Anoka County
Pursuant to authorization by the Minnesota Pollution Control Agency (MPCA), and
in accordance with the provisions of Minn. Stat. chs. 115 and 116, plans are
approved and a permit is hereby granted to the above -referenced Permittee for
the construction and operation of a sanitary sewer extension in Fridley,
Minnesota.
The facilities will consist of 440 linear feet of 8 -inch sanitary sewer pipe.
The facilities are further described in MPCA approved standard specifications
and plans designated as:
"Totino Grace Addition" received September 20, 1994, prepared by Charles W.
Plowe Consulting Engineer for the city of Fridley.
It is the Permittee's responsibility to assure compliance with any special
conditions and the general conditions that are required by this permit. This
includes taking all necessary measures needed to comply, including, but not
limited to, the notification of contractors or others who may be carrying out
this work.

GENERAL CONDITIONS FRSANITARY SE R E TENSION PERMITS
GENERAL CONDITIONS:
1) Material, labor and equipment for temporary erosion control measures and
the acceptable maintenance thereof shall be provided during the life of the
project, to effectively prevent water pollution through the use of berms,
dikes, dams, sediment basins, fiber mats, netting, gravel, mulches,
grasses, slope drains, and other erosion control devices or methods.
Surface cover materials shall be anchored to reasonably prevent their
entering waters of the State by erosion or rising water levels. -
2) Temporary pollution control measures shall be included for all construction
activity associated with the project where such work is necessary, for
example borrow pit operations, haul roads, equipment storage, and plant or
waste disposal sites.
3) The temporary pollution control provisions contained herein shall be
coordinated with any permanent erosion features to the extent practical to
assure economical, effective, and continuous erosion control throughout the
construction and post -construction period.
4) The surface area of erodible earth material exposed by clearing and
grubbing, excavation, borrow and fill operations shall be minimized and
immediate permanent or temporary control measures shall. be taken to prevent
contamination of adjacent streams and other water -courses, lakes, ponds,
and areas of water impoundment. Cut slopes shall be stabilized by methods
such as seeding and mulching as the excavation proceeds to the extent
considered practicable. Slopes shall be graded properly to minimize
erosion.
5) The Appl-icant will be required to incorporate all permanent erosion control
features into the project at the earliest practicable time. Provisions
should be made for continual checking and maintenance of all control
measures, particularly during periods of rainfall, to ensure maximum
effectiveness. Temporary pollution control measures will be used to
correct conditions that develop during construction that were not foreseen
during the design state; that are needed temporarily to control erosion
that develops during normal construction practices, but are not associated
with the permanent control features on the project.
6) The Applicant will control the area of excavation, borrow and embankment
operations commensurate with his progress with finish grading, mulching,
seeding, and other such permanent erosion control measures. Should
seasonal limitations make such coordination unrealistic, temporary erosion
control measures shall be taken to the extent feasible.
7) Oil and other liquid substances capable of polluting water of the State
will be stored in accordance with the requirements of MPCA Miscellaneous
Water Quality Rules Chapter 7100.0010 - 7100.0090 (formerly Minnesota Code
of Agency Rules 6 MCAR 4.8004) (formerly WPC -4).

8) Stream Bank Stabilization shall be utilized if it is needed to prevent
erosion, and shall be constructed of materials which will not pollute
waters of the State.
9) If an effluent will result from the project the Contractor shall submit to
the MPCA plans, for approval, to provide for the following:
a) Water from dewatering operations including effluents from construction
activities shall only be discharged when the effluent complies with
the applicable water quality and effluent standards. Dewatering shall
be performed using well points where feasible and practical, all other
dewatering shall be performed so as not to result in increased
turbidity in the receiving water. This may require the use of
desilting ponds to reduce suspended solids. When the MPCA requires,
permits must be obtained.
b) A Disposal System Permit shall be.obtained by the Contractor from the
MPCA prior to any hydraulic dredging or tunneling, or other activity
including an effluent whisch•may contain potential pollutants.
10) This permit shall not release the permittee from any liability or
obligation imposed by Minnesota or Federal statutes or local ordinances and
shall remain in force subject to all conditions and limitations now or
hereafter imposed by law. The permit shall be permissive only and shall
not be construed as stopping or limiting any claims against the permittee
for damage or injury to persons or property, or any.waters of the state
resulting from any acts, operations or omissions of the permittee, its
agents, contractors or assigns for damage to state property, or for any
violation of the terms or conditions of this permit.
11) No assignment of this permit shall be effective until it is executed in
writing and signed by the parties thereto and thereafter approved by the
Agency.
12) No major alterations or additions to the disposal system shall be made
without the written consent of the Agency.
13) The use of the disposal system shall be limited to the treatment and/or
disposal of the sewage, industrial waste, other waste materials or
substances described in the plans and/or permit application and.associated
material filed with the Agency.
14) The Agency may modify, suspend, or revoke in whole or in part, this permit
after giving notice and providing an opportunity for a public hearing or by
taking direct enforcement action, or any just cause including failure:
(a) to comply with the terms stated herein, or (b) to comply with Agency
water quality regulations and standards presently in force. Nothing herein
shall prohibit the Agency from exercising its emergency powers.

