I understand that the gunsmith and gun sale activity is a part-time occupation, and is not your principal means of income. It is also my understanding that you reside at the home addressed at 7395 Van Buren Street N.E. I have also learned that the Bureau of Alcohol, Tobacco, and Fire Arms has recently approved a license for you to sell fire arms on an annual basis. Further, it is my understanding that you have conducted gun sales since 1979 and inquired to the City if that was an acceptable home occupation. You explained to me that an order for a gun is placed with you, and you order the gun from another source. The gun is delivered via UPS to your residence, and then you arrange for the exchange of the gun with the new buyer. Section 205.03.34 of the Fridley City Code defines a home occupation. Part "C" of the definition states that "no over-the-counter retail sales are involved". Based on the information you have provided to me, you are not conducting "over-the-counter retail sales". You have advised me that you sell anywhere between 70 - 85 guns per year. You have also represented that orders for guns are not placed by people stopping at your home, reviewing a case or inventory of guns, and placing an order as in a retail business. For obvious reasons, the City would be concerned with a gun dealer that stocks an inventory of a significant amount of guns, and was advertising the sale of these guns from a residence. Based on the representations that you have made to me and as Dave Nelson March 5, 1996 Page 2 . outlined in the letter, and as. long as the gun sales are below 100 sales per year, the Community Development Department will advise the Bureau of Alcohol, Tobacco, and Fire Arms that the use is in compliance with the City's zoning ordinance. This determination is made solely on the issue of zoning compliance and does not in any way represent the City's official determination on the license as may be commented upon by our Police Department.
