This is to inform you that we have no objection to the request
for a variance for igen and Diane Warner to remodel and build
an expanded garage.
We realize the proposed expansion would place the west wall of the
1. garage closer to.our mutual lot boundary. However, since our
house sits in from the line,, there would still be.ample space
between the garage and our home
In addition, we realize that the exp nded:storage this structure
will provide for additional vehicles rather than the one car
capacity of the present building will add to'the-security
and appearance of the neighborhood.

A. PUBLIC PURPOSE SERVED BY REOUIREMENT:
Section 205.07.3D.3a requires a minimum rear yard setback of not less
than 25 percent of the lot depth, with not less than 25 feet permitted
or more than 40 feet required. Public purpose served by this require-
ment is to provide rear yard space to be used for green areas which
enhance the neighborhood.
B. STATED HARDSHIP:
"Present garage is 30 feet from lot line and is a single car garage,
which barely has room for one vehicle plus bicycles, a lawn mower and
minimum amount of lawn and garden supplies. Since we, as most families
in the area, own two vehicles, this necessitates one vehicle to be left
outside at all times. In addition, we have a trailer which must now be
stored in the back corner of the lot and a boat which must be stored
off the premises. The ability to'secure these items inside the qarage
would add to the aesthetic value of the property as well as the security,
not just to our property, but the neighborhood in general, since we are
on the corner."
C. ADMINISTRATIVE STAFF REVIEW:
The only stipulation the staff has to recommend is that a hard surface
driveway be provided for the new garage.
Mr. Clark stated the Commission had a picture of the property looking from
the side street where the new construction would take place. They also had
an aerial photo showing the lot lines and the approximate location of the
addition. He stated the petitioners have hired a home designer, and the
petitioners have plans to show what they intend to do with the addition.

It will be a two -car garage moved farther to the west than the existing garage
and between that and the house there will be a porch with some passive solar
glazing. He stated he felt this was a rather energetic project. He stated
there will still be about 25-30 feet between this structure and the neighbor-
ing structure.
The petitioners explained their plans to the Commission. Ms. Warner stated,
that the Commission had received a copy of a letter from their neighbors,
Clarence and Mary Lou Krueger, 173 Pilot Ave. N.E., stating they had no objec-
tion to the request for variance.
MOTION BY MR. BETZOLD, SECONDED BY MR. PLEMEL, TO RECEIVE INTO THE RECORD THE
LETTER DATED MAY 24, 1985, FROM CLARENCE AND MARY LOU KRUEGER, 173 PILOT AVE.
N.E., STATING THEY HAD NO OBJECTION TO THE VARIANCE.

Mr. Betzold stated most of the requests the Commission receives along the same
lines as this request are for side yard setbacks instead of rear yard setbacks,
and corner lots always cause a problem in that respect. Because of the way
this house is located on the lot,it's somewhat of a unique situation. By grant-
ing the variance, they would still be allowing plenty of room between this
structure and the neighboring structure, and he felt that was what the Citv
code was intended to do --to protect both the side yard and rear yard setbacks.
He did not think this variance violated the intention of the city code, and he
would be in favor of',granting the variance.
Mr. Plemel agreed. He stated this could not be considered a detriment or visual
pollution to the neighborhood. He thought this would be an attractive addition
and would certainly solve the petitioners' storage problems.
Mr. Barna stated the public purpose as stated was "to provide rear yard space
to be used for green areas which enhance the neighborhood". By storing vehicles
in the yard, it certainly did not enhance the green areas. This looked like a
very nice structure that the petitioners planned on building, and he would be
in favor of granting the variance.
MOTION BY MR. BETZOLD, SECONDED BY MR. PLEMEL, TO APPROVE THE VARIANCE REQUEST
PURSUANT TO CHAPTER 205 OF THE FRIDLEY CITY CODE, TO REDUCE THE REAR YARD SETBACK
