ARTICLE VI
EASEMENTS
1. Easements for Encroachment. The title of a Lot
shall include an exclusive easement on and over any adjoining Lot
to areas occupied by fireplaces, roof overhangs, air conditioning
compressors, decks, balconies and flower boxes and the use of
a�
common utility installations and other appurtenances which are
r� part of the original construction of any Dwelling Unit on each
Lot or which are added pursuant to the provisions of Article IX
hereof.
2. Easements for Repair and Maintenance. Rights and
easements of enjoyment by the Owner of each Lot and the title of
such Lot shall be subject to the rights of the Association and
any agent, employee or independent contractor thereof, to an
easement on and over said Lot for the purpose of performing any
Common Areas Maintenance, Lot Maintenance and the construction,
repair, replacement, and maintenance of any Common Areas or
utilities and every other Owner shall have an easement on and
over said Lot for the purpose of performing the maintenance
required by Section 2 of Article VII *hereof on the. Lot or Dwelling
Unitof such other Owner.
ARTICLE VII
COVENANTS OF OWNERS
1. Residential Use. Each Lot shall he used for
residential purposes only, provided that any garage should be
used solely for the storage of vehiples. No improvement or
structure whatever, other than single family dwelling houses,
together with any garage, fence, patio, or other structure acces-
sory to the dwelling house and approved by the Architectural
Control Committee pursuant to Article IX hereof may be erected,
placed or maintained. In the event this provision is violated,
the Association may, at its discretion, take steps necessary to
remedy such violation and the costs incurred in connection there-
with shall be treated as if it is part of the monthly assessment
as described in Article IV hereof and shall be a charge on the
Lot and a continuing lien on the Lot and also the personal obli-
gation of the Owner of such Lot.
2. Maintenance of Unit. Each Owner shall be respon-
sible for all landscaping care to his Lot (excluding lawn mowing
performed by the Association) and all repairs, replacements, and
maintenance to the interior of the Dwelling Unit of such Owner,
to all portions of the Dwelling Unit not maintained by the Asso-
ciation pursuant to Section 4(b.) of Article IV hereof, and to the
Restricted Areas of his Lot. In the event such Owner shall fail
to perform such landscaping or maintain the Restricted Areas in a
manner satisfactory to the Board of Directors, the Association,
after approval by -two-thirds (2/3) vote of the Board of DirectorE
