The Inspector of Buildings shall, before issuing permits for the _erection of any building or structure, or for any addition to any existing building or structure, or for any alteration or repairs to any existing building or structure, upon application therefore,.require the payment by the applicant for such permit of fees to the .amount herein below set forth and in the manner herein provided to -wit: UNIFORM BUILDING CODE: Type 1, 2 & 4 - $2.15 for each one thousand cubic feet, or fraction thereof, in such cubical contents. Type 3 & 5 - $1.85 for each one thousand cubic feet. ADDITIONAL INFORMATION For the purpose of computing fees for building permits, the cubical contents of any building or addition, is determined by multiplying the ground area covered from a point six (6) inches below the floor line of the basement or the cellar to the average heights of the upper surface or to the average:e -height of the roof surface of the main gable of a pitched roof. For repairs or alterations to an existing structure, the fee shall be at the rate of $3.00 per each five hundred dollars ($500.00) or fraction thereof in the cost of all proposed'work. '�- Community Development Department u PLANNING DIVISION City of Fridley DATE: April 20, 1994 TO: William Burns, City Manager FROM: Barbara Dacy, Community.Development Director Steven Barg,'Planning Assistant SUBJECT: Complaint Received by Councilmember Schneider/ Property at 5854 Stinson Boulevard It is our understanding that Councilmember Schneider recently received a complaint from Jeff and Jan Shaw who live at 5854 Stinson Boulevard. Staff has been involved in this situation and would like to provide a summary of what has occurred to this point. On March 9, 1994, Mr. Shaw contacted staff to discuss this matter. On March 10, 1994, Steve Barg inspected the site with Gary Ford of the Building Division. Since it appeared that construction of the garage at 5864 Stinson Boulevard during 1992 may have affected the slope, staff sent a letter (copy attached) advising the homeowners at 5864 Stinson Boulevard (Craig and Janna Coleman) of this concern and requesting the opportunity to meet and discuss this issue. Upon receiving this letter, Mr. and Mrs. Coleman contacted staff regarding this matter. The Colemans contend that they should not be held accountable for any additional runoff to the neighbors, since they obtained a valid building permit and City building division staff inspected the site and "signed off" on the permit. Staff asked the Colemans if they might consider participating with the Shaws in a solution, but the Colemans stated that they had done nothing wrong and were not interested in assisting the Shaws in any way. The Fridley Zoning Code states that "no land shall be altered and no use shall be permitted that results in water runoff causing flooding, erosion, or deposits of minerals on adjacent properties." While the slope may have been somewhat altered along the south side of the Coleman property, the land always sloped to the south, causing water to drain toward the Shaw property. It appears that the Shaws have constructed a berm designed to direct runoff water toward thp;rear of their property, and that a more "formal" berm at this location might greatly reduce the problem. 5854 Stinson Boulevard Complaint April 20, 1994 Page 2 Both parties have suggested that the City should have caught this during the building permit process. However, the City does not currently require that residents submit grading or drainage plans when applying for a building permit to construct a garage. Further, the City Attorney advised staff that the City bears no responsibility in such matters, and that it is a civil matter between the parties. Staff's policy has been to address complaints such as this by attempting to get the parties_to work together:on a solution and., if.this does not prove successful, advising the complainant that he may pursue civil action against- the neighbor in an attempt to recover any costs for damages which may have been incurred. Staff advised both parties of its position several weeks ago, and there has been no contact with either party since that time. Flora, Public Works Director DATE: July 7, 1998 SUBJECT: Stinson Boulevard Tree PW98-146 At the special council meeting of July 6,1998, Mr. Jeffery Shaw from 5854 Stinson and Mr. Ralph Nielsen from 5876 Stinson reported to the council that three trees along Stinson Blvd right-of-way fell into the street and the City failed to take any action to remove or clear the debris. The June storm occurred on the evening of June 24, 1998. The first call we received regarding the tree on Stinson Blvd was on Friday, June 26'. Upon visiting the site at that time, the tree trunk had been cut up and was removed and all that was remaining in the street were the tree branches. In measuring the tree stump, it was identified that the tree had been a private tree and was 3 feet beyond the property line. Accordingly, the individual was told that the remaining portion of the tree would have to be cleared from the right-of-way. Upon Mr. Nielsen's request, we provided him barricades for him to block off the area while he apparently was to complete removal of the tree that had been cut and felled onto the street. At the council meeting the council requested we remove the debris which was done on Tuesday morning, July 7, 1998. A follow-up photograph was taken of the area (copies attached) which indicate that there was only one tree, not three, and that the tree was a private tree, for your information as opposed to the statements that were made at the council meeting. The tree was cut down and dropped in the street. It is very apparent from what remains of the tree that the whole tree didn't fall into the street, and the property owner didn't make that claim when I talked to him on June 26th. From my discussion with the property owner, it's apparent that whoever cut the tree told him the City would haul the brush away. All the larger limbs and trunk pieces. have already been removed by others. When I met with the property owner, I told him that he couldn't block the street with the tree branches and it would have to be barricaded until the brush was removed. I offered to loan the property owner some barricades until he had time to remove the brush. At other locations in the City where private trees fell into the street, the tree was cut at the boulevard line and only the portion of the tree that was actually in the street was removed. The portion that was on private property was left for disposal by the property owner.
