INDEMNIFICATION AND HOLD
HARMLESS AGREEMENT
This Agreement is made this day of
and between PETER C. RECH and JOANN C. RECH,
("Property Owners") and the CITY OF FRIDLEY.

husband and wife,
WHEREAS, the Property Owners have requested the City of
Fridley to grant them a variance so as to reduce their rear yard
set back from twenty-five (25) feet to fifteen (15) feet so as to
permit the construction of a twelve (12) foot by twenty (20) foot
porch addition on the real property which is described as follows
to wit:
Lot 4, Block 5, Bourdeaux's Spring Brook,
Anoka County, Minnesota, and
WHEREAS, the City maintains and operates a City Park which is
adjacent to the rear yard of the subject property, and
WHEREAS, the City has informed the Property Owners that there
may be an increased risk in injury to their property or person
resulting from this addition being located closer to the City
Park than what is permitted under the City Zoning Code, and
WHEREAS, the Property Owners have represented to the City
that they will hold the City harmless for any injuries or damages
which they or their guests may sustain as a result of the opera-
tion of the Park.
NOWTHEREFORE it is hereby agreed by and between the parties
as follows:
1. That the Property Owners agree to indemnify and hold the
City of Fridley harmless from any bodily injury or property'dama-
ges sustained by either the Property Owners, their invitees, or
their guests in which injuries or damages arise out of the
operation and use of the adjoining City Park owned by the City of
Fridley.
2. That the Property Owners obligation to indemnify and hold
the City of Fridley harmless includes not only bodily injury and
property damage but in addition the Property Owners agree to
reimburse the City of Fridley for any legal expenses which it may
reasonably incur in defending itself in the course of any legal
action brought against the City of Fridley which arises out of
injuries or damages sustained within the scope of this Agreement.
IN WITNESS WHEREOF, the parties described above have affixed
their signature on the date first set forth above.

RE: Violation of the Fridley City Code, Chapter 205.07 and Special Use
Permit, SP #86-12, 6620 Lucia Lane N.E. -
Dear Mr. Throndson:
I inspected the above referenced property for ocapliance to SP #86-12 which
allows a second accessory building on that property. This permit was passed
by the City Council on October 6, 1986 with four stipulations. Of the four
stipulations, one remains to be completed. This is:
1. Provide a bardsurface driveway with the construction of garage.
This stipulation is also a requirement of the City Code, Chapter
205.07.06.a.2 which states that "all driveways and parking stalls shall be
surfaced with blacktop, concrete or other bardsurface material approved by
the City".
I realize that extenuating circumstances may have prohibited you from
installing this bardsurface driveway. I will reinspect the property on
August 5, 1988 and expect the bardsurface driveway to be installed. If you
cannot meet this deadline, please contact me at 571-3450. Tbank you for your
cooperation.
