On Monday, September 29, 2003, the Fridley City Council officially approved your request for a
Preliminary Plat, PS #03-05, to allow the exchange of property in order to correct an
encroachment on City owned land, legally described as Lot 13, Block 1, INNSBRUCK NORTH
2 N ADDITION, Anoka County, Minnesota, generally located at 1419 West Danube Road and
Farr Lake Park.
The Council action described above is only to approve the preliminary plat. You must have an
approved final plat prior to recording at Anoka County. When the final plat has been prepared
by your surveyor, a copy of the plat should be sent to the Anoka County's Surveyor's office for
review. Once that review is completed, please submit three full size copies of the. final plat to
the Community Development Department. The Community Development staff will contact you
as to which council meeting the item will be scheduled for consideration (it will be placed under
the "consent agenda"). After Council action on the final plat, the mylars of the plat must be
submitted to the City for signature by the Mayor and City Clerk. Once signed, the plat is ready
for recording at Anoka County. The final plat must be submitted for action within six months of
approval of the preliminary plat.

The City of Fridley contracted with the Registered Land Survey Company, Kurth Surveying, Inc.,
this past winter to conduct a boundary survey of Farr Lake Park. As a result of this investigation,
we found that you have constructed retaining walls, installed pool equipment and fencing outside
your property lines on City Park property. This is not in compliance with the approved layout for
your 1999 permit to construct this pool.
The construction on City property constitutes trespass. It is your responsibility as the property
owner to identify your property lines prior to a project. This letter is hereby notice to you to
remove these structures within 60 days to prevent further action against you by the City.

Thank you for meeting with me today. This letter serves to confirm our conversation. I am
requesting on the Kleins' behalf that the City hold any enforcement action against the Kleins in
abeyance while we are discussing the possibility of negotiating a civil resolution to the matter
identified in your April 28, 2003, letter. Further, we request the City give consideration to a
modest exchange of land. Klein propose to exchange the northeasterly triangle of their lot lying
north -of their north fence line for the land area they have inadvertently occupied with fence,
retaining walls and landscaping.
I understand your position that Mr. and Mrs. Klein must be willing to assume all the expenses for
accomplishing this work — namely, Klein would need to provide detailed survey work and
descriptions for the two areas that are proposed to be exchanged and provide the necessary deeds
to exchange these two parcels of land. If there are other expenses that you or City staff can
identify, I would appreciate receiving that information. Otherwise, please consider this letter as
the formal request from Mr. and Mrs. Klein to exchange these two areas of land.

This is a follow-up to my May 21, 2003, letter. I started to write a letter to Kurth Surveying, but
stopped when I recalled you indicated in our conversation that you might want to "square off'
one of the property lines.
Enclosed is an enlargement of the relevant portion of the survey that Kurth Surveying did for the
City. I have highlighted one of the enclosed copies to show the two areas proposed to be
exchanged. If you have a different concept for these land areas, I would appreciate receiving that
now. I will then take that information to Kurth Surveying and have them prepare a more detailed
drawing of these two areas for the benefit of the City. Thank you.

Please be advised I represent Brendan and Cheryl Klein, owners of the home at 1419 West
Danube Road N.E. in Fridley. The City of Fridley has approached my clients regarding the
apparent encroachments shown on that survey. After discussions with the City, the current
proposal we are working with is to exchange two areas of land between the City and Mr. and
Mrs. Klein.
Enclosed is a photocopy of a May 30, 2003, letter I received from Jon Haukaas at the City of
Fridley, together with a copy of his map. He has indicated. with red pen where he would like to
see the new property lines.
I have obtained the City's permission to use your firm's services to provide the detailed drawings
we need to accomplish this exchange of land. Please use Mr. Haukaas' drawing and prepare a
detailed drawing similar to his sketch and provide us with the metes and bounds descriptions that
would describe the two areas of land to be exchanged. Basically, the proposal is to exchange
Klein's "north triangle" lying just northerly of their fence line for the 4 -sided parcel that lies just
northwesterly of their pool. Please call if you need any further information.
