Ms. Dacy, Community Development Director, stat4d that this variance
is to increase the maximum square footageo a sign from 80 square
feet to 120 square feet.
Councilwoman Jorgenson questioned the sffiff report which indicated
an increase from 80 square feet to 84 square feet.
Ms. Dacy stated that the dimension on the drawing were incorrect
and the variance request is to i crease the size from 80 square
feet to 120 square feet.
MOTION by Councilman Billings to grant Variance ' Request,
VAR #92-22, with the followi g stipulations: (1) the variance shall
remain in effect until (a) the sign is altered in any way except
for routine maintenance a change of messages which makes the sign
less in compliance with he requirements of this Chapter than it
was before the altera ons; (b) the supporting structure of the.
sign is. replaced or r odeled; (c) the face of the sign- is replaced
or remodeled; (d) t sign becomes dilapidated or damaged and the
cost of bringing i into compliance is more than 50 percent of the
value, of said si , at which time all of the sign and its structure
be removed; and (e) notwithstanding paragraph (a) above, upon the

Ms. Dacy, Community Development Director, stated tha this is a
request for a variance to reduce the side yard setba on a corner
lot from 17.5 to 8.8 feet. She stated that an exp sion destroyed
this home, and the petitioner is requesting reco struction of the
home with an addition.
Ms. Dacy stated that the Appeals Commissio recommended approval
of the variance request. She stated hat several residents
testified at the Appeals. Commission m ting that they did not
object to the encroachment. She st ed .that staff recommends

that this is part of a loss.

Request
The petitioners are requesting that a variance be granted to
reduce the side yard setback from 10 feet to 7 feet to allow
the expansion and conversion of an existing porch in the rear
of the garage to a three -season porch. The request is for Lot
3, Block 1, Swanstrom's Court Addition, generally located at
1324 Skywood Court N.E.
Site
The property is located east of Menards and south of I-694.
The property is zoned R-1, Single Family Dwelling, as are all
adjacent properties. Located on the property is a single
family dwelling with an attached two car garage.
Analysis
section 205.07.03.D.(2).(a) requires a minimum side yard
setback of 10 feet between any living area and side property
line.
Public purpose served by this request is to maintain a minimum
of 20 feet between living areas in adjacent structures and 15
feet between garages and living areas in adjacent structures
to reduce the exposure to the possibility of fire. It is also
to allow for aesthetically pleasing open areas around
residential structures.
Located on the rear of the garage is an existing 5 ft. 10 in.
by 20 ft. covered porch. Since the porch qualifies as living
space, there is an existing encroachment as the setback is
less than 10 feet. The petitioners propose to add an
additional 2 ft. by 20 ft. addition which enlarges the
existing porch to 8 ft. by 20 ft.
The petitioners are proposing to create a three -season porch.
The adjacent structure to the west is set back 16.7 feet;
therefore, granting the variance would still provide for
adequate separation between the two structures.

2. CONSIDERATION OF VARIANCE REQUEST. VAR #92-23, BY JOHN AND
MARCELLA CLUTTER:
Per Section 205.07.03.D.(2).(a) of the Fridley City Code, to
reduce the side yard setback from 10 feet to 7 -feet to allow
the construction* of a three -season porch on Lot 3, Block 1,
Swanstrom's Court Addition, the same being 1324 Skywood Court
N.E.
MOTION by Ms. Smith, seconded by Mr. Kuechle, to waive the reading
of the public hearing notice and -open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 8:23 P.M.
Ms. McPherson stated the property is located on Skywood Court, east
of Menards and south of I-694. The property is zoned R-1, Single
Family. Dwelling, as are all the adjacent properties.* The
petitioners are proposing to convert an existing 5 ft. 10 in. by
20 ft. long enclosed porch on the rear of the attached garage to
a three -season porch. They are also planning to expand the porch
by adding. an additional 2 feet which will make the overall
structure 8 ft. by 20 ft.
Ms. McPherson stated there is approximately 16 1/2 feet. from the
property line to the adjacent structure to the west so there is
adequate area between structures thereby meeting the spirit and the
intent of the Code.
Ms. McPherson stated staff would normally recommend denial of these
types of applications. It is staff's, responsibility to apply the
letter of the law in interpreting the Zoning Code for setbacks and
regulations.. It is the responsibility of the Appeals Commission
and City Council to determine whether or not a variance request
such as this is warranted.
Ms. McPherson stated. that in this particular case, the Appeals
Commission and City Council may want to consider granting the
variance in order to encourage housing maintenance and improvement:
The proposed addition matches the existing encroachment and in
certain instances, the City may want to encourage these types of
additions on certain properties. The City must be cautious to
ensure that other adjacent properties are not adversely affected
and.that all other zoning requirements are met. In this particular
case, all the remaining zoning requirements for the R-1 residential
district are met by the property.
Ms. McPherson stated the City Council, the HRA, and staff are
currently working -on a long term housing plan which promotes
housing maintenance and improvements. 'If this particular variance
application is approved, it is consistent with that particular

