YARD SETBACK FROM 29 FEET TO 8 FEET, GENERALLY LOCATED AT 8141 RIVERVIEW TERRACE N.E.: Ms. Dacy, Community Development Director, stated that this is a request for a variance to reduce the rear yard setback from 29 feet to 8 feet in order to allow an addition. She stated that there is an existing single family home located on this property with an attached one car garage., She stated that the petitioner is requesting a variance to extend the existing garage from one stall FRIDLEY CITY COUNCIL MEETING OF NOVEMBER 9, 1992 PAGE 4 to three stalls to.store a boat, full size truck, and possibly a car. Ms. Dacy stated that the petitioner could construct a detached accessory structure; however, this would reduce the remaining useable space in the yard. Ms..Dacy stated that -.staff and the Appeals Commission recommended approval of a variance to reduce the setback from 29 feet to 18 feet to -allow an expansion from a one car garage to a two car garage. She stated that the petitioner could, however, construct a detached 'second accessory building which would conform with the setback requirements. Councilman Fitzpatrick asked if there was an opposition to this request. Ms. Dacy stated that there was no opposition at the Appeals Commission meeting, and she has not heard of any objections. Mr._Droessler, the petitioner, stated that he Mould prefer to add on to the attached garage, but he would construct..a separate building if this was necessary. He stated that by.adding to the existing garage it gives him a little more useable yard space. Councilwoman Jorgenson stated that she felt the attached garage would be more conforming than to'have a detached garage. Ms. Dacy stated that staff and the Appeals Commission recommended the minimum amount of variance, and felt that to attach the garage would be more aesthetically. pleasing. She stated that the petitioner -would .like the variance as originally requested to reduce the setback from 29 feet to 8 feet. Councilman Billings asked the hardship that exists for thia particular piece of property. Ms. Dacy stated that the lot is smaller than a normal single family lot ands. being on a corner, there were two fairly substantial setbacks. She stated that staff Is recommendation for a variance to 18 feet was based on the characteristics of the lot and a minimum variance to allow adequate rear lot area. Mayor Nee stated that the Riverview Heights area has been the subject of many variances because of the way it was platted and developed with small lots. Councilman Fitzpatrick asked the size of the lot. Ms. Dacy stated that it was 60 feet by 116.feet. Councilman Billings felt that staff and the Appeals Commission were. trying to meet the requirements of the code when they recommended the .minimum variance to provide a reasonable .structure .and the least impact. He stated that -he appreciates this concern from staff and from the Commission. Councilman Billings stated, FRIDLEY CITY COUNCIL MEETING OF NOVEMBER 9, 1992 PAGE 5 however, it is his .personal feeling that if a variance is going to be granted, it is the elected officials that will have to take the extra step since they are the ones. who are responsible to the citizens. Councilman Schneider stated that he has no problem with Councilman Billings' concept as long as it is applied one hundred percent. He stated that he felt this variance would upgrade the property. He stated that he recognizes staff is applying a strict interpretation of thecode, and. he is happy they are doing this in their recommendation to the Commission and to Council. Mr. Droessler stated that the adjacent neighbor has stated that. he had no problem with the variance as requested. MOTION by Councilman Fitzpatrick to grant Variance Request, VAR #92-19, to reduce the rear yard setback from 29 feet to 8 feet,. at.8141 Riverview Terrace N.E., with the stipulation that Special Use Permit,,. #92-10, be approved. Seconded by Councilman Billings. Upon a.voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. Mayor Nee stated that he appreciated staff's and the Appeals Commission's work knowing they are* trying to accomplish the overall purposes for the City. Request The petitioner is requesting that a variance be granted to reduce the rear yard setback from 29 feet to 8 feet in order to construct a 20 foot by 24 foot garage addition on Lots 31- 32, Block S, Riverview Heights Addition, the same being 8141 Riverview Terrace N.E. The petitioner has also applied for a special use permit as the property is located in the CRP -2, Flood Fringe District. Site Located on the property is a rambler -style single family dwelling with an attached one -car garage. The property is zoned R-1, Single Family, as are all adjacent properties. The property lies east of the Mississippi River. Analysis Section 205.07.03.D.(3).(a) requires a rear yard setback of not less than 25% of the lot depth with not less than 25 fest permitted or more than 40 feet required for the main building. Public purpose served by this requirement is to provide rear yard space to be used for green areas which enhance the neighborhood. The petitioner is proposing to extend his existing garage from one to three stalls. The petitioner could construct a detached accessory structure; however, this would reduce the remaining usable space in the yard.. As proposed, the addition increases the maximum lot coverage to the 25% threshold. The lot is smaller than the minimum lot area; therefore, the proposed addition has a greater impact. The code requires that all lots shall have a double car garage (Section 205.07.05.B.