M]NISB CHAIRMAN BOARD OF APPEALS April 9, 1971 To The Board of Appeals and Fridley City Council: I have talked to Mr. William Dieck concerning a variance request for the house he purposes to build which joins my property at the point where the variance is requested. I have seen the plot and the blue prints and I am fully aware that this house will be approximately 221 from the lot line on the north end and approximately 191 on the south end rather than the normal 251 required. I feel this house will be an asset to the neighborhood as Mr. Dieck has purchased 1-1/2 lots to place this house on and wishes to build in this spot to retain the trees which lay to the north. I recommend that he be given this variance permit. Sincerely, "`Ronald Ellis �3. THE BOARD OF APPEALS MINUTES OF APRIL 27, 1971 Pale 3 Seconded by Sondheimer. Upon a voice vote, there being no nays, the motion carried unanimously. REDUCE THE REAR YARD DEPTH M&UIM21ENT FROM 25 FEET TO 19 FEET 7 INCHES TO R T THE CONSTRUCTION OF A WELLING ON PART OF LOT 5, BLOCK 1, Mr. Dieck was present to present the request. A survey and plans were shown to the Board. Mr. Dieck stated he has bought 12 lots which make up a long corner lot at a curve on Talmadge Way. The house will be a split entry and will face the West. He will be using the side yard, to the North, as the back yard. He then presented a letter of no objection from the adjacent property owner on the North. MOTION by Drigans to receive the letter of no objection written by Mr. Ellis. Seconded by Sondheimer. Upon a voice vote, there being no nays, the motion carried unanimously. Mr. Dieck explained he could turn the house on the lot to conform to the Codes but he would then have to take out quite a few trees which he would rather not do. MOTION by Harju to close the public hearing. Seconded by Drigans. Upon a voice vote, there being no nays, the motion carried unanimously. MOTION by Harju to recommend approval of the variance to the Council for the following reasons: 1, Placing this house on the lot any other way would mean removing trees which are an asset to the lot as this is a wooded neighborhood. The other houses in the neighborhood have large setbacks as they are trying to save the trees. 2. We have a letter of no objection for the variance from the adjacent property owner. Seconded by Harju. Upon a voice vote, there being no nays, the motion carried �punanimously. ADJOURNMENT: The meeting was adjonraed by Chairman Minish at 8:25 P.M. (REQUEST BY MR. WILLIAM DIECK, 2410 ARDAN AVENUE, MINNEAPOLIS, MINNESOTA): The City Engineer said that Mr. Dieck has a letter from the property owner behind him and he has no objection to the variance. He showed the Council photographs of the property. MOTION by Councilman Harris to grant the rear yard depth variance to Mr. William Dieck as recommended. Seconded by Councilman Kelshaw. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. MOTION by Councilman Kelshaw to receive the Minutes of tkte Board of Appeals Meeting of April 27, 1971. Fridley, Minnesota Day Call: $6.50 Night Call: $7.00 Snowmobile: $5.00 Motorcycles: $6.50 Snowbirds $7.50 Trailers: $10.00 per hr. depending on size Accident: 1 i $12.00 per hour Police Cars: - No bill except under warranty Inside Storage: $3.00 Outside Storage: $2.00 The Acting City Manager said that Shorty's Towing Service was the only company that submitted a bid. He said the specifications were basically the same as previously, and he reviewed the bid prices for the Council. :MOTION by Councilman Harris to award the towing contract to Shorty's Towing Service. Seconded by Councilman Breider. Upon a voice vote, all voting 7tye, Mayor Kirkham declared the motion carried unanimously. CONSIDERATION OF PURCHASE OF PROPERTY AT 5951 3RD STREET: (LAPIDES ESTATE) The City Attorney said that technically these lots were still R-2, because iwhen the Council rezoned this area, these lots were omitted, however, if ,this went to court they would argue that the rest of the area was rezoned and the City did it so as not to have to pay the coroaercial price. Councilman Harris asked what the original price had been. The City Attorney said he believed he had asked for $17,000. Councilman Liebl thought that $15,000 was a fair price considering what other lots have sold for in this area.
