Fridley, Minnesota 55432 RE: Request for Letter of "No Zoning Restrictions" Mr. Knepper: The Zoning Code in Fridley does not allow a home occupation, or business from the home that involves over-the-counter retail sales in the R-1, Single Family Residential zoning district. Your property is zoned R-1, Single Family residential, therefore, a gun dealer cannot operate from your address since retail sales would be involved. The City Code (Chapter 205) describes a Business as any occupation, employment or enterprise wherein merchandise is exhibited or sold or which occupies time, attention, labor or materials or where services are offered for compensation. Code (Chapter 205) goes on the state that a Home Occupation as; any occupation or profession engaged in by the occupant of a dwelling unit and carried on within the unit and not in an accessory building. Any home occupation shall be clearly incidental and secondary to the principal use of the premises and shall not change the residential character. The following are criteria of home occupations: A. Professional offices, minor repair services, photo or art studios, dressmaking, teaching and similar uses. B. No stock in trade is stored outside the dwelling unit. C. No over the counter retail sales are involved. D. Entrance to the home occupation is gained from within the structure. E. Teaching is to be limited to six (6) or less students at any given time. F. Licensed home based Family Day Care that serve twelve (12) or fewer children when one (1) care giver is provided and licensed home based Group Family Day Care that serve fourteen (14) or fewer children when two (2) care givers are provided, as defined by the Minnesota Rule, Parts 9502.0300 to 9502.0445. Fridley, Minnesota 55432 Subject: Request for letter of "No Zoning Restrictions" To Whom It May Concern; I need a letter from the City of Fridley stating that the City has no Zoning Restrictions for someone who wishes to operate a firearms business out of their home. This request is from the local Bureau of Alcohol, Tobacco, Firearms and Explosives (A.T.F.) office in St. Paul. Let me explain as I continue. I submitted an application for a Federal Firearms License (FFL) to the Bureau of Alcohol, Tobacco, Firearms and Explosives in hopes of establishing a business in my home. The application instructions stated that I should first check with my local authorities to make sure there were no Zoning restrictions prior to the submission of my application. So I made a visit to the Fridley Police Station. There, I spoke with an officer on duty that was available to answer my questions. He stated that he wasn't aware of any restrictions. Furthermore, he cited the fact that there was already someone in Fridley who operated a Firearms Business out of their home. So, with this news, I proceeded with the application process. The next step in the process is an interview with a local ATF Field Officer. Prior to this interview, he has asked for this letter as requested above.
