Per Section 205.04.06.A.(3) of the Fridley Zoning Code, to increase the allowable
encroachment into the side yard of a comer lot from 3 feet to 5 feet 11 inches to
allow the construction of an open deck and steps on Lot 4, Block 3, Rice Creek
Terrace Plat 6, generally located at 6875 Washington Street.
MOTION by Ms. Beaulieu, seconded by Dr. Vos, to waive the reading of the public
hearing notice and to open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED
THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:32 P.M.
Mr. Bolin stated petitioner is requesting an increase in the allowable encroachment into
the side yard of a comer lot from 3 feet to 5 feet 11 inches to allow the construction of an
open deck and steps. The code requires a maximum encroachment of 3 feet into the
side yard setback on comer lots for the construction of open decks.

Mr. Bolin stated the property is located at the intersection of Washington Street and
Madison. The property is zoned R-1, Single Family, as are the surrounding properties.
Mr. Bolin stated no previous variances have been requested. The home was built in 1958
and an addition to the home was constructed in 1976.
Mr. Bolin provided a picture of the site. The proposed deck and steps would be located
behind an existing fence. The steps would be located at a point where there are three
large glass doors to the house.
Mr. Bolin stated the petitioners' hardship statement indicates the proposed deck and
steps are needed to provide direct access from the existing patio door to the existing
patio. If the steps went to the left from the deck (south), they would be partially blocked
by a basement window well and a gas meter. If the steps went to the right (north), they
would end close to another basement window well.
Mr. Bolin stated similar requests have been granted in the past. Because the request is
within previous granted variances, staff has no recommendation.
Mr. Bolin showed an aerial view of the property.
Commission members had no questions of staff.
Mr. Skjervold stated he had no additional comments.
Mr. Kuechle asked how far off the bottom of the door is the ground level.
Mr. Skjervold stated it is about 36 inches to the bottom of the door.
Dr. Vos asked if this would be different from what is existing.
Mr. Skjervold stated, no. The steps were put on this fall by a landscape contractor
working with his wife to put in a wildflower garden. Neither of them knew they needed a
variance. When they found out they needed one, they came in and applied. The deck
and steps are there now.
Ms. Beaulieu asked if there were any comments from the neighbors.
Mr. Skjervold stated they had no comments from their neighbors.
MOTION by Dr. Vos, seconded by Ms. Beaulieu, to close the public hearing.

Dr. Vos stated he believed this is existing. He asked if the building inspector had taken a
look at the construction.

Mr. Hickok stated he believed the building inspector came upon the construction as it was
happening, looked at it, and the structure looks to be adequate.
Dr. Vos stated he noted that the survey that was shown does not reflect the existing
building that is on the footprint. It also shows a single stall garage 43 feet from the house.
A three -stall garage currently exists near the house.
Mr. Hickok stated the survey shown is one that was in the address file from August, 1976.
They have built a three -stall garage since the site plan was prepared.
Ms. Beaulieu stated she had no problem with the request. It looks like the petitioner
needs to get to the patio. It sounds like he could not go either right or left without
interfering with the basement windows.
Ms. Mau agreed. She did not see that the petitioner had much of a choice.
MOTION by Ms. Beaulieu, seconded by Ms. Mau, to approve Variance Request, VAR

Mr. Kuechle asked for clarification of what triggers the requirements for a building permit.
Was it the fact that it was a step or was it the fact that it encroached?
Mr. Hickok stated it is a complicated series of things that causes the need for a building
permit. Something like this with a platform and railings would need inspection to see that
the railing is adequate and the footings are adequate. The safest thing to do is call the
building department. Some small projects may not need a building permit., If they do, the
fee is nominal, and it gives the owner the satisfaction of knowing the footings have been
done correctly, the required elements are in place, the railings meet the code
requirements, etc.
