I have received a complaint from Dr. Heggestdd regarding the weed problem along the perimeter of the'shopping center, which is probably the' highway right of way and also on the east *side of the Skywood Shopping Center. He also -complained about litter all over the area and dry grass, he and his neighbors have had five to 'sic fires recently-, and he indicated that Bob Hughes and Bob Aldrich are fully aware of the problem. He also complained about a serious trespassing -problem that the kids use his property to go into the shopping center and it is a regular thoroughfare, which also contributes to litter and vandalism] and he wants ways found to -eliminate this.problem. He has made an offer that he would be willing to pay for any signs.the City would want to put up. He'also indicated that the kids in the area come behind his property and smoke pot and use other drugs, and he has brought this to the attention of the Police without any results. - - Would you please check into the problem and coordinate.a response to Dr. Heggestad's complaint. I am sending copies of this memo to the Fire Department, Police Department, and Engineering Department so that you can seek their help in -resolving the problems. Dr. Heggestad was quite upset and he said he has not received any kind of good response from the City for the last -twelve years, and if he did not get some serious action on the City's part, heis going to get a petition and really make a campaign of the area to.got the problem corrected. HILL, PIALIC SAFETY DIRECTOR FROM: LIEUTENANT RICK DATE: APRIL 10, 1974 SUBJECT: COMPLAINT FROM DR. HEGGESTAD, 1258 SKYWOOD LANE, N.E. In response to the memo from the City Manager dated March 29, 1974, the follow- ing action has been taken: I went to the location and personally viewed the property in question. It would appear that the primary problem in regard to the trespassing is the path which has been made up the hill over a period of time and which is now being used, not only by pedestrian traffic but also by minibikes and motor- cycles, etc. It would seem the only logical solution to stop traffic up and down that hill would be some type of a physical barrier preventing the passage of people, such as a fence. It would not appear that signs would be of any great value and in discussion with Mrs. Heggestad she informed Officer Duncan that they had previously placed signs which were ignored. I had Officer Duncan go to the location and take several pictures which illustrate the path going up the hill and also the area where it directly affects the Heggestad yard. In reviewing this, the path taken up the hill terminates at the tope of the hill by going through a hedge planting made by Dr. Heggestad and continuing on through his yard out onto Skywood Lane. This route is a considerable short-cut from the area on top of the hill in Innsbruck and the Skywood area, down to the Shopping Center. Pedestrian traffic to and from that area, if they were denied the use of the pathway, would have to walk about 3 or 4 additional blocks. The pictures also illustrate the extent of the fire which burned up to the base of the tree planting shown in picture #3 and they were very close to the house. An explanation of each picture is enclosed, also all the reports we have received in the past from Dr. Heggestad which are namely two, one report being called in May of 1973, and the second report dealing with the fire which occurred March 7. I have also included a plot map of the Heggestad property and have roughly indicated the route of the path up through the property as it concrns them. In regard to a solution to the Heggestad trespassing problem, as I said before, a physical obstacle would be the only solution. To police the area with officers would require a considerable amount of man-hours being devoted to nothing more than sitting at the base of the hill or the tope of the hill and advising people not to use the path. Motorcycle traffic would be difficult to catch and the trespassing aspect would be somewhat questionable in that they would have to be advised first that they were trespassing and they were not supposed to be on the property which is one of the requirements of the law. Dr. Heggestad's reference to the kids coming behind his property refers to the use of a gully north of his property which actually is owned by the party who lives directly north of him, a Mrs. James H. Mathews. There is an undeveloped lot between the Mathews homesite and the Heggestad homesite and this lot contains a depression, or gully, which in the summertime is quite well surrounded by foliage, etc., and sort -of creates an area there where kids can have a Mr. Hill Heggestad complaint -2- degree of privacy from the lower level, or the upper level. This area would be again very difficult to police since it would require someone to walk up in the area and check it quite often to see if there were in fact any kids there. They would not be visible from the parking lot below, nor would they be visible from the street above from a vehicle. I would suggest that in that concern Mrs. Mathews be contacted in regard to her feelings since it is her property. Access to that area could be denied by a fence down below which would keep the people from going up the hill. April 9, 1974 Lt. The complainant feels that it is time for the city to find a solution to the problem. Relating to the fire of this date three neighbor children have some information which he feels is pertinent to the investigation of the cause of the fire. Witness John Mathews 9 years, 1259 Skywood Lane saw smoke and told his mother, she in turn called the fire department. John saw 4 teen-age young people leave the area of the hill. He later saw these same 4 people leaving the area on two motorcycles. He is insure if they were male or female. John was trying to be helpful, however, I feel he is adding things to ghat he really saw. Witness "Ann MAthews, John's sister, said she saw the motorcycles leave the area and nothing else. 'Witness Chris Edwards, was not interviewed. -John MAthews found some matches on the hill, these were turned over to me and I have them in my possession if anyone wants them for evidence. I indicated to him.that prior to any sidewalk construction, appropriate hearings -would be held to get the affected pro- perty owner's input. It was also explained, that in our opinion the only way to eliminate the problem was the construction of a walkway with appropriate lighting and maintenance -free landscaping. He agreed but had reservations regarding the walkway next to his property. He indicated -he would await the results of. the bikeway/walkway committee study and make his input at that public hearing. I also pointed out to him that Menard's had constructed a fence which should help and will also work with him for installation of "No Tresspassing" signs to be installed in the spring.