15) The permittee acknowledges that nothing contained herein shall prevent the
future adoption by the Agency or its predecessors of any pollution control
regulations, standards, orders or statutes more stringent than those now in
existence or prevent the enforcement and application of such regulations,
standards, orders or statutes to the permittee.
16) The Agency, its officers, employees and agents review and comment upon
engineering reports and construction plans and specifications regarding
this permit solely for the limited purpose of determining whether such
report, plans and specifications will enable the facilities subject thereto
to reasonably comply with the regulations and criteria of the Agency.'
17.) This permit has not been reviewed by the U. S. Environmental Protection
Agency and is not issued pursuant to Section 402 of the Federal Water
Pollution Control Act Amendments of 1972.
18) The plans for the project have been approved with the reservations stated
on the attached sheet entitled "Information Relative to Review of Plans and
Permit Application."
19) The permittee shall comply with all rules, regulations and requirements of
the Minnesota Environmental Quality Board prior to construction of the
proposed project. This permit is not effective until the permittee
completes all applicable environmental review (Environmental Impacts
Statement or Environmental Assessment Worksheet) which may be required for
the project.
20) This permit authorizes the Holder to perform the activities described
herein under the conditions set forth. In issuing this permit, the
state/agency assumes no, responsibility for any damage to persons, property
or the environment caused by the activities of the Holder in the conduct of
its actions, including those activities authorized, directed or undertaken
pursuant to this permit. To the extent the state/agency may have any
liability for the activities of its employees, that liability is explicitly
limited to that provided in the Torts Claims Act, Minnesota Statute §
3.736.

The review of plans and specifications for sewage, industrial waste or other
waste disposal systems and application for permits is made in accordance with
the authority conferred by law (see MS, Section 115.07). Approval of plans and
permits is based upon the assumption that the information provided by the
applicant is correct and that all necessary legal requirements have been or will
be satisfied.
Plans for sewage, industrial waste or other waste disposal systems are examined
with regard to the design features which apply to operation and maintenance of
the treatment works or sewer system, the degree of treatment to be provided, the
effectiveness and reliability of'the system or methods employed, and compliance
with applicable standards systems. The bulletin entitled Recommended Standards
for Wastewater Facilities, 1990 Edition, and supplements thereto, as well as
other information are used in examination of the design, operation and
maintenance aspects of the proposed system.
Sewer plans are recommended for approval on the basis that the system is to
collect only domestic sewage and such industrial or other waste as may have been
provided for in the design. Foundation or footing drains to collect ground
water and roof drains or other surface water conduits should not be connected to
the sanitary sewer system. Adequate field supervision and inspection by a
qualified representative -of the owner should be provided at all times during
construction to assure that the project is constructed in compliance with the
approved plans and specifications.
The Agency assumes no responsibility for the integrity of structures or physical
features, or for the reliability, durability or efficiency of specific items of
propriety equipment or material. All applicable federal, state and local laws,
regulations or ordinances must be followed in the design, location and
construction of proposed sewer systems or treatment works.
The Agency reserves the right to withdraw its approval of plans if construction
is not undertaken within a reasonable period after issuance of the permit.

STIPULATION; The Board of Managers will require that the fill limieasement
boundary be clearly marked in the field prior to commencing grading. These fill limits shall
remain posted until such time that the District Inspector bas approved the return of the
permittee's cash surety at the completion of the project.
It is the responsibility of the Permittee to provide all measures necessary to contain sediment on the
site during constriction. This may require the use of erosion control measures not outlined on the
erosion control plea. If this requirement is not met, the Permittee may be ordered to provide additional
erosion control measures if deemed necessary by the District Inspector. It is also the responsibility of
the property owner to provide necessary maintenance to assure that the stormwater management
systems approved as part of this Permit will continue to function as originally designed.

