She stated that Council approved a license for a hous trailer for Viking Chevrolet for a two-year period on May 17, 82; however, they did not formally apply for an extension in 984. ADMINISTRATIVE STAFF REVIEW: Request The petitioners are requesting that a variance be granted to reduce the setback from the normal high water line of the Mississippi River from 100 feet to 87.5 feet. The request is for Lot 2, Block 1, Walt Harrier First Addition, the same being 6492 Riverview Terrace N.E. Site A single family dwelling is located on the property. The property is zoned R-3, General Multiple Family Dwelling, as are the parcels to the north, south, and east. Located west of the property is the Mississippi River. Single family dwellings are located east and south of the subject property. Analysis Section 205.25.08.C.(2) of the Fridley City Code requires that all new structures and uses shall be placed not less than 100 feet from the Mississippi River's normal high water line as defined by the Federal Insurance Administration's Flood Insurance Study. Public purposes served by this requirement are as follows: 1. To protect and preserve a unique and valuable state and regional resource for the benefit of the health, safety, and welfare of the citizens for the state, region, and nation; 2. To prevent and mitigate irreversible damage to this state, regional, and national resource; 3. To preserve and enhance its. natural, aesthetic, cultural, and historic value for the public use; 4. To protect and preserve the river as an essential element in the national, state, and regional transportation, sewer and water, and recreational systems; and Staff Report VAR #91-34, 6492 Riverview Terrace N.E. Page 3 5. To protect and preserve the biological and ecological functions of the corridor. The petitioners are proposing to remove an existing deck and replace it with a three -season porch and deck. Decks are allowed to encroach into the required setback by up to 10 feet. Whilethe petitioners do not have the option of constructing a gazebo on the property, nor will the proposed porch adversely impact the Mississippi River, the property owner does have reasonable use of the property without the three -season porch. Therefore, denial of the variance would not constitute a taking. Recommendation Staff recommends that the Appeals Commission recommend denial of the request to the City Council as the property owner has reasonable use of the property. Appeals Commission Recommendation The Appeals Commission voted unanimously to recommend approval of the variance request to the City Council. Ms. McPherson stated the property is located on the Mississippi River and west of Riverview Terrace. The property is zoned R-3, General Multiple Family Dwelling, as are the surrounding parcels. The variance request is to reduce the setback from the normal high water line of the Mississippi River from 100 feet to 87.5 feet. Located on the property is a single family dwelling unit, and the petitioners are proposing to remove an existing deck and replace it with a three -season porch and a new deck to the south of the porch. Decks are allowed to encroach up to 10 feet into the setback area. 91 APPEALS COMMISSION MEETING, NOVEMBER 26, 1991 PAGE 5 Ms. McPherson stated that while the petitioners do not have the option of constructing a gazebo on the property and the proposed porch does not adversely impact the Mississippi River, the bluff line, or the normal high water line, the property owner does have reasonable use of the property without the porch and denial of the variance request would not constitute a taking. Ms. McPherson stated staff recommends that the Appeals Commission recommend denial of the request to the City Council as the property owner does have reasonable use of the property. Dr. Vos stated that in looking at the site plan, a portion of the house encroaches into the setback. Ms. McPherson stated that if the Commission recommends denial of the variance for the three -season porch, it would be prudent to recommend approval of a variance to bring the house into conformance as it is an existing condition. Ms. Savage asked the petitioners to explain the hardship. Mr. Tom Carlson, Sawhorse Designers and Builders, stated the main hardship is the mosquitoes. He stated Ethel Arnold, owner of the property, wants to do a major renovation of the house, and the new porch and deck are part of that renovation. There will be extensive remodeling of the whole main floor of the house so that Ms. Arnold can live entirely on the main floor. The existing deck is unsafe. Ms. Arnold asked them to create a nice three -season porch for her so that she can enjoy the view of the river. He stated they have designed the porch so that it will go with the aesthetics of the house. They are not proposing any structure that is going to stand out. The overhangs and roof slopes will be identical with the existing house. Mr. Carlson stated the bluff is quite high in this area. There is absolutely no chance of the river ever getting to the top of the bluff. The bluff shields the house from the view from the river. This house is on a cul-de-sac with two other houses and is considerably farther back from the river than the house adjacent to it. There are no other houses in that area that are blocking any views of the river. Mr. Rick Riley, staff architect for Sawhorse Designers and Builders, stated he did not know when the 100 foot setback got overlaid. As stated by Dr. Vos, the existing house encroaches into the 100 foot setback line, as well as the existing deck. The three -season porch is a raised structure with an enclosed area and an open deck area with no true structure below it. Mr. Riley stated the Planning Department is charged with finding other alternatives such as a gazebo or another outdoor enjoyment space. There are existing setbacks on the north, south, and east . ., APPEALS COMMIS_S_ION MEETING, NOVEMBER 26, 1991 PAGE 6 sides of the building that will not allow the construction of a three -season porch. The existing building is nonconforming now in that it encroaches into the 100 foot setback. Dr. Vos asked about the drop in grade from the house to the bluff line. Mr. Riley stated the grade is not very steep --less than 5 feet. That is why the perception from the river is little or none at all. Ms. Shirley Severson, 6490 Riverview Terrace, stated her mother, Ethel Arnold, will move into the house after the house is remodeled. Her mother needs the living area all on one level. MOTION by Dr. Vos, seconded by Ms. Smith, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 8:10 P.M. Dr. Vos stated that there are not a lot of options for additions on this property. He believed the uniqueness of having the high water line setback does constitute taking some of the property. If there is only a drop in grade of about 5 feet from the house to the bluff, then essentially the whole back yard cannot be used because of the 100 foot high water line. Part of the hardship is the 100 foot setback, and the fact that the house is already in the wrong place. Ms. Smith stated she believed the public purpose is being served even if the encroachment is allowed. She is reluctant to allow everyone to put a porch off the back of the house that encroaches into the 100 foot high water line, but in this case she did not believe there are any problems. Ms. Beaulieu agreed with these comments. Ms. Savage stated she also agreed. The public purpose is being served and there is no adverse affect on the river or adjoining properties.
