buildings in the same area fell. MOTION by Sondheimer to close the public hearing. Seconded by Ahonen. Upon a voice vote, there being no nays, the motion carried unaniinously. MOTION by Drigans to recommend to the City Council approval of the request for the following reasons: 1. The fire protection is sound. 2. The traffic situation will be solved at the same time or sooner than the building completion date. 3. When the ordinance governing apartment heights was adopted, he didn't think the City considered that anything higher than 6 stories would ever be built in Fridley. It blends into the area as there are apartments on surrounding properties. 6. It is something special for our community. Seconded by Ahonen. PROPOSED PRELIMINARY PLAT, INNSBRUCK NORTH, P.S. #70-03, BY VIEWCON, INC' That portion of the A of the Sia of Section 24. 2. REZONING REQUEST: 20A #70-05, BY VIEWCON, INC.: For that portion of the E� of the SE14 of Section 24 to be rezoned from R-1 to R-3 (general multiple family dwellings) or R -3A (apartments only) The City Engineer said that the Planning Commission has discussed the requests by VieWcon over the last 2 or 3 meetings, but in this meeting they did not take formal action and passed it on to the Council without a recommendation. The rezoning is in the area called Innsbruck North and the total acreage is about 132 acres. The plat is divided up into residential lots along with some large outlots, and he showed it on the screen. The public hearing has already been set for September 14th. They plan to plat into 120 single family dwellings, mainly on the west side. On the north side there is some park property. They also have some interest in the property to the east in Now Brighton, The proposed road,.as shown on the plat would connect to Salver Lake Road. Councilman Liebl said that he had heard comments from the people adjacent to this project indicating they are in favor of it. He said that at this point he would be in favor of the project, as it takes into consideration the pvoperty owners in the area. They have indicated that they wanted a suitable buffer and this has been provided. He said homes were needed in this area, Mayor Kirkham said that he was agreeable to holding the public hearing. The City Engineer said that there was no formal action necessary as the public hearing has already been set. Councilman Breider asked about the question raised by the Planning Commission regarding the assessments. The City Engineer explained that the developers Wondered whether it would be possible to have some of the unbuildable lots not assessed and the remaining lots would then carry the assessment. The Finance Director said that if this is to be considered, there should be acme bind of an agreement on paper. Councilman Breider asked whether there Were any sidewalks proposed. The City Engineer said that there were no plans for any sidewalks now. Councilman Breider suggested working something but so that in 10 years or so if they are needed, they could be put in. MINNESOTA): REGULAR COUNCIL MEETING OF SEPTEMBER 8, 1970 PAGE 9 Councilman Liebl explained again that it was not fair for the people paying assessments to also be taxed for the maintenance of the unimproved streets, This money comes from the general fund. The city Engineer said that of course it is their money, but it would be - bad planning to delete 4th Street. At this time maybe some�of the base could be saved, but if delayed any further the whole street would have to be torn up, The assessment for this street would not go on until 1972, and would be spread over 10 years. He explained again that by grouping the streets in the same general area, it keeps the costs down. He agreed that maybe the alleys could be deleted. The improvement was suggested to try to clean up the City. The lady said that they did not want 54th deleted as that street is very bad. Mr. O'Bannon said that:the alley between 4th and 5th would only serve the apartment house. MOTION by Councilman Liebl to delete from the 1971 construction project the improvement of the alley between 4th Street and 5th Street from 54th Avenue to I. 694 Outer Drive and the alley between 4th Street and University Avenue from 53rd Avenge to 54th Avenue and 4th Street from 53th Avenue to I. 694 Outer Drive. The improvement to be delayed until 1973 and be on the tax rolls in 1974, Councilman Sheridan felt that if this street was taken out, the improvement of the area would not be feasible. Councilman Liebl said that they would still have to do 54th Avenue. Councilman Sheridan said that he felt that every- thing should be deleted from this quadrant, or else leave everything in. He said that he would agree with Councilman Liebl on the deletion of the improve- ment of the two alleys, and would go along with Councilman Liebl, but only for a two year period. A member of the audience said that 4th Street has just been patched and is in quite good shape now. Councilman Sheridan asked how long the street has lasted, The City Engineer said that it was never a standard street, but was a PE mix, then seal coated. THE MOTION SECONDED by Councilman Sheridan. Councilman Breider said that at the public hearing meeting there were com- plaints about the snow plow not plowing the alleys. He said that he wanted to eke clear that if these alleys are deleted, they would not be plowed or maintained as the City does not maintain unimproved alleys. The com- plaint was that garbage was not being picked up. Mr. O'Bannon said that these apartments are the poorest kept in the City of Fridley. Mayor Kirkham asked that when he sees a condition existing, to please call it in so something could be done about it. Mr. O'Bannon said that he would call the Building'Inspection Department next time, A member of the audience said that she has called on complaints on the garbage six times and she has seen rate - gunning from the cans. Councilman Liebl said that when a complaint is reoei,vsd, action is taken and these apartments have been tagged. c9 ncilman Sheridan asked for a call for the question, with the comment that these diplettons would hurt the improvement program. TOWNHOUSE DEMOPMENT Townhouse Development The purpose of this section of the Zoning Ordinance is to provide for and encourage advances in housing design; changes in types of dwellings; more flexibility in layout and site planning; the development of the life -cycle environment; and the more efficient use of land, open space and public facilities. 