5. VARIANCES
A. Appeals Commission.
She City Council created an Appeals C udssion to serve as the
board of appeals and adjustment, and to exercise all the
authority and perform all functions of said board pursuant to
Minnesota Statute Sections 462.351 to 462.364 and operate
according to the Fridley City Code.
B. Petition By owner.
(1) Appeals from Decisions on Code Enforcement: At any
time within thirty (30) days, any .property owner who feels
aggrieved by an alleged error in any order, requirement,
decision or determination made by an administrative officer
in the enforcement of this Chapter which affects the owner's
property, may appeal to the Appeals Commission by filing a
written appeal with the City. The appeal shall fully state
the order appealed from, the facts of the matter and the
mailing address of the owner.
(2) Request for Variances frau Zoning Chapter Provisions:
A property owner may appeal the strict application of the
provisions of this Chapter where there are practical
difficulties or particular hardships preventing the strict
application of the regulations of this Chapter. An
application for a variance shall be filed with the City and
shall state the exceptional conditions and the peculiar and
practical difficulties claimed as a basis for a variance.
C. Recommendations By teals ccomission.
Within thirty (30) days after filing an appeal from an.
aclainistrative order or determination, or request for variance
from City Code provisions the Appeals Commission shall hold a
public hearing thereon and shall hear such persons as want to be
heard. Notice of such hearing shall be mailed not less than ten
(10) days before the date of hearing to the person or persons
who file the appeals, and to all adjacent property owners within
a 200 foot distance of the requested variance location. Within
a reasonable time, after the hearing, the Appeals Commission
shall make its recommendations or approvals subject to
conditions of the Fridley City Code and forward a copy of such
recorranendation or approval to the City Council through the
Planning Cor fission.
D. Variances In R-1 Zoning.
(1) In areas zoned R-1 (One Family Dwelling District), the
Appeals Co wdssion has the authority to grant final approval
of variances when all of the following conditions are met:
(a) There is unanimous agreement of the -Appeals
Consnission.
(b) The staff concurs with the recommendations of the
Appeals Commission.
(c) The general public attending the meeting or
responding to the notice of public hearing have no
objection.
(d) The petitioner is in agreement with the
recommendation.

(2) When the above conditions are not met, the variance
request must be reviewed by the Planning Commission with
final approval by the City Council.
E. Record Of Action Taken.
The Appeals Un nission shall provide for a written record of its
proceedings which shall include the minutes of its meeting, its
findings and the recommendation or approval of each matter heard
by it. The finding of fact shall contain the following:
(1) The public policy which is served by requirement.
(2) The practical difficulties or unique circumstance of
the property that cause undue hardship in the strict
application of the requirement.
(3) In recommending or approving a variance, the C=nission
and/or Council may impose conditions to ensure compliance
and to protect adjacent properties.
F. Action By The City Council.
4he Council shall at its next regular meeting, after receiving
the recommendation of the Appeals Commission, with a policy
review by the Planning Cocunission, decide on the action to be
taken.
G. Lapse Of Variance By Non-use.
If work as permitted by a 'variance is not commenced within one
year and completed within two years after granting of a
variance, then the variance shall become null and void unless a
petition for extension of time in which to complete the work has
been granted by the City Council. Such extension shall be
requested in writing and filed with the City at least twenty
(20) days before the expiration of the original variance. The
re uest for extension shall state facts showing a good faith
attempt to ,complete the work permitted in the variance. Such
petition shall be presented to the appropriate body for review
and/or decision.

The petitioner wants to build living space area above the existing
attached garage, which is 5 feet from the south property line. The
house to the south is in front of the existing garage. The proposed
room would have a bay window in it. The building code restricts the
use of windows to a minimum of 3 feet from a property line. Therefore,
if the variance is approved, the maximum projection of the window would
be 2 feet.
The deck along the back of the room should not project south of the
wall of the existing garage.

Ms. Bruflodt stated the neighbor to the south was at the meeting, and they
have no objection to this variance.
fir. Day stated they would like to preserve the existing handic 0, ramp so
they can have entrance to the lower level living quarters whe a the handi-
capped person resides. There was a considerable drop-off an,4 the 30 ft.
setback from the bluff line on the river put them right int6 the middle of
theincline and would still put the garage pretty close to;!he house.

Mr. Day stated that was correct. There would heo need for variance if the

Ms. Savage stated she would agr e. She felt there was a hardship just in the
need for a garage in 11innesota and the fact that the garage cannot be built
attached to the house and sti maintain the handicap ramp. The situation
of the 5 ft. exception was s mething that did exist before the petitioner
purchased the property. Sh would be in favor of granting the variance.

