the County. Councilman Thompson asked Mr. Comstock when it will be Possibi,

construction of the storm sewer with the County at the present time and
he believes it would be possible to write an agreement with the County in

not be built until the following spring and the Council could delay
consideration if the construction project.

The City Engineer showed a map of the proposed construction to the Council;
explained the problem to the Council. He stated that he wishes to'obtaia. a
motion,-ifrom'the- Council acknowledged that the City. intends 'to .extend
construction for storm sewer project SS#12 up Roman Road to Panorama Avenue,
-and approving construction of same. The City Engineer stated that he.needs'
this information to decide whether to construct this line at this time or

plan for construction at a future time. Councilman Wright -asked whether
if the water from Main Street were to be diverted from running into Panorauu

City Engineer answered that it is feasible to run the storm sewer water on

it is possible to determine how much cost -will be added to construction of a
storm sewer on Main Street if the drainage of Main Street is run into the

feet per second of flow. He stated that the capacity of this outfall cannot

insists that a map of the drainage district be included in the agreement
for construction of SS#12. The City Enginner stated that when the
assessment heating for SS#12 is held and the people object to assessment
for this construction, the City Administration should have answers for
these people why this part of the line was constructed against their
objections.'

The City Manager read the Notice of Hearing,
The Mayor pointed out the area concerned by the proposed rezoning on the
map for the benefit of the visitors present at the Council Meeting. The
Mayor asked whether anyone wished to be heard upon this question. There
were no comments or questions concerning the proposed rezoning.
Mayor Nee declared the hearing closed.
FIRST READING OF ORDINANCE AMENDING ZONING DISTRICTS:
Motion by Wright to adopt upon first reading the ordinance to rezone the
[d2 of the SW4 of Section 14, and that part of the E2 of the SE -4 of Section
15 in Township 30, Range 24, Anoka County and to waive the first reading
of the Ordinance. Seconded by Sheridan. Upon a roll call vote, there being
no nays, the motion carried unanimously.
PUBLIC HEARING
FINAL PLAT.- SYLVAN.HILLS PLAT 8:
The Mayor read the Notice of Hearing:
Mayor Nee asked whether anyone present wished to be heard concerning Ne
final plat of Sylvan Hills Plat 8. No one present had.any questions or
comments concerning the final plat. Mayor Nee asked the City Engineer
whether he had a copy of the final plat, The City Engineer stated that
a copy was delivered to City Hall, but was picked up to correct -the street
name given on the plat. Councilman Wright suggested that rather than
extending Starlight Boulevard to Mississippi Street, a cul-de-sac be
established at the end -of Starlight Boulevard north of Satelite Lane.
Mayor Nee declared the hearing closed.
Motion by Sheridan to accept the final plat of Sylvan Hills Plat 8. Seconded
by Wright. Upon a voice vote, there being no nays, the motion carried
unanimously.
BUILDING PERMIT_- 6001/6005 UNIVERSITY AVENUE NORTHEAST - MARCHIAFAVA:

Mayor Nee asked the City Manager whether he received any plans of the
proposed building request of Mr. Marchiafava. The City Manager stated that
he discussed this request with Mr. Marchiafava, but that Mr. Marchiafava, did
not appear to understand the need to submit pians for the building. He
asked Councilman Wright whether he had been able to discuss this with
Mr. Marchiafava. Councilman Wright stated that Mr. Marchiafava did not
call him, and he was unable to locate Mr. Marchiafava.
Motion by Sheridan to table the request of Mr. Marchiafava for a Building
Permit until such time as the Council has the necessary information to be
able to consider his request. Seconded by Kirkham. Upon a voice vote,
there being no nays, the motion carried unanimously.
ESTIMATE, AND ASSOCAITES (TABLED 9/20/65, 10/4/65)•
The City Manager stated that the City Attorney addressed a letter to the -
Finance Director and the City Manager read this letter to the Council. The
letter stated, in effect, that the Architect is entitled to be reimbursed
for the cost of duplicating specifications and making blueprints of the
plans.
Motion by Wright to approve the estimate of Smiley and Associates of
October 1, 1965 for reproduction of specifications and plans for payment
in the amount of $1,617.64. Seconded by Sheridan. Upon a voice vote, there
being no.nays, the motion carriedunanimously.
SUPPLEMENTAL MAINTENANCE AGREEMENT, SUPPLEMENTAL ESCROW AGREEMENT, RESOLUTION
AUTHORIZING AGREEMENT WITH COLUMBIA HEIGHTS - SS#12 (TABLED 10/4/65):