planning effort. If the Appeals Commission should choose to deny
the variance request for the addition, staff would recommend a
variance be approved to bring the existing nonconformity into
conformance.
Ms. Savage asked if -staff's analysis in this particular situation
have something to do with this promotion of housing maintenance and
improvements. Is staff saying that the Commission should be
looking at a variance request in a different way if it involves an
improvement; otherwise, there is no detriment.
Ms. McPherson stated the only real difference in this variance
request as opposed to other typical variance requests is that there
is already an existing 5 in. 10 in. by 20 ft. long encroachment.
There is already an existing porch on the back of the attached
garage which does not meet the 10 foot. setback. In this particular
instance, the conversion of the enclosed porch which already exists
to a three -season porch would add value and improve the overall
appearance and.functionality of the structure. .'It would.meet the
overall goal of improving the housing maintenance code, and it is
only unique in the fact that there is an existing encroachment on
the property.
Mr.. John Clutter stated the adjoining house 'has no doors or windows
overlooking his property, so he did not` see how the enclosed three -
season porch will affect their neighbor in any way. There is at
least 20 feet between the porch and the adjoining property. The
construction. is going to be enclosed within the limit of the
existing roof line.
Mr. Kuechle asked if the petitioner would consider cutting off 3.
feet and bringing the structure into compliance.
Mr. Clutter stated that right now the. porch is very narrow at 5 ft.
10 in. by 20 ft. The porch has existed for about 25 years, and
they want to enclose it and make it a more useful living area. The
enclosed porch would also make the house more secure.
MOTION by Mr. Ruechle, seconded by Ms. Smith, to close the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 8:35 P.M.
Ms. Smith stated she is in favoring of recommending approval of the
variance. Cutting off 3 feet would take away from upgrading the
property. The porch already exists and putting up a wall isnot
going to make much difference. There is also plenty of distance
between the petitioner's structure and the neighboring structure.
Ms. Savage stated she agreed with Ms. Smith.

Mr. Kuechle stated he would also vote in favoring of granting the
variance. The opportunity does exist to bring the structure into
compliance by setting it back 3 feet, however, that is a very minor
point and is probably being too picky.

CITY OF FRIDLEY PLAN REVIEW CHECKLIST
Applicants for vacations must submit the legal description of the
parcel (easement, street, etc.) to be vacated.
Complete site plans, signed by a registered architect, civil
engineer, landscape architect, or other design professional, to
include the following:
A. General:
1. Name and address of project
2. Legal description (certificate of survey
may be required)
3. Name, address, and telephone number
of applicant,
engineer, and owner of record
4. Date proposed, north arrow, scale, number of sheets, name
of drawer
5. Description of intended use of site,
buildings, and
structures including type of occupancy
and estimated
occupancy load
6. Existing zoning and land use
7. Tabulation box indicating:
(i) Size of parcel in sq. ft.
(ii.) Gross floor area of buildings
(iii) Percent of site covered by building
(iv) Percent of site covered by impervious -surface
(v) Percent of site covered by green area
(vi) Projected number of employees

showing widths of property lines, turning radii abutting
rights-of-way with indicated center line, paving width,
existing and proposed median cuts, and intersections of
streets and driveways
4. Vehicular circulation system showing location • and
dimensions for all driveways, parking spaces, parking lot
aisles, service roads, loading' areas, fire lanes,
emergency access (if necessary), public and private
streets, alleys, sidewalks, bike paths, direction of
traffic flow, and traffic -control devices
5. Landscaping Plan
6. Location, access, and screening detail of trash
enclosures
7. Location and screening detail of rooftop equipment
a. Building elevations from all directions
9. Utility plan identifying size and direction of existing
water and sewer lines, fire hydrants, distance of
hydrant to proposed building
