The City of Fridley has been acquiring easements for Locke Lake improvements and
maintenance. We had discussions with the Huddiks (past owners). Although Mr. Hudrlik was
not opposed to granting the easement he preferred we wait until the property was sold and
obtain the easement from the new owners (you). Mr. Hudrlik indicated he informed you of this
pending easement.
To date the City has obtained all the required easements on the perimeter of Locke Lake except
for your property.
Enclosed is the easement document for your review and signatures., Sign as your names appear
on the top of the document. I can notarize your signatures if you like. If you should have any
questions please call me at 572-3554. The property is Torrens and we will need the Owners
Duplicate Certificate of Title No. 76340 in order to record the document. The certificate will
be memorialized and returned to you at no expense.

Recognizingthe seriousness ofero-
sion and the need to establish a
comprehensive program forits con-
trol, the Board of Managers cre-
ated the Streambed and Bank Sta-
bilization Program while forming
the Watershed District's Manage-
ment Plan. This plan was ap-
proved by the State of Minnesota
in July 1990 which allowed the
Watershed District to begin tak-
ing the steps necessary to imple-
ment the program. The program
provides public and private land-
owners with resources to stabilize
properties subject to scour by wa-
ter erosion.
Streambed and bank program
projects enable the property owner
to minimize the loss of vegetation
and land to the effects of erosion.
Applications with cost estimates
are submitted to the appropriate
city prior to July 31 of each year.
Joint applications consisting of
adjacent property owners are
strongly recommended. Property
owners can receive financial assis-
tance for one-third of the owner's
cost.
How long will the District spon-
sor the program?
The Board of Managers is commit-
ted to a program of at least five
years. Whether the program is
extended beyond this period will
depend upon the number of appli-
cations received and the availabil-
ity of funding. The program is not
intended to be a permanent pro-
gram.
How is the project funded?
The Rice Creek Watershed Dis-
trict will allocate up to $30,000 per
year for the entire program. In
addition, financial and technical
assistance may be available from
other existing State programs. For
information on these programs,
contact your county soil and water
conservation district.

When is the neat application
period?
The next application period for
Streambed and Bank Program
grants will open on June 1. All
applications must be received or
postmarked by July 31.
To be eligible, applicants must
submit a completed application to
their municipal public works de-
partment with the following infor-
mation:
a minimum of two detailed
cost estimates from insured
(potential) contractors
cross sectional and plan views
of project site
other information detailed in
the application instructions.
Applications are taken during the
year prior to the year actual con-
struction will be performed.
How are applications evalu-
ated?
Applications will be reviewed first
by the appropriate municipality,
then prioritized by the Watershed
District. High priority projects
would include the use of natural
rip rap (loose stones) to protect
improved structures, trees, and
steep banks from the effects of
bank erosion. Lower priority
projects would include repair or
replacement ofretaining walls and
stabilization of areas which are
producing smaller amounts of sedi-
ment.
Considerable effort should be made
by property owners to include
neighboring lots in the repair
project. The number of contiguous
properties and their location along
the stream will be major factors in
the ranking of projects.

STREAMBED AND BANK STABILIZATION PROGRAM
Description and Need
Erosion of the bank and beds of Rice Creek and other major streams within the District has caused
considerable damage to private and public properties. The eroded sediment has an adverse effect
on downstream waterbodies. The intent of this program is to provide funds as a means of
encouraging stabilization works along the waterways of the District.
Eligible Waters
The primary intent of the program is to provide for stabilization of Rice Creek. In generally
decreasing order of priorities, additional waters include Clearwater Creek, Hardwood Creek, and
other major waterways of the District.
Erosion Mitigation Measures Eligible for Funding
Financial assistance may be available for implementing measures including riprap, gabions, revet
mattresses, deflectors, cribbing, and establishment of woody vegetative growth through the use of
fascines. Retaining walls may be eligible if they are the best possible management practice
available for the specific site.
Measures not Eligible for Assistance
Measures generally excluded from this program include removal of debris or clearing of deadfall,
removal of accumulated sediment/sandbars, repair or construction of retaining walls, tree planting,
and landscaping.
Eligible Lands
Applications for financial assistance are accepted from private and public landowners. Financial
assistance is not available to companies, corporations, or state agencies.
Evaluation Criteria
The following are criteria that will be used to rate each application. No actual scoring mechanism
will be used, but these criteria will be used to make detailed comparisons among applications.
• Are there contiguous properties which should be included with the application to ensure a
higher probability of project success?
• Does site pose health or safety problems?
• Will continued erosion lead to damage of habitable structures ?
• Has the most feasible erosion -reduction practice been selected?
• Are additional cost share funds currently or imminently available through the municipality
or state grant program?
• Is it likely that local, state and federal permits will be approved for the project?
• Will the proposed project cause additional damages to upstream or downstream areas?
• Has the site previously been identified as a potential repair site?
• Have legitimate historic efforts been made to stabilize the eroding area?

