I have recently placed several calls to your offic� and you either have not gotten the message or you have choosen not to call back. This letter is our final notice on these matters and if you fail to complete any of the following items, I have no alternative but to refer this matter to our City Attorney for his legal consideration. (1) 141 - 71st Way N.E., Foundation Wall Correction: This matter was first brought to your attention on October 3, 1986 when we asked that you engage the services of a structural engineer to certify the previous attempted correction. It took you until May of 1987 to get the report, dated 5/20/87, by Horgan Engineering. The report indicates that additional reinforcement is required. I have discussed this correction issue with you on several occasions; the last recorded time was July 1, 1987 when you stated you would complete the correction as per the engineering report and have the engineer recertify the correction on or before the end of July, 1987. The end of July is only a few days away. Therefore if you can not complete this work by July 31, 1987 we are willing to give you until August 14, 1987 to do so. (2) 7130 Riverwood Drive N.E., New House Construction: (a) Add a register in the warm air plenum. (b) Retuck the block in the rear basement wall where a hole was left after pouring the basement floor. (c) The future fireplace pit has been filled, however the webs were left open. They must be grouted to keep water out. (d) The owner recently pointed out that the blocks along the south wall of the garage have open joints: these must be cemented shut. E. , New House Construction: As you know, construction was abandoned after a basement was constructed at this location and the lot has weeds and other debris on it. The basement is not capped and poses a danger to bodily injury if someone was to fall into it. This too was brought to your attention on various occasions; the last time was July 1, 1987 when you stated you would clean it up and either cap the basement or fence it by the end of July. lis work must also be completed by August 14, 1987. (4) 7104 Riverwood Drive N.E., New House Construction: This home is now in the stage of being f ramed. We do need a verifying survey for it. We will not conduct the final inspection on it until we have received the required survey. We hope that this letter is all that is necessary to obtain compliance on these matters. There were many things unfinished when we moved in not only that we were concerned about getting done but also the City of Fridley had a list of concerns too. To begin with our sod was put in a week before we moved in and was never watered. Of course the strips of sod shran!',1 and most of our sod is ruined. What parts did come back have so many weeds from the shrinage everything is very poor. Our allowance for landscaping was forgotten and Mr. Moselle decided for us what we wanted and had whatever put int. In the middle of June we had a walk through to tell Mr. Moselle and his helper Chris what we ''knew at that time what had to be done. They did not bring with them any forms or even paper to write down our concerns so we just walked around and talked about what had to be done. July 6, 1987 I notified Mr. Ifoselle that we had water in the basement right under the front entry. One week later I talk to Chris and asked if they would please come and look att,the sidewalk in front because it was moving. Another week went by and the sidewalk was cracked and the steps started to move away from the house. By the end of July we got Mr. Moselle to come out and look at Vle steps and sidewalk. His only comment was "Talk to God". We then went to the City of Fridley Building Inspection for help. The inspector told us the water In the basement was caused from the ground giving way under-k.the step and also warrened us to take the insulation off the walls in the basement so the blocks and wood could dry out. He also discovered that the footing under one side of the steps was missing. It took him a month and a half to get Mr. Moselle to come out and put a footing under the stemp. Last winter the steps moved so much we could not at times open the front door. Aug. Chris came out to do some repair work. A handle on the window'in the family room needed replacement so he fi:.ed that but cracked the frame. He fixed a hole in the screen on the porch but forgot to nail the board back down so the screen popped out over the winter. Heydropped off the grids for the living -room windows and as'_ed me to "slop some statin on" and he would be back to install them. He installed some wood wor% in the upstairs bathroom but didmtt cover the nail holes -- other wood work in the house hasnft any nails marks that show. Sept. both Pair. Moselle and Chris came to talk about what needed to be done. Mr. Moselle said he didn't have any money. Chris said he would do some repairs that day but both got in their trucks and left -- without doing anything. This same month a roofer came by at the request of Mr. Moselle to repair our roof and the roof on the house across the street from us. He stopped to talk to my husband about our roof and said, "this is not a repair job - it is too masgive to be a repair job." He left to tall: to Mr. Moselle. In Jan. 1988, when talking with Mr. Moselle about the roof he told me he was not going to repair it because it did not leek. Oct. came and we turned the furnace on - from the first night I heard a noise li'.e a leeky faucet. I reported this to Mr, Moselle and personally tall, to Chris, who was wor'wing just a half a block away from our home, on two different occasions and asked him to came down and see what was wrong. He did not respond. Nov. 1$, I,00ntected the heating sub -contractor to come out and see if they could find out whet was wrong. The noise in the furnace kept getting worse, the coder it got outside the more the furnace went on, the more we heard the noises in the walls. They came out but couldn't find anything wrong but thought it was the pipe that ran down the full length of the house -- he would get back to us. Dec. I called the heating company again to find out what they were going to do and their decided to come out and replace the pipe we had talked about. The noise then_ got torsed I contined to call them on a daily basis - trying to get them to get the problem solved. The first part of Jan. IIr. Aioselle called. because the heating contractor wanted rye to stop calling them. I asfYed him to please come out to see form him::elf - 111 otl - then could Chris come out & meet with the heating people -v:hen they were coml.ng out - "No" - I talked to Chris myself and rsked hire to please stay on top of this problem because the noise was so terrible. I have never talked to him again about this problem andhe has not contacted me to see if this ever got fi,.ed. He did r_Othing. I also called in Jan. to report t,:at our kitchen cabinets were moving apart. This is when I learned of the McMullen/iioselle partnership break-up. The new name would be St. Charles Homes, Happy Moselle, President and new location of Egan. There was never any notification f,,f this to us. Feb. I contacted the Sheet Metal Union for some help with the heating sub -contractor. A.me6ting was arranged between the I,11anager of the heating company, myself and the pipe manufacture at our house. It was determined at this meeting that the pipe had a defect -- it was replaced in the triddle of Fob. Chris set-up a time in Jan. when he would be out to picl.-up a list of thingb_'.th.at-endeded tb�done in our home. He missed that date but showed up 3.weel,�s later unannounced and at that moment in time my husband could not find the List. He did not come prepared to fi<. anything that we had tali -ed about over the last 7 months. March I called to complain about nothing getting done Chris told me it was my fault becauCe I had not supplied him with a list of things to be done. Also. I co-,.-.ldnft even "slop on the stain on the grids" after all he was Going me a favor by givingme those grids. (gridsfr7.r our living -room windows) Those grids ere in our contract - I have already paid for them and the labor to put them in - stained. He then said. tl.2t I•:r. Mr. Moselle has been aware of all the things wrong with our new home for over a year and has n.,t made any major attempts to do anthing. I am enclosing the letter I'!r. 'Fosell_e sent to me in Iiarch and our reply. The City of Fridley hao filen a complaint against Mr. Moselle for replacement of our sicLewalk which was to be fix.ed by June of 1988. I have nov- contacted the Plumbers Union for help with our plumbing problems. Mr. I.iosell.e has not, on our behalf contacted any sub -contractor to get anything done. It too'- us 1. year anti 4 weeks just to get o,.,.r cabinets adjusted by the sub-cc;ntract -- something they tolde me Mr. Moselle was responsible for. Some of the oti-ier sub have told me the reason they are unwilling to come out is because they have not been paid by Er. Moselle. June ld, 1986 Chris called to as?:_ if he could come out to our house on June 17. He said he Cres coming out and would stay until everythin on the list was completed. He was suppose to arrive about 8130 am or 0:00 am. He arrived at 10:30 am and left at 12:30 pm. He replaced the vrindo-v frame in the family room but didn't varnish it --- he replaced some of the molding in our front entry -,stained some of it tLe wrong color and didn't stain other at strips at all but nailed it in anyway. Chris left without saying anythin or ever selling to say whet would hamppen neat. We are now gathering estimbtes for the grass, steps, and sidewalk to be replaced as soon as possible. Also three other familes in our area besides ourselves with similiar problems have contacted the law firm of O'Connor and Hannan in reference to a possible law-suit against Mr. 1oselle.
