Notice is hereby given that the Appeals Commission of the City of Fridley
will conduct a Public Hearing in the City Council Chambers at 6431 University
Avenue Northeast at 7:30 p.m. on Tuesday, June 14 , 1983 in regard to the
following matter:
Request for variance pursuant to Chapter 205 of
the Fridley City Code, to reduce the required side
yard on a corner lot from 17.5 feet to 13.5 feet to
allow construction of an 8 foot addition to existing
garage on Lots 12, 13, and 14, Block 0, Riverview
Heights Addition, the same being 8301 Riverview
Terrace.
Notice is hereby given that all persons having an interest therein will be
given the opportunity to be heard at the above time and place.

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.053, 4B, #5a, requires a minimum side yard width of 17.5 feet
on the street side of a corner lot.
Public purpose served by this requirement is to maintain a higher degree of
traffic visibility and to reduce the "line of sight" encroachment into the
neighbor's front yard.
B. STATED HARDSHIP:
"Existing single car garage was built 21.5 feet from the side property
line. In order to obtain a two car garage (20' x 221) encroachment of 4
feet into the required side yard is necessary."
C. ADMINISTRATIVE STAFF REVIEW:
The original house was built in 1968 with a single stall garage. With the
adoption of the new Zoning Code, the City is encouraging the development of
double car garages and in fact require double car garages with new house
construction. This should be promoted within the limitations of the
setback requirements and the public purpose served. In this case,
Riverview Terrace, north of Kimball Street, is a dead-end road and only
serves as access to three residences and does not generate a high amount of
traffic where visibility would be a problem.
The house directly east of this property is set back at 12.4 feet and
therefore does not suffer from encroachment with the expansion as per this
request.
The staff has no stipulations to add to this variance if the Board approves
this request.
NOTE: This property is outside of the Flood Plain.

B. STATED HARDSHIP:
'Would like to build a screen porch which would extend 11 feet from the
existing structure. There is an undedicated street which makes the 7995
property a corner lot. The City would like to vacate the street; however I
would like to use the porch this summer."
C. ADMINISTRATIVE STAFF REVIEW:
This property is located on a corner subject only to dedicated right of
way. Dover Street,. east of Broad, will not be improved because of the
differences in grade between street surfaces. Although the right of way
makes this property a corner lot and therefore requires additional setback,
the public purpose served by the requirement does not apply to this
property. There is no street traffic which would require visibility. The
property to the east is on top of the hill and is not affected by the "line
of sight" encroachment.
The staff has no stipulations to add to this variance if the Board, approves
this request.
Mr. Clark reported that the Staff Report pretty much explained everything. Mr. Plemel
asked if there was anything in the works of vacation. Mrs. Eastwood said she did
not know of any. Mr. Clark presented the plans for the 3 -season porch and said it
will not be seen from the street and meets the building code. Mr. Plemel asked what
would happen if the street were vacated and Mr. Clark said there would be no en-
croachment. Mr. Plemel asked if the porch would be living quarters and Mrs. Eastwood
said no, it would just be a porch.
MOTION by Mr. Betzold, seconded by Mr. Barna, to close the public hearing. UPON A
VOICE VOTE, ALL VOTING AYE, CHAIRPERSON GABEL DECLARED THE PUBLIC HEARING CLOSED

Mr. Barna noted that there will probably not be a street going in there and even
if there was a street, there would be no interference and Ms. Gabel noted that the

Mr. Clark presented some photos of the area and said that, regarding the "line of
sight" encroachment, you would have to be almost in front of the house to see
anything. Ms. Gabel noted there are a lot of trees in the area and asked if the
trees and telephone pole are a problem. Mr. Moore said he didn't see any problems
and the trees are very helpful during winter snowstorms. He said he presently
has 'a 14' X 22' garage and would like a double garage to keep the additional car
off the street and the extension would be either 6 or 8 feet. He said he is getting
estimates and somebody else will be doing the work. Ms. Gabel asked about the roof
lines being tied in. Mr. Moore it will look like part of the original structure.

B. STATED HARDSHIP:
"The present signs are obsolete and the cost of refurbishing would be
prohibitive. Chevrolet Motor Division, as part of our Dealer Sales and
Service Agreement, has asked us to instll GM identification signs to be
compatible -with -the rest of their GM dealers".
C. ADKINISMT1U STAFF REVIEW:
The existing free standing sign is 343 square feet and is 35 feet high.
This was originally installed on June 179 1965 and used to advertize Edison
Mobile Homes. When Viking Chevrolet purchased the property, they repainted
the sign with their name and product. At this time, Viking Chevrolet, at
the request of General Motors, wants to erect two (2) new standard Dealer
Identification signs and remove the existing free standing sign. The new
Identifications signs will have a total sign area of 371 square feet with
one (1) sign being forty-seven (47) feet high and the other being
thirty-six (36) feet high.
Viking also wishes to erect two (2) 119" x 695" (approximately 7 square
feet) directional signs to inform customers where the body shop and service
departments are located. The seven (7) square feet is three (3) more than
the maximum allowable of four (4) square feet. In addition, Viking has an
existing 2' x 12' (twenty-four (24) square feet) directional sign that is
only two feet off the right of way. This sign was erected without a sign
permit. Approval of a variance to increase the maximum allowable sign area
from twenty-four square feet, and a variance to permit a sign two feet
from the right of way instead of the permitted ten feet would allow the
staff to issue a sign permit.
In addition, there are several signs painted directly on the building and
Instead of applying for a variance to allow this, Viking Chevrolet has
agreed to paint over these signs. Finally, Viking Chevrolet has indicated
that they will be reconditioning all of the existing signs.
Ms. Gabel noted there were several variances and they should start with the first
two free standing signs. Mr. Clark presented aerial photos of the area which showed
the general location of the signs they are requesting and said the directional sign
is on Fireside Drive, a half block off Highway #65. Mr. Peugh (Signcrafters) said
one free standing sign is for the corporation I.D. for Chevrolet and the other is
for Trucks, 151 X 15-• and 11' X 111. He said he talked to GM about the signs and
they do make a 42' sign. Ms. Gabel said she could understand about the GM corporate
I.D. sign and asked about the Truck sign. Mr. Peugh said GM wants a Truck sign.
He said their present sign is about 35 feet and they asked for a 47 foot sign but
they can get a 42 foot sign. Ms. Gabel stated that GM is aware that cities have
sign codes and asked if they are aware how much they are out of code. Mr. Peugh
said they are aware. Mr. Plemel asked if the square footage would change if the
sign were lower. Mr. Peugh said it would remain the same. He said the sign would
be interior lit stainless steel and the concrete would be covered with metal.
Ms. Gabel asked why they want to go from 25' to 47' and 25' to 361. Mr. Peugh
said that is what GM stated and the dealer does not have much to say about it.
Ms. Gabel said she was sure they would cut it down if they have to and that when
she worked on the sign committee they found out that corporations would cut down
signs because of all the different city codes.