Technical Considerations
At a minimum, banks should be stabilized up to the elevation of the 10 -year occurrence interval
flood. It is the responsibility of the applicant to hire an insured (vehicle, general liability, workers
compensation) contractor capable of performing the work. The municipalities and the Watershed
District will not design the stabilization measures and will not guarantee the performance of the
contractor selected. It is the responsibility of the applicant to obtain all necessary local, state and
federal permits. Potential permits required could include the city, county, Department of Natural
Resources, Soil and Water Conservation District, United States Army Corps of Engineers, and Rice
Creek Watershed District. In addition, it is the responsibility of the applicant to obtain permission
to work within any restricted areas such as drainage and utility easements, rights-of-way, and
property not under control of the applicant.
Eligible Costs for Reimbursement
The Rice Creek Watershed District will reimburse up tom of the project costs. In instances
where state funding is available, the District will reimburse up to one-third of the cost remaining
after state contributions. District reimbursement shall be limited to labor costs associated with the
installation of the stabilization measures, and material costs such as riprap, geoteztile fabric, and
granular borrow. Planning and Design, incidental landscaping, and tree planting are not eligible.
The award value will be limited to one-third of the estimated eligible construction costs plus one-
third of all normal fees incurred as a result of regulatory agency permitting. Fees resulting from
violations will not be eligible.

SUBJECT: Tree at Locke Lake 7 ! Z ��
Jon Haukaas and I met with Carol Dalske, Outside Services, on Thursday morning, August 13th,
to inspect and discuss the removal of a large oak tree that fell into Locke Lake while the lake was
drawn down. The property owner adjacent to the tree was also present.
Carol feels Outside Services could remove the tree if given access to the lake for their log skidder.
The property owner seems agreeable to allowing access if care is taken to prevent damage to the
concrete parking area and other existing trees. The property owner also agreed to talk to his
neighbor to the east about working from their lake shore.
The property owner appears to prefer that the wood be removed from the site. I advised him that
it was the City's intention to remove, cut and stack the wood on the lake shore. Carol Dalske,
Outside Services, advised against stacking the wood .anywhere where the wood would be covered
with water when the lake was refilled.
Jon and I feel that the City should notify all the lake shore property owners that the lake will be
drained on October 15th and refilled November 1st, and they should schedule any shore line
repairs for that time period. The two-week period would allow time for the area under the tree to
drain and for the mud to become firm enough to walk on, facilitating the tree removal.
Carol Dalske will prepare several cost options:
1. Cut tree, move from the lake and stack on the shore line.
2. Chip material 6" or less in diameter and blow chips into depression between properties.
3. Remove all wood from site.
All options are to pull the stump as close to the bank as possible, but the stump will be left in the
lake.
The property owner was advised that the City will need written authorization for access across his
property. The property owner also inquired about bank stabilization this winter.

I regret to inform you that the RCWD Board of Managers has declined to offer cost -
share funds for your proposed bank stabilization project.
They reached this decision based on the fact that your shoreline is more "lake -like"
than "stream4ike" and the SBBS Program specifically excludes lake shore stabilization
projects. Other factors considered were the high cost of your project relative to the
potential for further sediment contribution, and the fact that currently the District's
cost -share fund for this program is limited because of substantial expenditures for a
large project on Rice Creek in Fridley this year.
