PUBLIC PURPOSE SERVED BY REQUIREMENT: Section 205.053, 1B, requires a minimum lot area of 7,500 square feet where a lot is one on a subdivision or plat recorded before December 29, 1955. Public purpose served by this requirement is to avoid the condition of over -crowding of a residential neighborhood,and to avoid an excess burden on the existing water and sewer services, and to avoid reduction of surrounding property values. B. STATED HARDSHIP: "Need the variance to build on the lot." C. ADMINISTRATIVE STAFF REVIEW: The applicant had approval of the lot area variance granted in 1979 (May 15, 1979 Appeals Commission) (June 4, 1979 City Council) but was unable to build the dwelling at that time and the variance lapsed from non-use within one year of approval. He now feels he can build the dwelling, and is again asking for the lot area variance. Riverview Hei4hts was platted many years ago in 25 foot lots. Over the past years, many homes have been built by combining two 25 foot lots to obtain one 50 foot site. There are several homes in this same block that have been built on lots of this size. This lot is located in the flood plain, therefore, the structure must be elevated to a certain level, and in some instances it has been difficult to grade the property to meet flood plain requirements. The staff has no recommendation on the area variance request if the Commission approves it. Appeals Commission Meeting - March 161 1982 Page 2 B. STATED HARDSHIP: "This is a large lot in an old plat. The house is situated so that any split of the lot to form a new buildable site would place the lot line into the required rear yard. The lot is large enough to split into three lots." C. ADMINISTRATIVE STAFF REVIEW: This lot is 111.37 feet by 250.0 feet on the northwest corner of Mississippi Street and Oakley Drive, with the frontage on Mississippi Street. The applicant proposes to split off the northerly 81 feet to maks a buildable site, fronting on Oakley Drive. The existing house is set back 121 feet from the front property line (Miss. St.) leaving a 20 foot rear yard if the lot split is approved. If the Boards decision is to grant this request the staff has no suggested stipulations. ?:r. Mr. Anderson responded that he understood that was the requirement and Fir. Clark added that the 81 feet gave 9021 square feet enough to meet the area requirement. Mr. Clark noted that this item appeared before the Appeals Commission about two years ago. At that time there was a request for two variances, one for'the lot area and one for the side area. The variance for the lot area was approved, but the side yard variance was denied. That recommendation did carry on through the Appeals Commission Fleeting - YLa.rch 16, 1982 Page 4 City Council who asked that the variance be redrafted without the side yard variance. The petitioner redrafted the plans and brought in a new house plan. The new house plan does meet the side yard requirements. The new house will be a full two stories of living area above grade with an attic. The house is to be built on post and beam with no appreciable amount of fill. The elevation will be about 1 foot higher than that of the house to the north and the south. There will be 18" of air space beneath the first floor which is required for maintenance purposes. Ns. Perrozzi indicated that he had brought his contractor with him to explain the plans. Pir. Pizokopowiez, the contractor, indicated that they had eliminated the post footings and were running one continuous frost footing and that it would be blocked up like a aonuentional. house. There would be no driven posts just regular footing. Chairwoman Gabel asked how much fill would be required and Pyr. Pizokopowiez responded that it would be difficult to determine but that they did intend to allow 20" instead of the required 18" of air space. In response to a question about the drainage he noted that they would be using swales so the water would drain to Hugo Street where there is a storm drain. It was also noted that the Engineering Department had looked at the present drainage system and that it was satisfactory. Por. Perrozzi indicated tivit he was pulling the financing together and hoped to build in hay or June. The Contractor further indicated that he had experience building on poor soil so knows it can be a problem but he knows how to deal with it. hr. Barna asked if this was to be built as a private residence and Mr. Perrozzi said he would be living there. Mr. and k:rs. Schneppmueller, neighbors of the proposed building site, voiced a concern over the possibility of crowding since they feel the lot is just too small to build on. Pars. Schneppmueller presented a picture showing the area under heavy moisture. She indicated that right now that lot stops the water from running off and they are afraid if that land is developed the water will run into their basement. Chairwoman Gabel commented that from the previous request the City attorney had commented that the City didn't have the right to force the person owning that lot to provide drainage for the rest of the people. Pars. Schneppmueller asked if there was not also a law prohibiting