This office has completed a preliminary plan review for Mona's Cakes the located at 1478 Royal Oak Lane in Fridley,
Minnesota. The plan review was conducted as required by Minnesota Statute Chapter 28A and the Minnesota Food
Code Chapter 4626. The Minnesota food code is the primary governing document for this review and may be found
on line at www.leg.state.mn.us/leg/statutes.asp by requesting Minnesota Rule Chapter 4626.
All appropriate permits from the local authorities shall be applied for and issued prior to starting any work on
the site. Failure to comply with this may result in a delay or this office not issuing your retail Food Handlers
license until the proper permits are issued. Our inspector will verify that the permits have been obtained.
The Minnesota Department of Agriculture grants preliminary plan approval to the plans for this proposed food
establishment. Upon this agency certifying that all items in this review have been addressed, final plan approval will
be granted. This preliminary plan approval is based upon the pans s—ubm--iffe-d to trus office. Any deviation from the
OpLoved plans and % ecifications must have prior approval from this agency_
Preliminary approval of the plans and specifications does not constitute endorsement or acceptance of the
completed establishment. Periodic on-site inspections may be made during construction. A final inspection of
the completed establishment, with equipment installed, must be conducted to determine if it complies with the

This review was for an addition to an existing bakery. No HACCP plan was submitted with this plan and
none was review. Nothing shown in the plans indicated that a HACCP plan was necessary. No menu or
equipment list was submitted with the plans.
Licensing of your firm is dependent upon proper installation of an approved water supply, plumbing and
waste system. Our inspector will review your approval letters from the appropriate authorities to insure these

approvals from building and fire officials before granting final approval. Please provide copies of approvals
for review at the final inspection.
Minnesota requires that all equipment be Certified to the National Sanitation Foundation Standards for clean
ability, durability and performance. New or used equipment not meeting these standards are prohibited. Any
equipment installed that does not meet these standards may be ordered removed.
All equipment as submitted met NSF standards. The room finishes consisting of tile flooring, FRP walls and.
vinyl coated ceiling tile are acceptable. The installation of the convection oven will require a class II hood
system. Our inspector will verify this during the final inspection.
It is our understanding that your firm currently has the necessary sinks for operation.
The following listed items will be verified by our inspector at the final plan review inspection. Please address each

Equipment
Food equipment shall meet the applicable National Sanitation Foundation (NSF) International food service standards.
The equipment shall be determined by NSF International or an American National Standards Institute (ANSI) 234.1
accredited independent entity, including Underwriters Laboratory or the Edison Testing Laboratory, to be equivalent
to the NSF International Standard. The use of equipment, that does not meet the NSF standards, prohibited.
Bakery equipment must comply with the Bakery Industry Sanitation Standards Committee (BISSC). (4626.0505)(4-

Custom fabricated or modified equipment must be constructed by a contractor listed by NSF International.
The name and address of the fabricator for custom fabricated equipment must be identified. (4626.0505)(4-

All service counters and other millwork surfaces shall be protected with stainless steel, plastic laminate, or equivalent,
covering all exposed wood. In areas where food equipment involves heat or moisture, or where food comes in contact
with the surface, a stainless steel finish or approved equivalent material is required. Solid surfaces for food contact,
such Corian or Gibraltor° shall be constructed by a fabricator listed by an approved third -party testing agency. They
are required to be installed on six-inch legs or a solid base. All areas of the custom fabricated counters shall meet the
requirements of NSF International Standard No. 35. All hard grain decor wood (e.g. oak) shall be properly sealed

Used equipment meeting NSF International, NAMA, or BISSC standards, specified at the time of installation is
permitted if it: met the NSF International, NAMA, or BISSC standards, in effect at the time it was manufactured,
remains in good repair, is capable of being maintained in a sanitary condition, and is approved by the regulatory
authority. Your inspector will evaluate any used equipment to determine if it is acceptable.

Provide multi -use equipment, utensils, and food storage containers than are smooth, easily cleanable, and resistant to
pitting, chipping, or scratching. All food equipment in a retail food store must be designed as to be easily cleanable,
durable and be adequate for its intended use. Household utensils or equipment is prohibited. The use of
commercial equipment not meeting the NSF standards must be evaluated and approved prior to installation.

