FRIDLEY CITY CODE, TO REDUCE THE MINIMUM SIDE YARD REQUIREMENT FROM 10 FEET TO 3 FEET TO ALLOW THE CONSTRUCTION OF AN ADDITION ONTO AN EXISTING DWELLING LOCATED ON LOTS 21, 22 25DAND 26,B,UCK Q, RIVERVIMJ HEIGHTS ADDITION. THE SAME BEING 8215 RIVERVIEW TERRACE N.E., FRIDLEY, MINNESOTA. (REQUEST BY MR. ROBERT P. DOHERT 8215 RIVERVIEW TEkRACE N.E.. FRIDLEY, MINNESOTA.) Mr. Doherty was present to present the request. Pictures of the lots and a verification survey were shown to the Board. Mr. Doherty explained he wants to add on a 14 foot by 26 foot addition onto the front of the existing house. The problem is that the existing house is only 3 feet from the lot line so the addition will also be only 3 feet from the line. The existing house was built in 1946. He said his main purpose for the addition is to get more room since the main house is small to begin with. It will be used for a living room, family room and a small office. Mr. Al Williams, who has an interest in Lots 27 and 28, Mr. Dennis Berry, 680 Ironton Street and Mr. Raymond Weitbrecht, 690 Ironton Street, were present and interested in learning what Mr. Doherty was proposing. Mr. Williams stated he has a purchase agreement on the two adjacent lots ,to the North that are owned by an estate. The lots were probated in Wisconsin but have to be probated again in Minnesota. The owners live in California. He said he owns the 3rd & 4th adjacent lots to the North. Chairman Minish asked Mr. Belisle if granting the variance would create problems for Mr. Williams in building on his lots. Mr. Belisle answered the variance would add to an existing non -conforming use and would restrict building on the adjacent lots as there has to be 15 feet between structures and 20 feet between living areas. The addition would also be increasing the fire hazard between structures. He asked Mr. Doherty if he had considered building onto any other part of the house. Mr. Doherty stated that economics dictated which way they could add on. This is the only way to go to get the maximum benefit for them. Any other way would disrupt all of their plans. This plan would also blend in very nice with the existing house. He said in answer to the Boards questions, that the addition will not have a second story and there will be just a crawl space under it. Mr. Crowder asked if Mr. Doherty had talked to a builder and if the builder could build the addition as proposed. Mr. Doherty said his sketch is just a rough sketch and some ideas could be changed but he has had estimates from 3 contractors and they can build according to his measurements. Mr. Williams asked if it would make any difference on his lots if he placed the garage in the rear yard and ran`the driveway along the property line. Mr. Belisle said there would have to be 15 feet between structures. �. Mr. Williams said that with a SO foot lot you don't have to much choice. He said he doesn't wish any hardship on Mr. Doherty but he is concerned about building on his property. 3. Mr. Sondheimer asked what the north wall of the house and addition will be covered :with. Mr. Doherty said the outside wall will have wood shingles. MOTION by Harju to close the public hearing. Seconded by Sondheimer. Upon a voice vote, there being no nays, the motion carried unanimously. -Chairman Minish asked Mr. Doherty if he had planned any windows on the north side of the addition. Mr. Doherty said they had planned to have 1 window. The existing dwelling has 4 windows on that side. Mr. Sondheimer stated he was concerned about the position of the garage to the adjacent dwelling and making it safe in case of fire. This could be especially dangerous with wood shingles. MOTION by Wahlberg to recommend to Council approval of the variance if consideratiow if given to eliminate the fire hazards. Mr. Harju added the stipulation that there be no windows or overhang on the north side of the addition. Seconded by Harju. Upon a voice vote, there being no nays, the motion carried unanimously. Mr. John Christenson and Mr. Roger Christenson were present to present the request. A house plan of the proposed two family dwelling was shown to the Board. WIDTH ON A STREET SIDE OF A CORNER LOT FROM 17.5 FEET TO 12.5 FEET TO ALLOW THE CONSTRUCTION OF A TWO FAMILY DWELLING ON LOT 5, BLOCK 5, MELODY MANOR ADDITION, THE SAME BEING 7396 SY!VHONY STREET N.E., FRIDLEY, MINNESOTA. (REQUEST BY JOHN D. CHRISTENSON, 929 CROSS STREET, ANOKA, MINNESOTA): The Engineering Assistant reported this building would be located on the corner of 74th and Symphony and is zoned R-2 (double bungalow). He then presented a plot plan and the plan for the building on the easel. The neighborhood has presented a petition in favor of the building as presented. CHRISTENSON FOR PROPERTY LOCATED AT 7396 SYMPHONY STREET N.E., WITH THE CONDITION THE CONSTRUCTION BE IT1 ACCORDANCE WITH THE PLANS SUBMITTED TO THE CITY OF FRIDLEY: MOTION' -:by Councilman Mittelstadt to receive Petition #2-1972 dated March 28, 1972 and received this date. Seconded by Councilman Breider. Upon a voice vote, all ayes, Mayor Liebl declared the motion carried unanimously. The Engineering Assistant explained that there is to be a single car garage on one side of the double bungalow and a double car garage on the other side. The Code requires four parking spaces, therefore, the neighbors would like the £o-tirth parking space in some inconspicuous place in the back yard. The side yard set- back would be 12.5 feet. The variance is to reduce the required side yard from 17.5' to 12.51. Councilman Breider asked if he meant that it would just be a piece of pavement in the back yard and the Engineering Assistant replied yes. Councilman Breider said as a practical matter, the fourth parking stall would be in the driveway the same as for single family dwellings with a one car garage having two cars. The Engineering Assistant said that is probably the way it would work, however, to meet the Code, they must provide four parking stalls. Re said that this area may become a place to park a boat, snowmobile etc. Mayor 4iebl commented that this looks like a good plan, they use brick � way up the building. He agreed with the comment in the minutes, that he would hate to see a good plan sacrificed just because of a fourth parking stall. ION by Councilman Breider to concur with the recommendation of the Board of Ap als and approve the revuest for a variance by John Christenson, subject to th Board's stipulations.
