Dear Mr. Brickner:
This is to confirm our telephone conversation of October 1, 1.990
regarding the vacation request of a portion of the 67th Avenue
right-of-way abutting 991 - 67th Avenue N.E. In order to complete
the vacation process as stipulated by the recommendation of the
variance approval, you need to submit the following:
1. A check for $40. 00 accompanying the enclosed vacation form.
2 . A legal description of the portion of the street right-of-way
to be vacated.
The City is requiring a $40. 00 fee for the vacation since a
majority of the analysis for this request has been completed via
the variance review process.
Please complete and sign the enclosed application and forward the
above two items to my attention at your earliest convenience. We
will then schedule the item for Planning Commission and City
Council consideration as soon as possible.

SUBJECT: Councilman Billings' Concern Regarding Vacation
Request, SAV #90-03
At the October 29, 1990 City Council Conference meeting, Councilman
Billings expressed concern regarding the vacation request by
Brickner Builders, to vacate a portion of the 67th Avenue cul-de-
sac (please see attached map A) . Mr. Billings questioned the
ability of the City to construct a cul-de-sac within the remaining
right-of-way should a single family home be built within the Oakley
Drive right-of-way recently dedicated in the Michael Servetus
Second Addition plat. In speaking with Assistant Public Works
Director Mark Winson, we determined that a cul-de-sac with a radius
of 35 feet could be constructed within the remaining right-of-way
(please see attached drawing B) . We believe that this should
answer Councilman Billings' concern. Should staff continue to
process this vacation request, or should Mr. Brickner be refunded
his $100.00 application fee?