Retail shelving and refrigeration and freezer display cases shall be designed and constructed to be durable and to
retain their characteristic qualities under normal use. (4626.0505)(4-201.11)
Provide sufficient refrigeration to hold all readily perishable food products at 41°F or less. Provide sufficient
ventilation (e.g. louvers, etc.) for the compressor unit to evacuate any buildup of heat at the underside of the cold pans
in and about the compressor area. (4626.0675.) (4-301.11)
If an ice machine or bulk water unit is to be installed, the waste drain must be properly plumbed and divert to
an indirect waste (air break) floor drain. *(4626.1045 A.) (5-201.11)
Food Protection
Provide a food thermometer for checking the internal temperatures of potentially hazardous foods. Thermometers
must be provided in all coolers, freezers, and hot holding units where potentially hazardous food is stored, and must
be located in an area that is representative of the true air temperature. (4626.0705)(4-302.12) The internal temperature
of potentially hazardous food must be maintained at 41'F or below, or 140°F or above, except during preparation.

Food on display must be protected from potential contamination from coughs, sneezes and improper handling by
installing properly constructed food shields, the use of packaged food items or other effective means of protection.

Lighting
Provide at least 10 -foot candles (110 LUX) of light intensity, at a distance of 30 inches from the floor, in the walk-in
refrigeration units, dry food storage areas, and during periods of cleaning. Provide at least 20 -foot candles (220 LUX)
of light intensity, at a distance of 30 inches from the floor, for areas where food is provided for consumer self-service,
including buffets and salad bars, or where fresh produce or packaged foods are sold or offered for consumption, inside
equipment including reach -in and under counter refrigerators, in utensil storage areas, in areas behind a bar used for
ware washing, and in toilet rooms. (4626.1470)(6-303.11)
Provide at least 50 -foot candles (540 LUX) of light intensity for areas where food employees are working with
utensils and equipment where safety is a factor and areas used for ware washing. (4626.1470)(6-303.11)
Install effective shielding or shatter -resistant bulbs for all light fixtures over exposed food storage, food preparation,
food display facilities, clean equipment, utensils and linens, and unwrapped single -service or single -use articles.

Plumbing
At least one toilet facility and not fewer than the number required by law shall be provided. *(4626.1075)(5-203.110)
These facilities must be conveniently located and accessible to employees at all times.* (4626.1095)(5-204.11) Toilet
rooms must be provided with adequate ventilation, hand cleanser, single -use towels or hand drying devices, tissue
paper and waste paper receptacles. Toilet rooms shall have at least one covered waste receptacle for sanitary napkins,

Plumbing plans must be submitted to the Minnesota Department of Health, Engineering Unit, or delegated authority
for review and approval prior to installation. All plumbing must be installed according to the Minnesota Plumbing
Code, including current amendments. *(4626.1045) (5-202.11)
Equipment connected to the potable water supply shall be protected from back -siphonage. Equipment with
submerged inlet lines (dish machine, garbage disposal, steam table, urinal, etc.) shall be equipped with an approved
backflow preventor, this includes all threaded hose bib connections. *(4626.1085) (5-203.14) If a post -mix beverage
system is provided, an approved pressure-type, back-flow preventor upstream from the control valve on the
carbonator (water line to the carbonator) is required. (Toilets shall be equipped with an anti -siphonage ball cock
assembly. The water line serving a dipper well shall be permanently installed with an air gap on the water line

Install a hot water heater in accordance with NSF Standard #5. (4626.0505) (4-201.11) It must be of adequate size and
recovery rate to provide hot water to all taps during.peak water usage. Lack of hot water will require the installation

If a grease interceptor or grease trap is required by the city building official, it shall be mounted flush with the floor in
an accessible location for maintenance. The Iid shall be water -tight and securely fastened in place. Under no circum-

