BY WILLIAM AND JEAN SCHACHER: Per Section 205.07.03.(3).(a) of the Fridley Zoning code, to reduce the required rear yard setback from 25 feet to 15 feet to allow the construction of a three - season porch on Lot 1, Block 5, Bordeaux's Spring Brook Addition, generally located at 8191 Ruth Circle. MOTION by Dr. Vos, seconded by Mr. Jones, to waive the reading and open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING WAS OPENED AT 8:05 P.M. Mr. Bolin stated that the petitioners are seeking to decrease the required rear yard setback from 25 feet to 15 feet to allow the conversion of their existing deck into a three - season porch. Section 205 of the City code requires a minimum rear yard setback of 25 feet for this property as it is 100 feet in depth. This is a single family zoning district. Their hardship summary is: "Plan to build a three -season porch on existing deck joists. Another option which is unlikely --to build along Ruth Street on west side of house. It will spoil the looks of the house." Mr. Bolin stated that the yard is well landscaped, and there appears to be a row of bushes along the rear property line so it would have minimal impact to the neighboring property. City staff has no recommendations because the request is within previously granted dimensions. If approved, staff recommends one stipulation: 1. All permits shall be obtained prior to construction. Dr. Vos asked if he was going to follow the roofline. Mr. Schacher stated, yes, and the porch would have matching roofing and siding. Ron Zaczkowski, 314 Hugo St., stated that their backyards are adjoined and he has no problem with this as long as he follows the existing deck. Dr. Vos stated that this is the neighbor most directly affected by this. To the west is the road and to the east the house is further away. ' MOTION by Dr. Vos, seconded by Mr. Jones, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE PUBLIC HEARING WAS CLOSED AT 8:15 P.M. Dr. Vos stated this is a case where the back yards are fairly tight to the lot line and the petitioner is not adding anymore to where the deck is, just adding height to the porch. He would vote in favor of the variance Mr. Kuechle agreed. The setback is mainly to give it some more open space and not give it a crowded look. The lot has a really oversized side yard so the feeling of space lost and the elevation will have a minimum impact. This is the first one where the size of the sign has/been larger than what is allowed. The other cases were a matter of getting the sign ntractors to pull the proper permits, pay investigation fees, and go to court for crimin/citations. Mr. Kuechle asked if there is a criminal citation if they o not get a permit. Mr. Bolin stated, yes. The sign contractor, busines owner, and the property owner can be charged. The attorney representing Mr. Huynh, Mike Ve rick, stated that the frame of the sign was constructed sometime in 1996. The pre, 'ous owner erected the sign sometime in 1996, possibly 1997. Mr. Huynhsimplmy cha ged the faces of the sign sometime in 1997 or 1998. The previous owner had soe s of variance for the frame of the sign. The previous owner had permission and had a sign the size that it is. The problem is that there was some stipulation in that pape ork that if the sign faces were changed, the new owner would have to come in for 0 variance. Mr. Huynh did not do that because he cannot read English. He was not pur osefully trying to skirt the law. He lived in a war zone in a communist country and c,' a to America as a refugee. He paid $10,000 for the sign faces. The sign, accord in to the City, is twelve square feet over the limit. The neighborhood and its character i appropriate for that kind of sign because it is not noticeable when driving down U iversity Avenue. Mr. Huynh is being criminally prosecuted for this sign and th 're is a court date on May 23 to discuss the constitutionality of the sign co e. It is their position that the sign code is unconstitutional. The Fridle Sign Code is pretty clear that the erector of the sign has the responsibility for gettin `the permits. Taurus Sign Company out of St. Paul did not do that. Since Mr. Huynh ' as not responsible for applying for the variance in the first place and is being crimin Ily prosecuted, he thinks he has suffered enough. Mr. Kuechle asked if tore was a variance in 1996 for the 92 square foot sign. Mr. Bolin stated that he variance was back in the late 70s or early 80s. It was stipulated at the ti that the business could have the larger sign face, but any further changes after Go met Village required another variance. The petitioner's criminal citation and the v riance request are not related. The City Attorney is handling the criminal citation iven for the "Kids Eat Free" sign. MOTION by D .
