Liebl. Upon a voice vote, all voting aye, Mayor Kirkham declared
the motion carried.
MOTION by Councilman Sheridan to approve Change Order #1 for Bostrom
Sheet Metal Works, Inc., 785 Curfew, St. Paul, Minnesota for air
conditioning work for Police and Park Department remodeling in Civic
Center in the amount of $228.00 making the amended contract $6,070.00.

Councilman Liebl said that the Board of Appeals had approved of
this request, however, he has had some second thoughts on this,
and would like to have the feeling of the Council. He asked if
Mr. Zimbal does not already have an attached double garage. The
City Manager replied that he had, and that the applicant has 4
cars, two of which he now parks in the place he is requesting a
garage.
Councilman Liebl asked how big the present garage is and the City
Engineer .said that he thought it was 201 x 24° and that, the pro-
posed garage was 20' x 301. Councilman Liebl said that he thought
this was a lot of garage space. The City Engineer explained that
the Board of Appeals' feeling was that as long as the petitioner
was using the land for parking his cars now, it could be granted.
Carl Paulson asked if there was any obstruction of view of the traffic.
Councilman Liebl said it might possibly be an obstruction but Mayor
Kirkham said that he did not think so. Mr. Paulson said that
aesthetic values must be considered. Councilman Liebl said that this
is exactly what the Council is considering.

Councilman Sheridan said that the City cannot license Electrical
Contractors. The City Attorney agreed and said that this was tried
in Golden Valley.
Mayor Kirkham suggested to Mr. Paulson that he take this up with his
State Legislators.
Mr. Richard Harris, a visitor to the Council Meeting, suggested that
this might be a good time to examine the licensing procedures of
all the contractors since the City is thinking of adopting a
tagging ordinance.

TIME AND PLACE OF HEARING THEREON-.
The City Attorney said that it was suggested to him that the City
join the N.S.S.S.D. Board in fighting this condemnation by the City
of Minneapolis. He said that he would want to try to prevent this
condemnation by Minneapolis. He explained that this information
had just come to him today and that he had not had a chance to look
it over.
Mayor Kirkham commented that it would seem that N.S.S.S.D. would be
the superior authority in this action.
MOTION by Councilman Sheridan that in the interest of the City and
the N.S.S.S.D. District, the City should authorize the City
Attorney to work with Mr. Meyers, the Attorney for N.S.S.S.D. to
fight this land acquisition petition. Seconded by Councilman
Liebl. Upon a voice vote, all voting aye, Mayor Kirkham declared
the motion carried.

CENTER:
The City Engineer said that the Park Department and Police Depart-
ment plan to move into their new quarters after the Labor Day weed -

A visitor to the Council Meeting said that he did not think this
garage would be compatible with the rest of the area. He did not
think the value of the cars would be equal to the value of the
garage. He said that there was one car parked on the boulevard
which has not run since it arrived.
Councilman Liebl said that he could not understand the action of
the Board of Appeals. He said that he had received calls from
neighbors expressing concern and that the people felt that the pre-
sence of this garage would devaluate their property. He said that
if this request was approved, what good are our ordinances. He
said that he felt this would set a bad precedent. He said that some
of the people who called had suggested that the proposed garage
be attached, and the existing garage be made living space.
Mr. Jack Korthof, 6261 Rainbow Drive, said that he had looked at
this area and talked to Councilman Liebl and he felt that the
front yard could not handle parking one car without it hanging over
into.the boulevard area. He also suggested that the garage be set
back,.and the existing garage be made a part of the house.
Carl Paulson said that people should consider how much space they
need for living before buying and if more land is necessary, they
should buy a larger area. He said that the Board of Appeals should
also look into other aspects of the problem, such as how many
drivers there are in the family, what the garage will be used for
etc. Mayor Kirkham assured him that this is done by the Board of
Appeals, and that the Council's main concern was the non --compliance
with our ordinances.
MOTION by Councilman Sheridan to deny the request for a va-riance
by Walter Zimbal, 6240 Sunrise Drive, for the erection of a 20' X
30' garage. Seconded by Councilman Liebl.. Upon a voice vote, all
voting aye, Mayor Kirkham declared the motion carried.

RECEIVING MINUTES OF BOARD OF APPEALS METING OF JULY 31, 1968:
NOTION by Councilman Liebl to receive the Minutes of the Board of
Appeals meeting and concur with their actions. The motion was
seconded by Councilman Harris who requested that the Administration
ask the Secretary of the Committee to put more commentary in the
minutes, so that the feelings of the people -either for or against
a request are more explicit.
Councilman Liebl said that the variance request from Mir. Zimbal
,which was tabled should have the concurrance of the people within
200 feet because the ordinance will be violated if he builds the
second garage. He said that he had received quite a few telephone
calls concerning this. The City Attorney said that the Board of
Appeals has the authority to make a decision, and if either the
applicant or the neighbors object to the decision, they can appeal
it before the Council.
THE VOTE upon the motion, being a voice vote, all voting aye,
Mayor Kirkham declared the motion carried unanimously.

MOTION by O'Bannon (1) To grant the variance of ordinance #332, Section
45.102, Paragraph 4A, to reduce the minimum floor area from 2.'500 square feet
to approximately 1200 square feet for the purpose of a Pet Clinic only
because the size proposed is of sufficent size for the proposed purpose and
that there is sufficent land to the rear of the building for future expansion.
(2) To grant the special use permit as provided in ordinance #373, as his plans
and specifications conform to the requirements of ordinance #373, and provided
that this building be used for treatment of animals and not the boarding of
same.
Seconded by Ahone.n. Upon a voice vote, there being 2 ayes and Minish
abstaining from voting because of previous acquaintances with Dr. Dudley, and
no nays, the motion carried.

Mr. Jack Korthof, 6261 Rainbow Drive, said that he had looked at
this area and talked to Councilman Liebl and he felt that the
front yard could not handle parking one car without it hanging over
into.the boulevard area. He also suggested that the garage be set
back, and the existing garage be made a part of the house.
Carl Paulson said that people should consider how much space they
need for living before buying and if more land is necessary, they
should buy a larger area. He said that the Board of Appeals should
also look into other aspects of the problem, such as how many
drivers there are in the family, what the garage will be used.for
etc. Mayor Kirkham assured him that this is done by the Board of
Appeals, and that the Council's main concern was the non-compliance
with our ordinances.
MOTION by Councilman Sheridan to deny the request for a variance
by Wa ter Zimbal, 6240 Sunrise Drive, for the erection of a 20' X
30' rage. Seconded by Councilman Liebl. Upon a voice vote, all
voti g aye, Mayor Kirkham declared the motion carried.
