Dear Mr. & Mrs. Youngmark:
In early August you began working on a backyard playhouse. Our
building inspector alerted you that your building was being
constructed in violation of the required setbacks. Your building
project had just begun, you continued to complete the building
knowing of the improper placement.
On Friday, August 14, 1995, you and I discussed the fact that you
were constructing the playhouse too close to the property line and
within a drainage and utility easement. I explained alternatives.
You asked if you could complete the roofing paper shingling
project. I asked if the further completion would cause additional
problems with moving the building. You responded that there would
not be a problem and you would move the building. You then asked
for fence information and I prepared the information and dropped
it off on August 28, 1995. You immediately replied with a letter
stating that you would be moving the building.
All of this activity was in August. I have since driven by your
property (and stopped) to get updates from you on several
occasions. There has been no progress from what I can observe
from the public right-of-way.
Your building is in a grading and drainage easement and in this
location it can have detrimental impacts on both your property and
your neighbor's property. The City seek's to resolve matters such
as this in a friendly informative manner. If additional
information is necessary it is given. If additional time is needed
it is generally granted. You have been given both the proper
information and adequate time to resolve the matter.
It is for this reason that the City of Fridley has set October 31,
1995 as the reinspection date. Upon reinspection, if the building
has not been moved, a citation will be issued and the City will
seek a legal remedy to this matter.

Re: Construction Without Obtaining a Building Permit

Dear Mr. Youngmark:
According to Section 106.1 of the 1994 Uniform Building Code as
adopted by the City of Fridley, no building or structure regulated
by this Code shall be erected, constructed, enlarged, altered,
repaired, moved, improved, removed, converted, or demolished unless
a separate permit for each building or structure has first been
obtained from the Building Official.
You have been notified of your need to obtain a building permit and
have failed to comply as of today's date. As a result, a special
investigation fee will now be added to the permit, equal to the
permit fee. The City of Fridley will give you 30 days in which to
comply before turning this matter over to the City Attorney for his
legal consideration.
