REQUEST• ♦ To reduce the side yard setback for an accessory structure from five feet to three feet. ANALYSIS• ♦ Section 205.04.05.B.(2) requires that all accessory buildings and structures shall not be any closer than five feet to any lot line. Public purpose served by this requirement is to provide space between individual structures to reduce the possibility of fire, to provide access to the rear yard for emergencies, and to limit the condition of crowding in the residential neighborhood. The petitioners propose to construct a new 22 foot by 30 foot detached accessory structure. The new structure would replace an existing 16 foot by 22 foot structure. The proposed location of the structure requires a reduction in the side yard setback from five feet to three feet. Slightly less than six feet of open space will separate the dwelling from the new structure. The petitioners have the option of moving the garage entirely into the rear yard, which would allow them to maintain the three foot setback without a variance. The structure would need to be moved back approximately five feet. If the petitioners had an attached single car garage, Staff Report VAR #94-17, by Dean and Lynne Saba Page 2 they would be permitted to expand it to within three feet of the lot line per Section 205.05.B.2.a of the Zoning Code. The requested variance is within previously granted requests. APPEALS COMMISSION MEETING, AUGUST 23, 1994 PAGE 2 Ms. McPherson stated the variance request is for 6325 Van Buren Street. The property is zoned R-1, Single Family, as are the surrounding parcels. Also located on the subject parcel is a single family dwelling unit and a detached single car garage. The petitioners are proposing to construct a new garage measuring 22 feet X 30 feet in depth. The existing garage is approximately 16 feet x 22 feet deep. The proposed location of the structure is partially in the side yard hence the request to reduce the side yard setback for a detached accessory structure from 5 feet to 3 feet. Approximately 6 feet of open space would be left between the proposed accessory structure and the dwelling unit. The petitioners could move the garage to the east which would place it entirely in the rear yard. This would allow the petitioners to construct the proposed garage without a variance as the setback from the side lot line for a detached accessory structures located in the rear yard is 3 feet. However, this requested variance is within previously granted requests. Staff does not have a recommendation regarding this request. If the Commission chooses to approve the request, staff recommends the stipulation as follows: 1. The south wall shall be one-hour fire rated with no openings. Ms. Smith asked if the north wall also needed to be fire rated. Ms. McPherson stated it does not need to be fire rated. Mr. Kuechle asked, if the petitioners moved the garage back 5 feet, they would not need a variance. Ms. McPherson stated this was correct. Mr. Saba, 6325 Van Buren Street, stated they had considered moving the garage back, but they would rather move it as forward because of the length of the driveway. He does not want any more driveway than they have already. He likes the location of the garage and, with a 30 -foot garage, it leaves about as much yard as they like. They considered a 24 -foot wide garage but thought this would not leave enough space between the house and garage. That is why the size is 22 feet wide. They cannot get two cars in the current garage. Mr. Kuechlesked if they had considered moving the garage forward and attachin ktt to the house. Mr. Saba stated the kitchen is located on that side which faces south, and%the living room is on the other side. This location works out as more convenient all the way around. Dr. Vos stated they at one time had a procedure for residents going from a single garage to a double garage. Ms. McPherson stated the code section addresses attached single car garages. In this instance, it is a detached single car garage. Dr. Vos asked if a variance would be required if there were a breezeway. Dr. Vos asked if the second accessory structure would exceed the lot coverage requirements. Ms. McPherson stated no. MOTION by Ms. Smith, seconded by Dr. Vos, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON RUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:38 P.M. Ms. Smith stated the spirit of the code is being met. It does not disrupt any existing structures to the south. She would be inclined to.vote for approval. Dr. Vos agreed. If this were attached, the variance would not be necessary. Mr. Kuechle concurred. If attached, the structure would be okay at 3 feet. If set back 5 feet, it would okay at the same distance from the lot line. He would be inclined to recommend approval.
