Air. Kohlan, City Attorney, stated that there -maothing waived as far as the setback requirements were concerned, but :slot depth and area requirements were waived. Mr. Brown stated that a Council could accept the plat as presented, and if there were any ages, it would be brought back to the Council. Mr. Walquist stated -r. he has a builder who wants to build on these lots and he has been �L:ing for quite some time. He said there is no question on the setbacksi i vokild like to apply for a permit. Mr. Wayne Toumie was present, and a.ed that he would be the• person building on the lots, and he stated 4:.the setback, would be the same as on any other lot. The Mayor declared -a hearing closed. Mr. Wegler of the Board of Appeals was present, and stated that he had not voted in favor of this variance request as he felt there was no hardship involved, and they could build a garage without this variance being granted. Mr. Cochran was present and stated that there is no hardship involved but, ' the building is constructed in such a way to accommodate a garage on the side of the building that it is planned. The Planning Commission had recommended that approval be granted authorizing the $350.00 for a report to the community on parks. REZONING REWESP BY S. G. PEARSON COMPANY INC. TO REZONE FROM C -2S TO R-3 PART OF ThT Sol,-- OF THE S'g O�:,CTIUN 3: The City Manager read a letter from Comstock and Davis, Inc. with reference -� to the sewer and water facilities in the area. The Planning Commission had recommended approval of this rezoning request, calling the attention of the Council to the sanitary sewer problem in the area, and the rezoning is recommended only if the Council approves the amendments to the rezoning and _. building ordinances. Councilman, Johanson stated that the Council cannot hold up these matters any longer, waiting for a solution to the North Suburban Sanitary Sewer District. Councilman Nee asked Mr. Knutson of Comstock and Davis, Inc. some questions about the letter. Mr. Knutson ' stated that when the North Suburban SanitarySewer S er District line is avail- able, it would alleviate the problem in this area. Motion by Sheridan to receive the recommendation of the Planning Commission and to hold this matter until such time as the recommendations of the Planning Commission can be complied with. Seconded by Nee. Councilman Sheridan stated that he had a petition concerning this matter. Councilman Sheridan read Petition x;'60-1962 signed by three people who were in favor of the rezoning, and one opposed, and a petition in oppo- sition to the rezoning. Councilman Sheridan stated that on the petition by people in favor of the rezoning, one had asked that six -unit apartment buildings be put in. As part of the City's comprehensive housing program, an on-site inspection was conducted of the above listed property on June 11, 1984. The inspection on that date found the following list of deficiencies which are in need of corrective action. Any repairs or improvements must be completed in a workmanship like manner. It is the City's hope that similar or other deficiencies that were not noted will be corrected as needed. EXTERIOR: 1. Clean and maintain the refuse area free of the old water heater and any other refuse found littered there. 2. Repair or remove the metal storage shed found on the east end of the garage. 3. Provide and maintain screens, without holes, for all openable windows: North wall, third floor, 1st from west. 4. Enclosed you will find Section 220.10, of the Fridley Housing Maintenance Code. These are City adopted, manditory State regulations for all residential rental properties. It is expected that all windows and doors will be brought into compliance by caulking and weatherstripping where needed. In addition, the rest of the building must be brought into compliance with the remaining energy requirements if applicable to this property. It is expected that the property will be brought into compliance with all energy requirements prior to the start of the 1984 heating season. 5. The painted wood surfaces of the windows and doors are chipping and flaking and in need of refinishing. This should be accomplished during the summer of 1984. There is a water leak under the kitchen sink that is damaging the wall. Repairs must be made to stop the leakage and fix the wall. 19. The counterweight springs for the windows in the children's bedroom have become detached and repairs must be made to allow the windows to remain open. 20. Replace and maintain the missing screen for the bedroom window. 21. There is a double keyed dead bolt lock on the exterior door. The dead bolt locks must be single keyed, with a 3/4 inch throw to the bolt. Please see enclosed statement for the correct style of dead bolt lock to install. The City must require you to correct the above listed items on or before July 16, 1984 at which time a reinspection will be conducted to determine compliance. During the upgrade of Mississippi Street, a median will be constructed which will no longer allow access to the Sylvan Hills area through the existing frontage road system. Accordingly, 3rd Street was extended to provide access to Mississippi Street until such time as the southwest quadrant of Mississippi and University is redeveloped. The 3rd Street extension consists of a series of curves, behind commercial buildings, and adjacent to commercial parking lots. Because of the traffic associated with the commercial activities, the narrow width, and curvature of the road, it was determined that placing "No Parking" signs would insure safe transit over the road. The commercial congestion in this area is further aggravated by the apartment complex at the intersection of 3rd Street and Satellite Lane. The vehicles parking in the vicinity of the apartment complex and the rear of Burger King, at a curve in the road, provide a very dangerous hazardous traffic condition. The construction of the road has not changed the area use significantly. All residential single and multiple properties, as well as commercial properties, are to provide adequate parking for residents and users, therefore, there is no need to park on this section of road, particularly since the road has not been in use for a number of years. We have a bunch of Fridley residents up in arms and very disturbed about the NO PARKING Restictions that have been placed on both sides of the street on 3rd Street, just north of Satellite Lane. I do not believe that the NO Parking Restrictions serve any useful purpose, and is a great inconvenience to our residents, and their guests who come to visit. We understand that there must be adequate room for emergency vehicles to pass, but there should still be adequate room for emergency vehicles, if we allowed parking on just the west portion of 3rd Street in the:,.ar,ea that is just north 'of Satellite Lane N.E. for about 300 Ft. I have previously informed Mr. Tenenbaum that we signed the street for safety purposes, due to the curves and the intersection, plus indicating that each apartment is to provide adequate space for their tenants. Unless you or the Council have some different feelings on this, I will respond to him, indicating that we will not remove the no parking signage. We have a great number of very angry tenants, that this is inconveniencing, and they have prepared a Petition containing over 40 signatures from people who reside in the area, asking that these restrictions be removed. I am for the present keeping the originals of the petitions, but I am enclosing a photo copy of them for you. We all agree that there are a number of curves on the street and it would not be a good idea to have parking all along this area, however, the 300 Ft. area directly north of Satellite Lane, on the East Side Of The Street, is quite straight, and this is the area that we are requesting the No Parking restrictions be removed from. The construction of the road has changed the use very significantly, as it was previousely a culdesac with no traffic, and has always been used for parking. We would like you to reconsider and to remove the no parking restrictions on just the East side of the road, for just 300 Ft. North Of Satellite Lane. I am in hopes that we can get this matter resolved to everyones satisfaction with no further action.
