Ms. McPherson stated this property is located at the intersection of Riverview Terrace and Kikball Street in the northwest corner of the City. The property is zoned R-1, Single Family Dwelling, as are all adjacent properties. The single family dwelling faces the Mississippi River. At that time, it was the petitioner's intention to expand the single car garage to a two car garage by adding 8 feet on the south side of the existing garage. The existing garage is 14 feet by 22 feet. At that time, the Appeals Commission voted unanimously to approve the variance request; however, the petitioner did not begin construction within the one year timeframe as required by Code. Ms. McPherson stated the petitioner has revised his original variance request and has reduced the amount of encroachment by proposing to add a 6 foot addition onto the existing garage. If the variance is approved, the resulting addition would be 17 feet 2 inches from the curb line and 15 feet 2 inches from the property line. Ms. McPherson stated the Fridley City Code does require that each dwelling unit have a two -car garage; therefore, granting the variance would allow the encroachment but would also bring the property into compliance with another section of the Zoning Code. Ms. McPherson stated the proposed addition to the garage does not appear to adversely impact any adjacent properties. . Ms. Savage stated that since this property is fairly close'to the Mississippi River and is in the Six Cities Watershed District,'is there any need for a permit from the Watershed District? Ms. McPherson stated, no, the property is out of the flood fringe (CRP -2) district which is an overlay district, and the impact to the property is such that a permit from the Watershed District is not be required. Dr. Vos asked how large the garage could be if the petitioner had to'build within the 17 1/2 feet. Ms. McPherson stated the petitioner could probably add approxi- mately three feet onto the existing garage. The petitioner does have an alternative in that he could demolish the existing garage and build a detached garage in the rear yard to meet the 17 1/2 foot setback, but that alternative does not seem very logical. Mr. Moore stated he has not received any opposition from his neighbors. A two -car garage is really needed, and it is also a requirement in the Code. The single family home next to him on Kimball Street is closer to the street than he will be with a double car garage. MOTION by Ms. Smith, seconded by Dr. Vos, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:46 P.M. APPEALS COMMISSION MEETING. JANUARY 12, 1993 PAGE 3 Ms. Smith stated that she did not believe the proposed addition to the garage will cause any problems. She believed the public purpose is being met as the addition should not cause any problems with sight lines from the neighbors. She would be in favor of approving the variance. Dr. Vos agreed. He stated the other option the petitioner has to build.without a variance is to expand the garage only about 3 feet, and that would not be an adequate sized two -car garage. Also, the petitioner does not have full use of his property if he cannot build something to comply with City Code which is the two -car garage. Regarding the sight lines and the location on the corner, this seems like a reasonable request. Ms. Savage stated she agreed with both Ms. Smith and Dr. Vos. STATED HARDSHIP: See attached letter from petitioner dated November 30, 1992. B: ADMINISTRATIVE STAFF REPORT Request The petitioners request that a variance be granted to reduce the side yard setback on the corner side of a lot from 17 feet 6 inches to 15 feet 2 inches in order to allow an addition to an attached garage. The request is for Lots 12 - 14, Block O, Riverview Heights Addition, the same being 8301 Riverview Terrace. Site The property is located in the northeast corner of the intersection of Riverview Terrace and Kimball Street. Located on the property is a single family dwelling unit with an attached single car garage which faces the Mississippi. River. The property is zoned R-1, Single Family Dwelling, as are all adjacent properties. Analysis Section 205.07.03.D.(2).(c).((I)) requires that the side yard setback on the street side of a corner lot shall not be less than 17 1/2 feet. Public purpose served by this requirement is to maintain a higher degree of traffic visibility and to reduce the "line of sight" encroachment into the neighbor's front yard. The petitioners processed a variance request in 1983 to reduce the same setback from 17 1/2 feet to 13 1/2 feet. At that time, the Appeals Commission voted unanimously to approve the variance request. The staff review included encouraging development of two car garages as the new Zoning Code required two car garages with new house construction. The staff review indicated that the adjacent property would not be adversely affected by the variance request. The petitioners have since revised the variance request to reduce the amount of variance required. The petitioners are proposing to add a 6 foot addition as opposed to the original 8 foot addition requested in 1983. If approved, the resulting addition would be 17 feet 2 inches from the curb line and 15 feet 2 inches from the property line. The City Code still requires that a two car garage be constructed with all new dwellings; therefore, granting the variance would bring the property into compliance with the section of the Zoning Code. The proposed addition would not adversely impact the required lot coverage. PUBLIC PURPOSE SERVED BY REQUIREMENT: Section 205.053• #B, l5a, requires a minimum side yard width of 17.5 feet* on the street side of a corner lot. Public purpose served by this requirement is to maintain a higher degree of traffic visibility and to reduce the "line of sight" encroachment into the neighbor's front yard. B. STATED HARDSHIP: "Existing single ear garage was built 21.5 feet from the side property line. In order to obtain a two car garage (20' z 22') encroachment of 4 feet into the required side yard is necessary." C. ADMINISTRATIVE STAFF REVIEW: The original house was built in 1968 with a single stall garage. With the adoption of the new Zoning Code, the City is encouraging the development.of double car garages and in fact require double car garages with new house construction. This should be promoted within the limitations of the setback requirements and the public purpose served. In this case, Riverview Terrace, north of Kimball Street, is a dead-end road and only serves as access to three residences and does not generate a high amount of traffic where visibility would be a problem. The house directly east of this property is set back at 12.4 feet and therefore does not suffer from encroachment with the expansion as per this request. The staff has no stipulations to add to this variance if the Board approves this request. NOTE: This property is outside of the Flood Plain. Mr. Clark presented some photos of the area and said that, regarding the "line of sight" encroachment, you would have to be almost in front of the house to see anything. Ms. Gabel noted there are a lot of trees in the area and asked if the trees and telephone pole are a problem. Mr: Moore said he didn't see any problems and the trees are very helpful during winter snowstorms. He said he presently has a 14' X 22' garage and would like a double garage to keep the additional car off the street and the extension would be either 6 or 8 feet. He said he is getting estimates and somebody else will be doing the work. Ms. Gabel asked about the roof lines being tied in.