jobs. He stated that Mr. Lametti informed him that he would call the City
Manager's office the following Wednesday to find out if the City of Fridley
will award a bid on this work or whether he should seek additional work.
Councilman Sheridan stated that the -Administration should ask the contractor
for a five day extension of time to allow the Council to consider the matter
at the regular Council Meeting of November 15, 1965, and inform the contractor
that the City of Fridley is willing to award the contract to him.
The City Attorney stated that the City Attorney of Columbia Heights is
advising the City of Columbia Heights not to sign the contract before the
public hearings on same are completed. He stated that he is rather reluctant
to advise Columbia Heights to sign any agreements for this project. He
stated that he thinks Columbia Heights might be ready to act by Wednesday.
Mayor Nee called a special Council Meeting of the Council of the City of
Fridley for Wednesday, November 10th at 8:00 P.M., with the provision that
should Columbia Heights approve the agreementg,or should the meeting be
unnecessary, the City Manager will inform the Council that the special meeting
has been called off.
The Council took no action upon this matter.

ordinance depends upon the rapidity with which connections -are made to the
sanitary sewer system of the N,S.S.S.D. The Mayor stated that is not correct,
that this part of the sanitary .sewer system will be connected to a different
sewer system, rather than to the N.S.S.S.D.
Motion by Wright to adopt, upon second reading, Ordinance #315 rezoning C -.2S
and M-1 to R -3A, a portion of Sylvan Hills Plat 8, and publish same.

SAFETY COMMITTEE MEETING MINUTES - OCTOBER 20 1965:
Councilman Wright asked the City Manager whether he has data concerning the
traffic count at the intersection of 7th Street Northeast with 61st Avenue
Northeast, especially a traffic count of the number of vehicles making turns
at this intersection. The City Manager stated that he has traffic count data,
taken from automatic counters, and that it is not feasible to use the auto-
matic counters to determine the number of vehicles making a turn at an
intersection. He stated that the only way this data can be gathered is to
have an observer at the intersection count the number of cars that make turns.

PUBLIC HEARING
_REZONING-- C2S AND M-1 TO R -3A - CART,SON - LaVINE:
The City Manager read the Notice of Hearing.
The -Mayor pointed out the area concerned by the proposed rezoning on the
map for the benefit of the visitors present at the Council Meeting. The
Mayor asked whether anyone wished to be heard upon this question. There
were no comments or questions concerning the proposed rezoning.
Mayor Nee declared the hearing closed.
FIRST READING OF ORDINANCE AMENDING ZONING DISTRICTS:
Motion by Wright to adopt upon first reading the ordinance to rezone the
IJZ of the SW'k of Section 14, and that part of the EZ of the SEk of Section
15 in Township 30, Range 24, Anoka County and to waive the first reading
of the Ordinance. Seconded by Sheridan. Upon a roll call vote, there being
no nays, the motion carried unanimously. 1.
PUBLIC HEARING
FINAL PLAT - SYLVAN HILLS PLAT 8:
The Mayor.read the Notice of Hearing.
Mayor Nee asked whether anyone present wished to be heard concerning file
final plat of Sylvan Hills Plat 8. No one present had any questions or
comments concerning the final plat. Mayor Nee asked the City Engineer <
whether he had a copy of the final plat. The City Engineer stated that
a copy was delivered to City Hall, but was picked up to correct the street
name given on the plat, Councilman Wright suggested that rather than
extending Starlight Boulevard to Mississippi Street, a cul-de-sac be
established at the end -of Starlight Boulevard north of Satelite Lane.

Mayor Nee declared the hearing closed.

Motion by Sheridan to accept the final plat of Sylvan Hills Plat 8. Seconded
by Wright. Upon a voice vote, there being no nays, the motion carried
unanimously.
BUILDING PERMIT - 6001/6005 UNIVERSITY AVENUE NORTHEAST - MARCHIAFAVA:
(TABLED 10/4/65):
Mayor Nee asked the City Manager whether he received any plans of the
proposed building request of Mr. Marchiafava. The City Manager stated that
he discussed this request with Mr. Marchiafava, but that Mr. Marchiafava did
not appear to understand the need to submit plans for the building., He
asked Councilman Wright whether he had been able to discuss this with
Mr. Marchiafava. Councilman Wright stated that Mr. Marchiafava did not
call him, and he was unable to locate Mr. Marchiafava.
Motion by Sheridan to table the request of Mr. Marchiafava for a Building
Permit until such time as the Council has the necessary information to be
able to consider his request. Seconded by Kirkham. Upon a voice vote,
there being no nays, the motion carried unanimously.

