SECTION 2. The Inspect:)r of Buildings shall, before issuing permits for the
erection of any building or structure, or for any addition to any existing
building or structure, or for ._iny ,41terati.on or repairs to any existing
building or structure, upon application therefore, require the payment by the
applicant for such permit of fees to the amount herein below set forth and in
the manner herein provided to -edit:
UNIFORM BUILDING CODE: Type 1, 2 & 4 -- $2.15 for each onu thousand cubic
feet, or fraction thereof, in such cubical contents. Type 3 & 5 - $1.85 for
each one thousand cubic feet.
ADDITIONAL INFORMATION
For the purpose of computing fees for building permits, the cubical contents
of any building or addition, is determined by multiplying the ground area
covered from a point six (6) inches below the floor line of the basement
or the cellar to the average heights of the upper surface or to the average
height of the roof surface of the main gable of a pitched roof.
For repairs or alterations to an existing structure, the fee shall be at the
rate of $3.00 per each five hundred dollars ($500.00) or fraction thereof in
the cost of all proposed work.
In no case shall the fee charged for any permit as set forth in Section 2 be
less than $5.00.
VERIFICATION OF FOUNDATION
NOTEI Permits Lor construction will be issued a minimum of 24 hours from the
time of application, to allow for proper review of the proposed structure and
of the construction site.
A Certified Survey of the lot, showing the location of the foundation, once it
has been constructed, will be required before proceeding with the framing.
CERTIFICATE OI' OCCUPANCY
Application for a Certiiicate of Occupancy shall be made ten (10) days prior
to the use or occupancy of any structure for which a building permit has been
issued; and said structure shall not be used or occupied until a Certificate
of Occupancy has been issued.

Records indicate main sewer line stoppages occurred on April 19, 1983, January
10, 1988, and January 16, 1994. Sewer Stoppage reports are attached.
Records also indicate that the main was cleaned August 31, 1989, in conjunction

SUBJECT: 201 Sylvan Lane Sewer Backup
On January 16, 1994, the resident at 201 Sylvan Lane experienced a sewer backup at
approximately 9:30 am. It appeared that a stick had been lodged in the manhole, causing
the backup. The stoppage was relieved at 10:20 am the same day. Service Masters was
contacted to provide cleaning and disinfecting of the residence. On this extremely cold day
Service Master was involved in a number of water breaks and was unable to respond
immediately. They did, however, show up to clean and disinfect the property as their
manpower became available.
This home is serviced by a sewer line on Sylvan Lane which enters the manhole that receives
sewage from two additional lines at the intersection of Sylvan Lane and Jupiter Drive.
Our records indicate that over the last 10 years there have been three backups on the
property: April 19, 1983, January 10, 1988 and January 16, 1994.
This sewer line was last cleaned in August, 1989. There have been no indications of
problems with this line since then.
Information is not available as to the depth of the basement of the residence. It would
appear that due to the amount of flow entering the manhole and the possible deep footing
of this residence, any stoppage in the manhole will result in a backup of this property. No
other properties in the past have been affected.

back into our basement.
The cost to repair the damage is estimated at $4335.93 (see attached), plus
450.00 in personal loss. Our insurance coverage carries a deductible of

Subject: Sewer Backup at Hogetvedt Residence
Date: January 20, 1994
Today I received a call from Cindy Hogetvedt, 201 Sylvan Lane N.E. ,
Fridley, 55432, (571-1177). There was a sewer backup in her home
on Sunday morning, January 16, 1994. Apparently, it was quite a
mess with junk in the basement and no way to open the windows with
a thirty degree below zero temperature outside. She claims that
this is the fourth time that their sewer has backed up in recent
years. She wants the City to pay the $500 deductible on her
homeowner's insurance policy. She further claims that there is
thousands of dollars worth of damage to her home.
Mrs. Hogetvedt also wants to appear before the City Council to air
her complaint. I informed her of the February 7 date for the next
council meeting and the open forum time. She said she will be on
vacation at that time but very likely -will appear at the council
meeting on February 22. I will get in touch with Paul Lawrence to
get further background on this matter. In the meantime, I informed
Mrs. Hogetvedt about the process for making a claim against the
City. _

SUBJECT: 201 Sylvan Lane SewerBackup
On January__ 16, 1924? the resident at 201 Lane experienced a sewer backup at
approximately -4:3-0- am, It appeared that stic had been. lodged in the manhole, causing
the backup. The stoppage was relieved at-10-2G-Am'the same day. Service Masters was
contacted to rovide cleaning and disinfecting--of-the residence. On this extremely cold day
,-Ser—Vic—e-Mastei was involved in a number of water breaks and was unable to respond
`-immee iately. They did, however, show up to clean and disinfect the property as their
manpower became available.
This home is serviced by a sewer line on Sylvan Lane which enters the manhole that receives
sewage from two additional lines at the intersection of Sylvan Lane and Jupiter Drive.
Our records indicate that; o er �e lasF-lam year' there have been ,three -backups' on the
property: April 19, 1983, J anua- ry -10; T9$8 and January ] 6, 1994. - ---- -
This sewer line was last cleaned in August, 1989. There have been no indications of
problems with this line since then.
Information is not available as to the depth of the basement of the residence. It would
appear that due to the amount of flow entering the manhole and the possible deep footing
of this residence, any stoppage in the manhole will result in a backup of this property. No
other properties in the past have been affected.

