Ordinance, for the following described property:
To reduce the front yard setback from 35 feet to 26 feet; to reduce the side
yard setback on a corner lot from 17.5 feet to 8.5 feet to allow the construction
of additional living and storage space on Lots 16 and 17, Block 3, Florence

IT IS ORDERED that a variance be granted as upon the following conditions or
reasons: 1. The addition to be structurally compatible with the existing

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.07.03.D,(1), requires a front yard depth of not.- . less -;than
35 feet.

Public purpose served by this requirement is to allow for off street
Parking without encroaching on the public right-of-way and also for
aesthetic consideration to reduce the building "line of sight"
encrnacbnent into the neighbor's front yard.
Section 205.07.03.D, (2), (c), (1), requires a side yard depth on the street
side of a corner lot of not less than 17.5 feet.
Public purpose served by this requirement is to maintain a higher degree
of traffic visibility and to reduce the "line of sight" encroacxment into
the neighbor's front yard.
B. STATS HAMM IP:
"The house is 768 sq. ft. with no basement, and no attic that is usable.
I need a little more living and storage space. I want to end up with a
dining area and also a large walk-in closet off the one bedroom. The
only way to accnnplish this is going out the front (west) of the house
about 6 feet. Going south will not work because the house will end up
very close to the street and it would involve extensive moving of
existing walls inside the house. Going north would only add on to the 2
bedroans, not what I want. Going east (out the back) would not work
because of the rear entrance to the house. Adding on this direction
v3ould mean the back entrance would came in to either the dining roam or a
bedroan - neither would be acceptable. Having to go out any 2 directions
(like north and east) would make it financially impossible.

C. ADKWISTRATIVE STAFF RE IM:
The petitioner, Ms. Shirley Switzer, is requesting two variances be approved
in order to construct an addition on her house located at 6405 Van Buren
Street N.E. These variances are:
1. To reduce the front yard setback frau 33 ft. to 26 ft.
2. To reduce the side yard setback from 17.5 ft. to 8.5 ft.
Ms. Switzer is proposing to add approximately 150 sq. ft. onto her house
which is currently 768 sq. ft. This addition would be used partially as
a dining room and walk-in closet. To establish a logical floor plan which
would meet the. petitioner's needs, the addition. can only be placed on the
west side (front) of the house. This establishes the need for the variance
requests.
Men analyzing this request, consideration should be given to. the following

If approved, staff recommends the following stipulation be attached to
the variance:
1. 1. Addition is structurally compatible with the existing
structure.
Mr. Clark stated that Ms. Switzer had submitted a letter at the meeting from
her neighbor to the north, Mr. Negri, at 6415 Van Buren.
MOTION by Dr. Vos, seconded by Mr. Ruechle, to receive into the record a
letter dated September 15, 1988, from James Negri at 6415 Van Buren Street N.E.
stating he has no objection to the variances requested by Ms. Switzer.

CARRIED UNANIMOUSLY.
Mr. me Clark stated this howas constructed back in the late 1940's/early 19501s.
It is slab house built on a corner lot. Mien it was originally built, it had
a driveway that went all the way to Mississippi St. There really was no building
code at the time this house was built, so the existing house ended up about 8.5
feet from 64th Avenue and 33 ft. back from Van Buren Street in the front.
Mr. Clark stated Ms. Switzer would like to add on to the house and as stated
in her hardship, she feels the only way she can economically add on to the house
is to the west. She is asking to go out 6 ft. which would reduce the existing
33 ft. front yard setback down to 26 ft.
Mr. Clark showed the Commissioners a copy of the floor plan which showed where
the addition will be located and how it related to the rest of the house.
The Commissioners should note that the addition will not cut down any more of
the site lines than what is existing because it is not going all the way to
the south end of the house.
Mr. Clark stated if the variances are approved, Ms. Switzer plans to retain
the services of a soils engineer to analyze the soil to make sure what kind
of footing system is needed under this addition. He stated he believed
Ms. Switzer did plan to have the addition match the existing facade of the house.
Mr. Clark stated the side yard setback is existing at 8.5 feet. It is only the.:
front yard that will be reduced by 6 feet.
Mr. Clark stated he will be looking at the soils engineer's recommendation,
and that will all be decided before the building permit is issued.

Dr. Vos stated the hardship was pretty well stated. There were really no other
options for expansion except to the west, and he had no objection to granting
the variances.
Mr..Sherek stated he had no abjection to approving the variances. The addition
would not look bad, and the hardship has been established.
Mr. Kuechle stated he was a little concerned about the site lines along the
front, but the hardship has been established, and he saw no ready alternative.
He also would be in favor of granting the variances.
Mr. Barna stated he thought the hardship had been established because of the
size of the house (below City's mininn n square footage for a house)and the
originality of the house, with no basement and only a small attic. He stated
additional living space is always necessary, and he would vote in favor of the

variances.

*elj1ug at 6405 Van Buren- Street in Fridley, Mu. The holes were dug to. depths of 4 and 7
feet below -existing ground.
The holes revealed a mediun dense, tan to red brown sand. These soil conditions are
adequste for foundation support.

The house and the soils below it were inspected by us on
September 27, 1988 and a report was issued, which indicated that
the foundation subsoil is adequate to carry structural loadings.
Furthermore it is basically a sandy material which has very
little susceptibility to frost heave.
For your house addition we recommend that the addition
should be on a thickened edge slab. This slab should not be
rigidly attached to the existing slab -on -grade.

For the wood frame construction above do not use rigid
connection of new wood framing to the framing of the original
house. Instead we recommend that at the connection you should use
slotted holes with lag bolts into the original members. This
would provide some latitude for a small amount of differential
settlement, if it were to occur.
At the roof line where the roof of the new addition matches
up with the existing house roof we recommend that wider sheet
metal flashings than usual should be used. The purpose of this
recommendation is again to allow for some small amount of
differential movement, without resulting in roof leakage.
We trust that this provides the additional information which
will help you in formulating your plans, and will address the
questions raised by the Fridley Building Inspector.

officially approved your request for a variance, VAR #88-23, to
reduce the front yard setback from 35 feet to 26 feet and to reduce
the side yard setback on a corner lot from 17.5 feet to 8.5 feet
to allow the construction of additional living and storage space
on Lots 16 and 17, Block 3, Florence Park Addition, the same being
6405 Van Buren Street N.E. with the following stipulations:
1. Addition to be structurally compatible with the existing
structure.
2. A soils engineer be consulted regarding the footing
system needed for the house.

UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON BARNA DECLARED THE PUBLIC
HEARING ClOsED AT 7:50 P.M.
Dr. Vos stated the hardship was Pretty well stated. There were really no other
options for expansion except to the west, and he had no objection to granting
the variances.
Mr. 5herek stated he had no objection to approving the variances. The addition
would not look bad, and the hardship has been established.
Mr. Kuechle stated he was a little concerned about the site lines along the
front, but the hardship has been established, and he saw no ready alternative.
He also would be in favor of granting the variances.
Mr. Barna stated he thought the hardship had been established because of the
size of the house (below City's minimum square footage for a house)and the
originality of the house, with no basement and only Wodosirall attin•favorHe sof�e
additional living space is always necessary,
and variances.