45.141. Procedure For Townhouse Development Approval Approval Procedure 1. Preliminary Plan: A. The application shall be filed at the Building Inspection Department of the City of Fridley. B. The application shall be submitted to the Building Standards -Design Control Sub- committee for review and recommendations. C. The recommendations of the Building Standards - Design Control Subcommittee will be submitted to the Planning Commission for their review and recommendations. D. The recommendations of the Building Standards - Design Control Subcommittee and the Planning Commission will then be submitted to the City Council for approval of the preliminary plan. 2. If Council approval is granted, the following procedure for the final plan will follow: A., k. final plan will be filed at the Building fi''pection Department. B. The final plan shall be submitted to the Planning Commission for their recommendations. C. The recommendations of the Planning Commission will then be submitted to'the City Council for .final action. 45.142. Application Application 1. Preliminary Plan The owner of any contiguous parcel (s) of land containing five (5) or more acres in any residential district may apply to.the City Council for development of .said tract under Townhouse Development as hereinafter provided. 99 45.142 Application for Townhouse Development shall be made by the owner of the property except that an option holder may apply for Townhouse Development provided his application is ace mpanieGd by signed letters stating ne objection from the owner or owners of all land included in the application. The application shall be filed in the Building Inspection Department and shall be accompanied by a minimum of three (3) copies of the preliminary plan containing the following information. A. Plot plan showing building., parking areas, curbing, driveways, sidewalks, fencing, drainage and outside utilities, etc. B. Landscaping plan showing outside surface develop- ment including sodding, blacktop, concrete, etc., and plantino. C. Architectural plans, sections and elevations specifying the exterior material to be used. D. Density of land use. E. Height of all buildings. F. Size of all buildings. G. Feasibility study for disposal of sanitary waste and storm sewer. H. Proposed water service. I. The proposed geographical staging and timing of the plan. 2. Final Plan: The final plan shall be filed in the Building Inspection Office no later than 90 days.after approval of the preliminary plan is given by the City Council. The final plan shall include,but not be limited to,three (3) copies of the following materials. . A. A final plan indicating placement and type of all buildings and their uses. B. An elevation drawing of the.proposed development which will best indicates the height and size of'all structures. 100 45.143 C. A copy of all deed restrictions, and covenants and a copy of the by-laws of the proposed association of owners including but not being limited to the provision of the "Apartment Ownership Act", Chapter 457, Laws -of 1963, (MSA 515.01 to 515.29). D. Landscape plan. E. Any changes in the final plan caused by amend- ments to the preliminary plan by the City Council. The fee for filing a Townhouse Development which includes the fees for processing the application by the City shall be $100.00. 45.143. Standards Standards 1. Lot Requirements and Setbacks A. Lot Coverage. The maximum ground floor area for the sum of all buildings in the project shall not exceed 25% of total land area in the Townhouse Development. B. Densities District R-1 R-2 R-3 Lot Area/Unit 9,000 Sq. Ft. 5,000 Sq. Ft. 3,000 Sq. Ft. NOTE., The lot area required per dwelling unit shall be computed by including the entire development, including the streets, walks, and other open areas; except dedicated streets and other public facilities. 2. Special Requirements A. The staging of any pian for Townhouse Development shall include the time for the beginning and completion of each stage. Such timing may be modified by the City Council on the showing of good cause by the comer. B. Any and all common open space shall be labeled as such and as to its intent or designed function and provisions for maintenance, ownership, and preservation shall be made in accordance with the provisions of the "Apartment Ownership Act", Chapter 457, Laws of 1963 (MSA 515.01 to 515.29). 101 C. The final plan shall include all proposed covenants, restrictions and easements to run with the land together with any provisions for release from same; provisions for dedication of easement for public streets, ways and facilities; density, size -and location of all structures. All or any of the foregoing may be modified as deemed necessary by the City Council for the preservation of the public health, safety,'morals and general welfare of the residents of the Townhouse Development and the City of Fridley. D. When Townhouse Development is granted in an R-1, District, the following conditions must be met: 1) The development shall consist of owner orpupied dwelling units. 2) Membership in the Townhouse Development shall be.made part of the agreement of the sale of each dwelling unit. 102 45.143
