Sincerely, Steven Barg Planning Assistant SB:ls CE -94-67 Community Development Department PLANNING DIVISION City of Fridley DATE: April 20, 1994 TO: William Burns, City Manager FROM: Barbara Dacy,-Community Development Director ;i Steven Barg, Planning Assistant SUBJECTS complaint Received by Councilmember Schneider/ Property at 585.4 Stinson Boulevard It is our understanding that Councilmember Schneider recently received a complaint from Jeff and Jan Shaw who live at 5854 Stinson Boulevard. Staff has been involved in this situation and would like to provide a summary of what has occurred to this point. On March 9, 1994, Mr. Shaw contacted staff to discuss this matter. On March 10, 1994, Steve Barg inspected the site with Gary Ford of the Building Division. Since it appeared that construction of the garage at 5864 Stinson Boulevard during 1992 may have affected the slope, staff sent a letter (copy attached) advising the homeowners at 5864 Stinson Boulevard (Craig and Janna Coleman) of this concern and requesting the opportunity to meet and discuss this issue. Upon receiving this letter, Mr. and Mrs. Coleman contacted staff regarding this matter. The Colemans contend that they should not be held accountable for any additional runoff to the neighbors, since they obtained a valid building permit and City building division staff inspected the site and "signed off" on the permit. Staff asked the Colemans if they might consider participating with the Shaws in a solution, but the Colemans stated that they had done nothing wrong and were not interested in assisting the Shaws in any way. The Fridley Zoning Code states that "no land shall be altered and no use shall be permitted that results in water runoff causing flooding, erosion, or deposits of minerals on adjacent properties." While the slope may have been somewhat altered along the south side of the Coleman property, the land always sloped to the south, causing water to drain toward the Shaw property. It appears that the Shaws have constructed a berm designed to direct runoff water toward thp;rear of their property, and that a more "formal" berm at this location might greatly reduce the problem. 5854 Stinson Boulevard Complaint April 20, 1994 Page 2. .Both parties have suggested that the City should have caught this during the building permit process. However, the City does not currently require that residents submit grading or drainage plans when applying for a building permit to construct a garage. Further, the City Attorney advised staff that the City bears no responsibility in such matters, and that it is a civil matter between the parties. Staff's policy has been to address complaints such as this by attempting -to get the .parties 'to' work together on a. solution and, . if this does not prove successful, advising the complainant that he may pursue civil action against the neighbor in an attempt to recover any costs for damages which may have been incurred. Staff advised both parties of its position several weeks ago, and there has been no contact with either party since that time.
