Mr. Edwards, owner of 1344 Skywood Lane N.E., called to report that his claim or complaint about Hentges Plumbing with reference to his water closet has been satisfactorily satisfied. Fridley, MN 55432 Attn: Mr. Darrel Clark Dear Mr. Clark: Fridley, Minnesota 3 December 1976 This letter constitutes.a protest against a plumbing contractor licensed and insured to do business in the city of Fridley. The firm is D. H. Hentges Plumbing, 732 66th Ave. North, Brooklyn Center. Mr. Hentges installed plumbing in a lower level bathroom I added to my house last spring. It was not until 13 November 1976 that I learned that his negligence caused the new toilet to leak, thus destroying the floor in the bathroom. I have no legal leverage by which to force Mr. Hentges to pay me for the floor I had to remove, or my action would be with conciliatory court. However, I want your office to know the type of individual you license to do plumbing in Fridley. Mr. Hentges claimed he does considerable business in Fridley so keep this letter in your file. Perhaps someone else in Fridley will come through with a complaint similar to mine and Mr. Hentges will neglect his way out of work in Fridley. I say I have no legal leverage because I already removed the old floor in that bathroom. Otherwise I could call in Mr. Sandeen of your Department to observe first hand the condition that dictated my claim of negligence on the part of Mr. Hengtes. The only other evidence I had was the wax seal ring used on toilets, to prevent leaking. The ring showed that no seal had been made when the toilet was initially installed. I maintain that an experienced plumber should have noticed that immediately and should have known that leaking would occur unless two or even three rings were used. I showed the ring that had been installed by Mr. Hentges to Mr. Sandeen when he came out on 15 November 1976. He agreed that the ring had not been compressed by the toilet when it was attached to the sewer pipe collar and therefore the plumber should have used more than one,ring. However, Mr. Hentges now claims that ring is not the one he installed; that I substituted a ring I bought,so that I could make him look negligent. Therefore, Mr. Hentges has his word and the word of an assistant against mine concerning the ring. It is hard to believe that a responsible businessman could be so petty! City of Fridley/ -2- 3 December 1976 Verlan Edwards I asked Mr. Hentaes to submit a liability claim to his insurance company for $70.00 to pay for the floor. He denied any possible liability because it had been 7-8 months since the toilet was installed. it II hadtcailedrue aMr? It was not until I removed the -toilet o water from the toilet was leaking under the floor covering, breaking up the sand compound used for. leveling and thus ruining the floor. The leak developed because the wax seal was not in contact with the bottom of the toilet and was simply resting on the floor collar leaving a considerable gap for leakage. $70.00 is not a large sum of money. I'm sure Mr. Hentges made afe tiles that ttoilet in profit on the job at my house. It doesn't break me either, but is the straw that broke the camel's back. Everything Mr. Hentges did on that job was done in one hell -of -a -hurry. The new floor drain in the laundry room was not installed deep enough into the floor. I knew it would create problems and I told Mr. Hentges. Rather that re -do it, I accepted it. I explained to Mr. Hentges how the water pipes must run near the laundry chute. He installed them wrong and had to come back and re-route them. I thought all water pipes were to run inside stud walls in case those walls would be finished in the future. Mr. Hentges ran the water pipes to the shower stall in the new bathroom on the outside of the walls. When I asked him to re -work them, he explained how much effort that would involve and I accepted it, although I didn't like it. I plan to finish off the laundry room someday and the water pipes now run on the outside of a wall in the laundry room. Then to climax this entire mess, I discover his neglect concerning the toilet installation. To worsen matters, on 28 November 1976, I discovered that the latest wax sealing ring used on toilets, have a plastic flange in them that fit down into the sewer pipe like a funnel. This type of seal should definitely have been used originally in this case - it was not. One other item of interest. When I re -installed the toilet, the first thing I did was check to see if the wax sealing ring made contact with the sewer pipe collar - a logical thing to do. I immediately noticed that no contact was made so I knew two rings would be needed. The interesting thing is, this was the first time I have ever installed a toilet- definitely not an experienced plumber. I maintain an experienced plumber, seriously interested in doing a good job, would have detected the problem immediately. Mr. Hentges has stated that the concrete work on the floor where the toilet was to be installed was very poor. This claim is true. The concrete is rough and uneven. That was why a floor leveling and smoothing compound was used before a floor covering was put down. Mr'. Hentges would like to blame the poor concrete job for the leaking toilet. Mr. Sandeen appeared to support Mr. Hentges by stating that perhaps this did have a bearing on the problem. I maintain that if the floor was so bad, Mr. Hentges should have noticed it and informed the contractor doing the floor and that he could not install the toilet under those conditions. In that case, the concrete floor would have had to be reworked by the other contractor before the plumbing was completed.. D. H. Hentges Plumbing may well be within their legal rights in not rectifying what I call faulty workmanship. But I believe Mr. Hentges to be unethical in this matter and I would definitely not. recommend him to anyone in Fridley. If I would have had support from Mr. Sandeen concerning the wax sealing ring, I would raquest that your office pressure Mr. Hentges to take advantage of his -being insured to do business in Fridley and rectify the matter. In fact, I urge you to pressure all contractors doing business in Fridley to do the best job possible, not just one that "gets by". Sincerely, Verlan E.
