PUBLIC HEARING: CONSIDERATION OF A VARIANCE REQUEST, VAR #94- 20, BY MONTE AND MICHELLE MAHER: Per Section 205.07.03.D.(3).(a), of the City Code, to reduce the rear yard setback from 40'feet to 30 feet on Lots 16-21, Block W, Riverview Heights Addition, the same being 7965 Riverview Terrace, to allow the construction of an addition. MOTION by Dr. Vos, seconded by Ms. Smith, to open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, VICE-CHAIRPERSON RUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:53 P.M. Ms. McPherson stated the subject parcel is located at the northeast corner of Cheryl Street and Riverview Terrace. The petitioners have also applied for a special use permit as the dwelling is located in the flood fringe district of the Mississippi River. The Planning Commission will review the special use permit at its September 7, 1994 meeting. Ms. McPherson stated the subject parcel is zoned R-1, Single Family, as are all the surrounding parcels in the Riverview Heights neighborhood. On the subject parcel is a detached two -car garage and a single family dwelling unit. The petitioners are proposing to construct an addition to the rear of the dwelling. The variance request is to reduce the rear yard setback from 40 feet to 30 feet. This particular parcel is a corner lot with the front being the shortest of the two street frontages, although the front door of the dwelling faces Riverview Terrace. The petitioners are proposing to construct a one-story addition to the rear of the dwelling with three bedrooms and a bath. The petitioners have the alternative of shortening the addition by 10 feet and perhaps widening to make it longer. They can also add on to the front of the dwelling unit. However, this request is within previously granted variances for rear yard variances. Staff does not have a recommendation, but staff recommends the following stipulation: 1. Special Use Permit, SP #94-12, shall be approved. Dr. Vos asked if Cheryl Street was the front of the property. Ms. McPherson stated yes. APPEALS COMMISSION MEETING, AUGUST 23, 1994 PAGE 8 Dr. Vos asked the distance from Cheryl Street to the side of the house. Ms. McPherson stated the petitioner has approximately 88 feet from Cheryl Street to the dwelling. Dr. Vos stated, if this was the front, the structure could be within 35 feet. Because it isn't, they have problems in the backyard. Ms. Smith asked if a variance would be required if this were the side yard. Ms. McPherson stated no. Mr. Kuechle asked if they have to build up to get off the flood level. Ms. McPherson stated new dwellings are to be one foot above the 100 -year flood elevation. The existing dwelling is within that requirement so there is not going to be much grade change between the existing house and the addition. Mr. Maher, 7965 Riverview Terrace, stated his neighbor is approximately 10 feet from his lot line. Mr. Maher has a large yard to what he considers the side. He eventually would like to build on to the front of the house with a kitchen and living room. The house is very small and the lot is large. He wants to put the bedrooms to the back and bring the kitchen and living room forward which is the side with the view. The garage will also be moved to the side. Dr. Vos asked if this would require a variance. Ms..McPherson stated no. Mr. Maher stated his yard is at an angle and he has no way to use that other part of the backyard except with the addition. This still leaves 30 feet from the neighbor. Mrs. Maher stated it was not feasible for them to add bedrooms to the front. They now have one bedroom and they do not want to separate the family. It is feasible to add bedrooms to the back so the family is located in the same area. They need three bedrooms. For them, it is a choice. They love their neighborhood and would like to stay and have a comfortable home. The comment of adding to the front and to the rear does not make sense when thinking of bedrooms. Mr. Maher stated they have a south view and they don't want the bedrooms with a south view. The house is at an angle. The grade APPEALS COMMISSION MEETING, AUGUST 23, 1994 PAGE 9 is level so there is no need for correction. It about four inches above the 100 -year flood level. Mr. Kuechle stated the house looked like it was below the dike. Mr. Maher stated when sitting in the living room they can see the Mississippi River. MOTION by Ms. Smith, seconded by Dr. Vos, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 8:03 P.M. Ms. Smith stated this is an unusual situation where there is discussion about side yard or front yard. In this case, what is referred to as the back yard is the side yard. If this was considered to be the side yard, it would be within the code and would not require a variance. The public purpose is being served, and there is plenty of green space. She would vote for approval. Dr. Vos concurred. The foot print, even with the addition, leaves a lot of green space. The lot has the corner cut out of it so they really cannot move it anywhere and still put on the addition. It makes sense. Mr. Kuechle agreed. Although the way the rules are written, it is not a back yard. It really functions as a side yard. MOTION by Ms. Smith, seconded by Dr. Vos, to recommend approval of Variance Request, VAR #94-20, by Monte and Michelle Maher to reduce the rear yard setback from 40 feet to 30 feet on Lots 16-21., Block W, Riverview Heights Addition, the same being 7965 Riverview Terrace, to allow the construction of an addition with the stipulation: 1.