Ms. Campbell stated that, as stated in the Staff Report, the,two issues
of concern to Staff were the fact that the bay window could not project
more than 2 feet and that the deck along the back of the room should
not project south of the wall of the existing garage.
Mr. Jeff Johnson stated he was representing Shirley Severson, who could
not be at the meeting, and Ethel Arnold, the mother of Shirley Severson.
Ms. Severson and Ms. Arnold are co-owners of the property; however,
Ms. Severson is the owner occupant of the property.
fir. Johnson stated the request for the bay window has been dropped so
there will be no overhang of the window on the south side of the building.
fir. Johnson stated that regarding the deck not projecting south of the
wall of the existing garage, there was a stairway coming down and that
was why the extension appeared the way it did. He stated the house and
the garage do not run parallel with the lot line. In talking with the
builder, that was the preferred location for the stairway; however, he
felt that could be reworked to have the stairway access the backyard and
sideyard. They had no problem with Staff's recommendation regarding the
deck.
Mr. Betzold stated he did not know the layout of the inside of the house,
but he wondered if there was any other way additional living space cou'r,
be added without the need for a variance.
fir. Doug Siverhus stated he was the contractor for Shirley Severson.
He stated the house was an older home, and the living quarters were quite
small. There was really no other space to expand except to go up on top
of the garage. The way the house was laid out, it would be too costly
to expand to the east toward the front of the house because the house and
the yard would have to be completely reworked.
Dr. !jos asked how high the structure would be from ground to peak.
fir. Siverhus stated it would be approximately 17 feet.
fir. Johnson stated this was not a normal dormer. The garage slopes from
the front all the way to the rear, so the impact as far as height was
somewhat diminished with respect to the existing structure because it
was a higher roof line that was normally expected for a garage. In
addition, fis. Severson has talked to the property. owner to the south,
6482 Riverview Terrace, owned by Carol Dulany, and the property owner to the
north, 6492 Riverview Terrace, owned by Denise Smith. Both owners have
stated they have no objection to the variance.

Mr. Johnson stated the hardship was there was'an immediate need by
Pts. Severson to expand her living conditions. Additional family was
moving from California to live with her.
Dr. Vos stated the only thing that would be close to the neighbor to
the south would be the deck. The house itself was set at least 10-12
feet ahead of that. There were no common lines unless`''they went at an
angle.
Mr. Barna asked how many square foot of living space was in the house
right now.
fir. Siverhus stated there was 780 sq. ft. of living space and two
bedrooms.

fir. Barna stated he was having a little problem with the hardship. One
adult living in a two bedroom house with 780 sq. ft. of living space,
with another adult relative and possibly more moving in was an ambiguous
hardship. It was already a two bedroom house, and he could not find any
hardship that would justify a variance at this point.
Dr. los stated they have received letters that there are no objections
from the neighbors to the north and south. As a point of interest,
the house to the south was for sale. In looking at the proposed deck,
he would not be comfortable having a 17 ft. structure about 9-10 feet
away from the property to the south.
Ms. Savage stated she had some of the same concerns as those expressed
by fir. Barna and Dr. Vos. This area of Riverview Terrace was kind of
a crowded area to begin with, and she felt it would crowd the area more
by adding living space. She could certainly understand the need for
additional space, but would have to agree that there was not a valid
hardship.
Mr. Betzold stated that since he and fir. Johnson had gone to law school
together, he did not think it would be fair for him to vote on this
issue.

The petitioner is requesting a reduction of this setback from 35 feet
to 15 feet on the west and from 35 feet to 30 feet on the north.
Section 205.17.5, C, 4, requires that for warehouse and storage use,
at least 1 off-street parking space shall be provided for edch 2,000
sq. ft. of such space use. 11
Public purpose served by this requirement is to provide a suffi ient
amount of off-street parking. ,
The petitioner is requesting a reduction from 26 stallsreciired to
3 stalls provided.
Section 205.17.5, D, 5b, of the Fridley City Code requ'res that all
parking and hard surface areas be no closer than 5 f t from any side
lot line, except for a common drive approved by the adjoining property
owners and the City.
Public purpose served by this requirement is t allow for off-street
parking without encroaching on the public rig t -of -way and also the
aesthetic consideration of the neighborhood
The petitioner is requesting a reductiof the hard surface setback
from 5 feet to 0 feet on the east side.
Section 205.17.7, D, 6, of the Fridl y City Code requires that where
any industrial district is adjacent/to any other district, there shall
be a minimum 15 foot wide screenirfq strip to provide for a physical
separation.

site plan attt empts to fulfill the objectives of screening buffers and

buffer and, to the north, a fence of wrought iron with brick columns.
Also be noted is that the north property line abuts a parking lot.

Mr. Robertson, Community Development Director, stated this item was before
the Appeals Commission on October 13 and they recommended denial by a 3 to 1
vote. He stated there was discussion at the Appeals Commission meeting
regarding this proposed expansion on top of the existing garage and
justification of a hardship. Mr. Robertson stated both neighbors to the
north and south had submitted letters indicating they had no objection to
this variance. '
MOTION by Councilman Fitzpatrick to concur with the recommendation of the
Appeals Commission and deny variance, VAR #87-34, due to the lack of a
viable hardship. Seconded by Councilman Goodspeed. Upon a voice vote, all
voting aye, Mayor Nee declared the motion carried unanimously.

Mr. Robertson stated last month the City receiv 4" notice from the owner of
Universal Can that he was selling his com dny to Minnesota Soft Drink
Recycle, Inc. (MSD) . He stated he has tong; ''eted the City Attorney about
what should be done regarding the lease agreement and Minnesota Soft Drink
Recycle, Inc. has agreed to take over tY's lease. He stated staff is quite
comfortable with this transfer and feoc"Minnesota Soft Drink Recycle would
perform according to this agreement,!`'
Mr. Robertson stated it would b/q'''appropriate for the Council to consider
approving the assignment of tki" lease to Minnesota Soft Drink Recycle, Inc.

Mr. David Losey /president of Minnesota Soft Drink Recycle, Inc., stated he
wished toint duce himself to the Council so they have an idea of who they
were and wh ,>' they intend to do in the City. He stated their company was
formed in , g80 by the Minnesota Soft Drink Corporation to recycle beverage
packagi ',g and they are aggressively pursuing recycling. He submitted
brochu s for the Council's review. Mr. Losey stated his company intends to
do aiot of promotion, especially with the business community, for
re/94cling. He stated they now operate six recycling centers in the

within one year of building permit authorization; and (4) facadof garage