ESTIMATE - SMILEY AND ASSOCAITES (TABLED 9/20/65 10/4/65):
The City Manager stated that the City Attorney addressed•a letter to the
Finance Director and the City Manager read this letter to the Council. The
letter stated, in effect, that the Architect is entitled to be reimbursed
for the cost of duplicating specifications and making blueprints of the
plans.
Motion by Wright to approve the estimate of Smiley and Associates of
October 1, 1965 for reproduction of specifications and plans for payment
in the amount of $1,617.64. Seconded by Sheridan. Upon a voice vote, there
being no nays, the motion carriedunanimously.
SUPPLEMENTAL MAINTENANCE AGREEMENT, SUPPLEMENTAL ESCROW AGREEMENT, RESOLUTION
AUTHORIZING AGREEM1,NT WITH COLUMBIA IiEIGIITS - SS#12 (TABLED 10/4/65):

jobs. He stated that Mr. Lametti informed him that he would call the City
Manager's office the following Wednesday to find out if the City of Fridley
will award a bid on this work or whether he should seek additional work.
Councilman Sheridan.stated that the Administration should ask the contractor
for a.five day extension of time to allow the Council to consider the matter
at the regular Council Meeting of November 15, 1965, and inform the contractor
that the City of Fridley is willing to award the contract to him.
Ilia City Attorney stated that the City Attorney of Columbia Heights is
advising the City of Columbia Heights not to sign the contract before the
public hearings on same are completed. He stated that he is rather reluctant
to advise Columbia Heights to sign any agreements for this project. He
stated that he thinks Columbia Heights might be ready to act by Wednesday.
Mayor Nee called a special Council Meeting of the Council of the City of
Fridley for Wednesday, November 10th at 8:00 P.M.,,vith the provision that
should Columbia Heights approve the agreements.,or should the meeting be
unnecessary, the City Manager will inform the Council that the special meeting
has been called off.
The Council took no action upon this matter.

The City.Manager stated that the Resolution authorizing this agreement concerned

completion of the agreements, the Council should not adopt the resolution.

Councilman Wright asked whether it is correct that consideration of this
ordinance depends upon the rapidity with which connections are made to the
sanitary sewer system of the N.S.S.S.D. The Mayor stated that is not correct,
that this part of the sanitary sewer system will be connected to a different
sewer system, rather than to the N.S.S.S.D.
Motion by Wright to adopt, upon second reading, Ordinance #315 rezoning C -2S
and 11-1 to R -3A, a portion of Sylvan Hills Plat 8, and publish same.
Seconded by Sheridan. Upon'a roll call vote, there being no nays, the motion
carried unanimously.

Councilman Wright asked the City Manager whether he has data concerning the
traffic count at the intersection of 7th Street Northeast with 61st Avenue
Northeast, especially a traffic count of the number of vehicles making turns
at this intersection. The City Manager stated that ho has traffic count data,
taken from automatic counters, and that it is not feasible to use the auto-
matic counters to determine the number of vehicles making a turn at an

Gentlemen:
Pursuant to a previous request, we submit to you the following in regard to
the above subject:
1. The City Center plan to date recom' rends that the Levine property
north of Mercury Drive, west of 2nd Street N. E. (continued) be used
for multiple family (R3) residences and parking for future commer-
cial expansion.
2. The Plan also suggests Starlite Boulevard be extended westward to
the to the railroad (along Mercury Drive) then north to Mississippi.
Avenue. This road would serve as an outlet for the neighborhood to
Mississippi Avenue and yet not entice "through" traffic into the
neighborhood.
3. The Plan suggests further a building layout that would be compatible
with the area.
In summary, it is our recommendation that the land north of Mercury Drive
(extended north as appropriate for siting purposes) be re -zoned to an R3 use
provided a site development and preliminary architectural plans are submitted
showing the .total development which Mr. Levine has in mind. - We also suggest 1
the "design" qualities of the buildings be improved above the present structures
and that site amenities (landscaping in particular) be shown.