building on a lot of t:aat siza and Chairwoman Gable answered that there is a provision within the law on the lots platted prior to December 1955 that variances may be granted to make it a buildable lot. MOTION by lir. Barna, seconded by hr. Hippen to receive into the record receipt of a petition that statess "This is a petition against the consideration of a request for variance on Lots 28 and 29, Block R, Riverview Heights, the sane being 8181 Riverview Terrace N.L. to reduce the square footage requirement. from 7500 square feet to 5989 square feet". Mr. Clark pointed out that the only decision to be made by the Appeals Commission is the variance on lot size. All special use permits for grading, drainage and house plans would be considered by the Planning Commission on inch 24, 1982. Its. Clark noted that the most critical area is the garage to the south, but that the house to the north should be okay. rir. Barna noted that there are a number of lots in the area that are 50 feet, but the smallest on Riverview Terrace is 60 feet. He said it is a unique area and that granting this variance might set a precedence since there are two other vacant lots in the area. He personally feels that putting a house between the two existing, even though it is a desirable spot, just wouldn't fit. Chairwoman Gabel stated that they have been allowing 50 foot lots in the Riverview area as the lots were platted before 1955 and as the City said, it is not up to City to force some property owner to provide drainage for someone else. With the cost of housing she feels that Fridley will soon have to change the requirements on the sizes of lots, simply because people can no longer afford to tuy the large lots and build on them. Given the previous findings that the variance was granted and considering how things have changed something is going to built there. If the request is denied it may delay it a few years, but eventually something will go on that lot. MOTION by Mr. Barna, seconded by Mr. Hippen to approve the variance request to reduce the square footage requirement on Lots 28 and 29 recorded before December 29, 1955, from 7500 square feet to 5989 square feet, Block R, Riverview Heights, the same being 8181 Riverview Terrace-N.E. Chairwomen Gabel pointed out that in order to grant a variance, a hardship must be stated. The hardship in this case is that he cannot build on the property without a variance and that no additional land is available. UPON A VOICE VOTE, WITH GABLE AND HIPPEN VOTING AYE, BARNA NAY, THE MOTION CARRIED. Chairwoman Gable noted that this item would go on to the Planning Commission and City Council along with the Special Use Request. Mr. Clark noted that it might be possible that a low spot could be created in the lot, perhaps to the front or side of the house, put a catch basin in and run a pipe to the river for drainage. Then it would flood only in extreme` conditions. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. 8 RECEIVING THE PLANNING COMMISSION MINUTES OF MARCH 24, 1982: Q REQUEST FOR SPECIAL USE PERMIT SP #82-01 (REAPPROVAL OF SP #79-04 C7 A TO ALLOW CONSTRUCTION OF DWELLING IN FLOOD PLAIN CPR -2 ZONING , OSEPH EROZZI• Mr. Flora, Public Works Director, stated Mr. Perozzi applied for a special use permit in 1979 which was approved by the Planning Commission and City Council, however, no work was started or any extension applied for and the permit has now expired. Mr. Flora stated, therefore, Mr. Perozzi has made another request for a special use permit for building on his property. Mr. Flora stated the Appeals Commission reviewed this request and granted a variance for the lot size, and no set back variance was granted this time, as it was not needed since the placement of the structure on the lot has been changed. Mr. Flora stated the City's concern was the drainage and there will be swales and acatch basin. He stated the Planning Commission has recommended approval of this special use permit, with the stipulation that the City be satisfied that the drainage plan, as described and discussed, would be obtained in.. construction. Mr. Flora stated the staff's position is that they would like to insure the elevation of the first floor, of this two story structure, be construc- ted above 827 feet and the drainage is worked out in accordance with the plan proposed. Councilman Fitzpatrick stated one of the things that bothered residents was that this proposed structure would be high in comparison with the adjacent structures. He stated he is sympathetic to the persons who objected to it, however, what is proposed is totally within the ordinances. Mr. Perozzi, the petitioner, stated he would be building the home for occupancy by himself and would contact the people on either side of him so they would know what he is proposing. He stated he has had some contact with the person to the north, and felt any problems could be worked out, however, he hasn't been in contact with the person to the south. Mr. Perozzi felt they have the drainage worked out and it wouldn't be a problem. He stated he has consulted with engineers and take their word that the drainage will" work.
