Notice is hereby given that the Appeals Commissi.on,of the City of Fridley
will conduct a public hearing in the City Council Chambers at 6431 Univer-
sity Avenue Northeast at 7:30 P.M. on Tuesday, April 15, - 1980, in regard
to the following matter:
Request for variance pursuant to Chapter
205 of the Fridley City .Code, to reduce the
required 25% of the lot depth for rear yard
from 26 feet to 20 feet, to allow -'a 14' x
32' additjon to an existing house located on
Lot 5, Block 4, Bourdeaux's Spring Brook
Park Addition, the same being 8135 Ruth
Street N.E., Fridley, Minnesota.
Notice is hereby given that all persons having an interest therein will be
given an opportunity to.be heard at the above .time and place.

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.053, 4C, requires a rear yard depth of not less than 25 percent
of the lot depth with not less than 25 feet permitted
or more than 40 feet required.
Public purpose served by this requirement is to provide rear yard space to
be used for green areas which enhance the neighborhoods.
B. STATED HARDSHIP:
"The existing structure has 2 bedrooms and there are two single adult
occupants. Since one is a teacher and the other a nurse, both have a vast
amount of books and materials which necessitates a den. The den has to be
on the main floor because one occupant has a permanent knee disability making
steps a severe problem. That leaves the occupants with one bedroom. We
have extensively explored the possibility of buying a rambler but we can not
afford it. Therefore, our only alternative is to build a bedroom onto the
main floor. By expanding the living room, we can put in d fireplace for
energy conservation and at the same time make the addition aesthetic. By
cantilevering the addition we can retain the existing back yard by putting
our patio under the addition."

If the neighbors have no objection to this variance being granted, the
staff has no stipulations to recommend to the Board if approved.

Ms. Schnabel questioned if the drawing they have, if -it is
drawn to. scale?
Ms.`Mulrin:e after looking at the drawing stated that this was
not the one she.had drawn. She further stated: that the one the
Commission was looking at did now show the proper way the house
is on the Tot.
The Commission then was -shown the netitionerrs- drawing.
Ms. Schnabel stated that the addittion seemed like it would come
pretty close to the existing shed. 'She °asked if :IY1s. T:iulrine
was 'planning on keeping ..the shed?
I4is,'Mulrine stated that she had only stepped the measurements
off, so that it:was not accurate, but that it, -was about six
feet away,'and that yes. she would like to retain the shed.
Mr. Barna questioned why they have decided to go-out,the back,
instead of going off the side of the house.
Ms. 1dlulrine stated that if_ they were .to go off the side of the
house, all they could�go would-be 10 feet, axd'she did not feel
that was a sufficient size to warrant the addition.
Mr.:. Perlman, the builder, stated that .they ;did explore than
possibility, but because of the layout of the house, adding-
off- the side would minimize the value o -f the house.
Ms. Schnabel questioned if they -had talked
about this addition?

Ms. lAulrine stated that. she had only spoken. with the. neighbor
directly behind there, because she felt they -were the only ones,
that this addition would affect. She stated`that.thisneighbor
had no objections.

Pus Schnabel stated that she would like to know if 11110. Mulrine
was going to•have this work contracted to be done•by a builder?
Mr. Perlman of American Builders stated that he would be doing
the work for 11 -As. Mulrine, and that he is a licensed contractor
in,the City of Fridley.
Ms. Schnabel questioned if the exterior is of the addition is
going to match the exterior of the house?
Mr. Perlman stated that yes they would match.

for a variance pursuant to Chapter 205 of the Fridley City.Code,