(1)). Granting a variance to reduce the rear yard setback from 29 feet to 18 feet will minimize the overall impact of the addition while allowing the petitioner to meet another section of the code. Also, the maximum lot coverage is not reached which will allow possible future expansions. If the subject lot has been an interior lot, the variance would have been unnecessary as the garage could be as close as 5 feet to the lot line. Recommendation Staff recommends that the Appeals Commission recommend denial of the request to the City Council to reduce the rear yard setback from 29 feet to 8. feet, but recommend that the City Council approve a request to reduce the rear yard setback from 29 feet to 18 feet to allow the expansion of the garage to two stalls. The following stipulation shall be a condition of approval for either request: 1. Appeals Commission Action The Appeals Commission voted unanimously to recommend approval of a variance to reduce the rear yard setback from 29 feet to 18 feet to allow the expansion of a two -car garage. Ms. McPherson stated this property is located at the intersection of Hugo Street and Riverview. Terrace, west of East River Road. Ms. McPherson stated the petitioner is proposing to construct a 20 ft. by 24 ft. garage expansion to the existing attached single car garage. This addition would increase the maximum lot coverage to the 25% threshold.a The maximum percentage of structures which can cover any single family lot is 25%. Ms. McPherson stated the Code requires that all lots have a double car garage. Granting a variance to allow the petitioner to increase the garage to a double car garage would reduce the variance.requested from 29 feet to 18 feet and would minimize the lot coverage. The maximum lot coverage would not be.reached and would allow for future expansions to the property. Twenty-eight feet would be maintained between the garage addition area and the adjacent single story house to the east. Ms. McPherson stated corner lots are different than the typical interior lots. If this was an interior lot, the garage could be expanded to as close as 5 feet to the lot line. Ms.. McPherson stated that staff recommends that .the Appeals Commission recommend denial of the original request.to reduce the rear yard setback from 29 feet to 8 feet, but recommends that the Appeals Commission recommend approval of a rear yard setback from 29 feet to 18 feet to allow the expansion of the. existing garage to a two -car garage.• Staff recommends - one stipulation for the approval of either the original request or staff's recommended request.: 1. A 20 foot street and utility easement shall be granted over, across, and through the west 20 feet of Lots .31- 321Block.S, Riverview Heights Addition. Mr. Justin Droessler stated that this -is a very small lot. The proposed expanded three -car garage is needed to store his boat, as well as a.full sized truck and possibly a car. As long as he is going to extend the garage, he would. like to extend it to a reasonable size. Mr. Droessler-stated he has trouble with staff's recommendation to expand to a two -car garage. He has been told that if the contractor has to tear down the existing wall in the garage, they will have to tear the whole garage down and build out the 10 feet. So, hi's plan is to leave the wall there and just add 20 feet onto the existing garage so .it would not be as costly. It would cost twice as much to tear down the old garage and rebuild. If he is forced to go with the 10 feet as recommended by staff, he will not do anything. Mr. Droessler stated his neighbor to the east on Hugo Street, and he has no problem with this garage expansion, because there would still be 18 feet between buildings. Mr. Droessler stated he also has the option to build a detached two -car garage, but he believed that would not look very good, and he would prefer an attached garage. 5J APPEALS COMMISSION MEETING, OCTOBER 6, 1992 PAGE 6 MOTION by Mr. Kuechle, seconded by Ms. Beaulieu, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE,. CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 8:40.P.M. Mr. Kuechle stated he has a difficult time recommending approval of a variance for a three -car garage. The petitioner has reasonable use of the property, and he can expand his garage to.a two-car.garage. He.realized that the petitioner can build a two car detached garage without a variance, and he agreed with the petitioner that an attached garage would look better. However, he believed that almost any property owner in the City of Fridley could warrant the need for a three -car garage if they used the same rationale as used here. Although it is nice to have a three -car garage, that is not a sufficient hardship. He stated he would recommend denial.of the proposed variance from 29 feet to 8 feet, but would recommend approval of a variance from 29 feet to 18 . feet. Ms. Beaulieu stated she agreed with Mr. Kuechle. If this variance is approved, they are setting a dangerous precedent. The garage would almost be as large as the house, and this is a small lot. She would recommend approval of a variance to 18 feet. Ms. Savage stated she agreed with both Mr. Kuechle and Ms. Beaulieu. MOTION by Ms. Beaulieu, seconded by Mr. Kuechle, to recommend to City Council denial of variance request, VAR #92-19, by Justin Droessler, per Section 205.07.03.D.(3).(a) of the Fridley City Code, to reduce the rear yard setback from 29 feet to 8 feet to allow the expansion of an existing attached single car garage to a three -car garage, but to recommend to City Council the approval of variance request, VAR #92-19, to'reduce the rear yard setback from 29 feet to 18 feet to allow the expansion of an .existing attached single car garage to a two -car garage, on Lots 31-32, Block S, Riverview Heights Addition, the same being 8141 Riverview Terrace N.E., with the following stipulation: 1.