General Labeling
Provide complete labeling information is provided on all prepackaged food products offered for sale at self-service.
The labeling of these prepackaged food products must include, but is not limited to: 1) The name of the product; 2)
Name, address and zip code of manufacturer, packer or distributor; 3) Complete listing of ingredients in the order of
predominance by weight. 4) Net weight. Provide open quality assurance dates on all prepackaged foods with a shelf
life of 90 days or less. (4626.0435)(6-602.11)
Sinks
Install hand washing sinks in all food preparation, food dispensing, toilet rooms and utensil washing areas.
Generally this is within 20 feet as a person walks. 'x(4626.1095) (5-204.11)Provide hand cleanser, single -use
towels, and a fingernail brush at the hand -wash sink located in the food preparation, and ware washing areas.
Install a NSF three compartment, utensil -washing sink (4626.0680) (4-301.12) with integral drain boards, rack or
tables, (4626.0685) (4-301.13) for the proper cleaning and sanitizing of all multi -use equipment and utensils. The
size of the sink compartment must be large enough to accommodate the largest utensil/equipment, which is to be
cleaned and sanitized. Provide and use an appropriate chemical test kit to determine the strength of the sanitizing
agent in the final rinse water of the three -compartment sink. ( 4626.0715) (4-302.14)
Install a separate food preparation sink if raw food will be cut or combined with other ingredients, or otherwise
processed. (4626.0780)
Install at least one service sink or curbed unit with a floor drain for disposal of mop water and similar liquid waste.
(4626.1080)(5-203.13) Provide hooks or hang-up brackets at the utility sink for storage of mops and brooms.
Utensil washing and hand washing sinks are designed approved and restricted to their respective use and may
only be used for food preparation.
Storage
Provide adequate shelving covering the food operation to ensure that food products, utensils or single -service articles
are stored at least six inches off the floor. (4626.0730 A.) Food storage shelving used in walk-in refrigerators must be
in conformance with NSF standard #2. Chrome or zinc -plated shelving without an approved factory applied hard -
baked protective coating is not approved for this purpose. (4626.0505 B) Retail shelving shall be designed and
constructed to be durable and to retain their characteristic qualities under normal use conditions. (4626.0505A.)
Provide an area for storage of employee's personal belongings that is separate from food, clean equipment, and single
service supplies. (4626.1560)

Room Finishes
The floors, floor coverings, walls, wall coverings, and ceiling surfaces shall be designed, constructed, and installed so
they are: a) smooth, durable and easily cleanable where food operations are conducted; b) nonabsorbent, for food
preparation areas, walk-in refrigerators, ware washing areas, toilet rooms, janitorial areas, laundry areas, interior
garbage, refuse storage rooms, and areas subject to flushing or spray -cleaning methods, or other areas subject to
moisture. (4626.1325)
Concrete, sealed or unsealed, is prohibited: a) where food product packages, containers, or cases in those areas are
opened. b) Under equipment in food preparation and service areas including under service cases. c) in walk-in
refrigerators or freezers, ware washing areas, toilet rooms, mobile food establishment servicing areas, hand wash
areas, janitorial, laundry areas, interior garbage and refuse storage rooms, areas subject to flushing or spray -cleaning
methods and areas subject to moisture. (4626.1335 D.)
Sealed concrete is permitted: in areas used exclusively for refuse storage. The floor beneath the display shelving
units, display refrigeration units, and display freezer units located in the consumer shopping areas if readily movable,
must be designed so that it is smooth and easily cleanable, and the floor beneath these units are maintained in a clean
and sanitary condition. (4626.1335 D.)
Unsealed concrete is permitted: Outside garbage and refuse containers, including compactors stored on a smooth
and nonabsorbent surface. (4626.1230)
Vinyl flooring is prohibited: in a walk-in cooler or freezer. (4626.1335 C.)
Floor and wall _junctures: Shall be coved and closed to no larger than one millimeter (1132 inch) when cleaning
methods other than water flushing are used for cleaning floors. At the floor wall juncture where the fiberglass panel
meets the floor an acceptable base coving such as stainless, quarry or other pre -approved materials must be installed.
(4626.1345A.) Where water flushing is used caving shall be sealed. (4626.13458.) Glued rubber coving may not be
acceptable on fiberglass panels, as it may not bond to the fiberglass material.
Floor surfaces: Shall in the food preparation, food storage, and utensil washing areas be constructed of smooth,
durable, nonabsorbent, easily cleanable materials, which resist the wear, and abuse to which they are subjected.
The walls and ceiling in the food preparation, utensil washing and toilet room areas shall be smooth, non-absorbent,
and easily cleanable. (4626.1335A)
Ceilings: Perforated or fissured drop lay -in ceiling panels are prohibited in food preparation, food service, and
utensil washing or toilet room areas. (4626.1360B.)
Ventilation
All heating appliances which generate either excessive heat, vapors, condensation, greases, odors or fumes, must be
properly situated beneath a mechanical exhaust canopy. The canopy and hood construction must meet the applicable
standards of the NSF. (4626.0505) In addition, the requirements of the 2004 Uniform Mechanical Code and the 2004
amended Minnesota Building Code covering commercial kitchen ventilation systems must be met. Additionally vent
less frying systems requiring alternative methods shall meet standards EPA 202, NFPA 96, UL 197 and have
