Dear Ms. Wallach: On July 1, 1990, the City of Fridley began a new program called Systematic Code Enforcement. This program is designed to provide fair and equitable code enforcement, improve the City's appearance, and maintain property values by creating a more attractive suburban environment. Under this program, all properties in the City will be inspected approximately once each year to ensure that they are in compliance with the Fridley City Code. A recent inspection of your property revealed that not all Code requirements are presently being met. Listed below are item(s) which do not comply with the Code: 1. Observed solid waste containers in front of garage in front yard. Fridley City Code 113 requires that solid waste containers must be kept in the side yard, rear yard, or garage, except on the collection date. 2. Discontinue outside storage of utility trailer located near driveway in front yard. (Fridley Zoning Code does permit storage of such trailers in the side or rear yard.) Your prompt attention in correcting this problem would help us in our effort to improve the City. Wallach 5849 Tennison Drive NE Fridley MN 55432 Subject: 2001 Street Improvement Project Dear Ms. Wallach: Thank you for your letter expressing concern over the costs for the 2001 Street Improvement. Written comments had to be received prior to the November 20 meeting to be entered into public record. However, I will forward your letter on to your Ward Councilman Rick Wolfe. The estimated cost for the concrete curb and gutter is based on an average of past project costs. Due to the large percentage of assessable property on this project, I fully expect the actual cost to be much less. The costs assessed to the benefitting properties is approximately only 10-15 percent of the total project cost, the remainder is paid by the City from budgeted capital improvement funds. The assessment may be paid in a lump sum after the project is completed or it may be added to your property taxes to be paid over a period of 10 years. $1,125.00 assessed over 10 years at 7.5% interest equates to $163.90 per year or about $13.66 per month. As a senior citizen, you will have another option. The City allows for assessments against any homestead property owned by a person who is 65 years of age or older to be deferred until the time the property is sold or transferred to other ownership. To use this option, you need only submit a request for deferral on these grounds to the City at the final assessment hearing after the project has been completed. Haukaas Public Works Director JHH:cz Enclosure RESOLUTION NO. 14 - 1995 A RESOLUTION DEFERRING SPECIAL ASSESSMENT PAYMENTS FOR SENIOR CITIZENS WHEREAS, Minnesota Statutes authorize cities to defer special assessment payments for certain senior citizens, and WHEREAS, said deferment of assessments may be permitted at the discretion of the City Council, and WHEREAS, the City Council of the City of Fridley finds and determines that deferral of special assessments for certain senior citizens is in the public interest, and WHEREAS, it is necessary and proper that the City Council set forth its general policies and guidelines for granting said deferrals of special assessments for senior citizens, NOW, THEREFORE,.BE IT RESOLVED, that the City Council of the City of Fridley does endorse the principle of deferment of special assessments for senior citizens where the payment of said special assessments constitute a hardship: BE IT FURTHER RESOLVED, that the City Council's policy and procedures for granting said senior citizen special assessment deferments shall be based upon the following factors: 1. The property must be homestead property. 2. The owner must be at least 65 years of age or older, and in the case,of husband and wife, one member must meet this age requirement. 3. The owner is retired by virtue of permanent ancT total disability for whom it would be a hardship to make the payment. 4. The owner will make application for deferred payments on forms prescribed by the Anoka County Auditor and will make.application to the City of Fridley on forms provided by the city. 5. The application for said deferral must be made within the first thirty (30) days after the final assessment rolls are approved by the City Council. This time limit may be waived upon showing of extreme hardship. 6. The annual payment for the special assessment exceeds 1% of the adjusted gross income of the owner, as determined by the most recent Federal Income Tax Return, -the household income is below the VERY LOW INCOME threshold, as defined by the Federal Income Limits for the community Development Block Programs. 7. The death of the owner, provided that the surviving spouse is r..: other eligible for the benefits. b. The sale, transfer, or subdivision of the property or any part thereof. c.
