Fridley, MN 55432 Dear Mr. Mayer: I have received a copy of the letter which you recently sent to the City Manager and City Council. I have had an opportunity to review the issues you have raised and would like to provide a staff response to your concerns. In your letter, you make reference to two complaints of parking vehicles on lawns. Before addressing the specific locations that you have referenced, I would like to inform you of the status of our parking requirements. Recently, we lost a court case in which an individual was parking vehicles on the grass directly in front of his/her front door. The judge indicated that he believed our zoning ordinance provisions were unenforceable because there was not a clear tie between parking facilities and parking behavior. Since that time, we have been working to amend the zoning ordinance to correct this problem, and the first reading of this ordinance amendment is scheduled for the August 16, 1993, City Council meeting. Since my employment began with the City in the summer of 1988, I have received a number of complaints regarding 350 Osborne Road. Much of the neighborhood concern has been the parking of vehicles on portions of the property away from the hard surface driveway. I have sent many letters and worked with the Police Department regarding enforcement during non -business hours (nights and weekends) to resolve this problem. The last complaint that I received on this address was in April 1992, and my records show that the violation was promptly corrected. Since that time, I have not received any complaints regarding this property; but upon Council approval of the previously -referenced ordinance amendment, I will be glad to reinspect this site and follow up accordingly. You indicate that you spoke with me about this property before but that nothing has been done to date. Perhaps, there was a misunderstanding on my part or miscommunication between us, but my records do not show a specific complaint regarding unlawful parking on 67th Avenue during the past two years. Once again, I would be happy to reinspect and take appropriate enforcement action upon approval of our ordinance amendment and information from you regarding the property address. Finally, I would like to address your five point request of the City Manager and City Council. 1. Trimming trees - It is my understanding that your neighbor refused to trim a tree which encroaches onto your property. The Fridley City Code does not address this issue; but, as a property owner, it is your right to trim trees/bushes at the property line. I can tell from your letter that I have provided you with this information previously, but you are frustrated because you do not feel this is your responsibility and you also do not believe you should be responsible for disposing of the cut branches. While I can understand and appreciate your opinion on this issue, the City Code is silent on such matters and they are basically civil issues between property owners. 2 & 3. Fence construction/maintenance - You indicated that you believe your neighbor should be required to construct a gate in .his privacy fence to allow him appropriate access for maintenance purposes and that he should be required to paint or stain this fence. Fridley City Code 213 (copy enclosed) provides the requirements regarding fence construction and maintenance. The primary subsection which addresses your concerns is 213.06 (Substantial Construction and Abatement), but this paragraph does not require the construction and maintenance which you believe should be necessary in this circumstance. 4 & 5. Change the City Code - You have stated that two changes should be made to the City Code regarding fencing and landscaping requirements adjacent to property lines. Specifically, you have stated that property owners should not be permitted to plant trees and shrubs on a property line and that all privacy fences should be maintained and not unnecessarily encroach on neighboring properties. I Loren Mayer August 12, 1993 Page 3 With respect to trees/shrubs, the City Code does not address this issue. It is considered to be a civil matter between property owners, and anyone believing that a neighbor is encroaching onto their land may take appropriate civil action to protect their property rights. With respect to fencing, the City Code does require that all fences must be constructed and maintained appropriately. Although the City Code requires that all fences installed on property lines must be agreed to in writing by both property owners, it does not stipulate how far within one's owned property a fence must otherwise be constructed. However, when residents call the City, they are normally informed that they will be expected to fully maintain their privacy fence and that they should allow enough room on the other side of the fence to provide all maintenance required. Since you have requested that the City change the existing code to address these issues, I would be happy to refer this matter to the Council for their consideration. Recently, you received a letter regarding numerous code enforcement issues raised by the property owner at 7523 Tempo Terrace N.E. (Loren Mayer). Staff has reviewed this letter and would like to provide the following response. On August 12, 1993, staff sent a letter to Mr. Mayer addressing the issues which he raised in his letter. (A copy of this letter is attached for your review.) In this letter, staff addressed specific properties about which Mr. Mayer indicated he had previously filed complaints. Both of these involved parking vehicles on lawns, and staff's response included information regarding the City's current ordinance amendment process on this issue. With respect to Mr. Mayer's immediate neighbors and the concerns regarding construction and maintenance of fencing/ landscaping along the property lines, staff explained that the. issues raised are basically civil matters between the property owners and are not specifically addressed by the Fridley City Code.