Today I received a call from•Cindy Hogetvedt, 201 Sylvan Lane N.E.,
Fridley, 55432, (571-1177). There was a sewer backup in her home
on Sunday morning._January 16, 1994. Apparently,_it was quite a_
mess with junk in - the`. basement and no way to open the windows with
a thirty degree below zero temperature outside. She claims that
this is the fourth time that their sewer has backed up in recent
years. She wants the City to pay the $500 deductible on her
homeowner's insurance policy. She further claims that there is
thousands of dollars worth of damage to her home.
Mrs. Hogetvedt also wants to appear before the City Council to air
her complaint. I informed her of the February 7 date for the next
council meeting and the open forum time. She said she will be on
vacation at that time but very likely will appear at the council
meeting on February 22. •I will get in touch with Paul Lawrence to
get further background on this matter. In the meantime, I informed
Mrs. Hogetvedt about the process for making a claim against the
City.

SUBJECT: 201 Sylvan Lane Sewer Backup
The resident at 201 Sylvan Lane experienced a sewer backup on Sunday, January 16, 1994. We
were notified of the problem at 9:30 am. The crew arrived at the site at 10:00 am and the blockage
in the downstream manhole was cleared by 10:20 that morning. The basement had about 1 -inch
of water in a tiled floor room and a 10 x 12 ft carpeted room.
January 16 was an extremely cold day. When we called Service Master to come to the scene and
assist in cleaning and sanitizing the basement, they were unable to respond immediately because
of other broken waterline projects they were involved with. As a result, we called two other firms
but they could not respond. We therefore requested Service Master to come to the residence as
soon as possible. They arrived at 9:30 am Monday, the following day. Their initial effort was to
vacuum, clean, dry, sanitize and deodorize the basement. The bill for that work was $150. The
residents indicated they were concerned with the dirt on the steps as a result of the cleanup.
Service Master returned on February 12 and cleaned the carpeted steps in the residence for an
additional cost of $55.
The residence experienced a total of three backups: the first on April 19, 1983 was a result of the
downstream manhole blockage. The second was on January 10, 1988, exact cause was not known,
and the most recent one on January 16, 1994 was a result of the downstream manhole blockage.
It should be noted that there are three lines entering the manhole downstream of the property,
with a fourth line which transports the flow from that area. As a result, any blockage in that
manhole does receive a considerable amount of water from the three lines. It appears that the
residence at 210 Sylvan Lane must have a relatively deep basement as this is the. only residence that
experiences backups as a result of problems in the downstream system. It is not known whether
or not this residence has a backflow preventor in their floor drains. If the traps are designed for
a backflow preventer, this item should be installed or the trap could be considered for modification
for a backflow seal.

Our address files do not indicate basement elevations of the homes on Sylvan Drive. As a
result, the basement elevations cannot be determined without entering each home and taking
elevation shots.
201 Sylvan is the closest connection to the manhole on Sylvan Drive. As a result, any blockage
in that manhole will result in the 201 Sylvan service being the first affected. This does not have
a direct relation to the actual basement elevations as the sanitary line rises from that location.

As you know, our office is handling the investigation of the above captioned sewer back up on behalf
of the City of Fridley.
Our investigation into this sewer back up has been completed. It is important for you to understand
that in order for the City to be at fault for your damages, there are four areas that must be considered.
There must be a defect in the City's sewer line; the City had to have had knowledge of a defective
condition in their main line; the City had to have failed to properly respond to their notice of a
dt,fective line; and as a result of the City's failure to respond, the damages occurred. Our
investigation has revealed there was not a defect in the main line; the City did not have prior
knowledge that there was anything wrong in their line; and accordingly, the City did promptly
respond, and the damages you sustained were not a result of a defect in the municipal sewer line.
our investigation has shown there was a sewer back up at your home on April 19, 1983, January 10,
10,83, and the most recent on January 16, 1994. In reviewing maintenance records provided by the
City, we feel the City has exercised reasonable inspection and maintenance of their sewer lines. The

Our investigation into the January 16, 1994 back up reveals a 2 foot stick that was also removed from
the manhole. The City has a maintenance program where the City is divided into several areas. The

has not been a history of grease or roots found in their maintenance and the schedule does appear to

We are requesting a 3-4 month extension. We had to delay scheduled work until after a
variance hearing which took place the third week in July of 1998.
Due to the delay caused by the hearing and the 1998 storms, some of the work could not
be re -scheduled until spring of 1999.
