TO WHOM IT MAY CONCERN: OFFICIAL NOTICE CITY OF FRIDLEY PUBLIC HEARING BEFORE THE BOARD 'OF APPEALS NOTICE IS HEREBY GIVEN THAT the Board of Appeals of the City of Fridley will meet in the Council Chamber of the City Hall at 7:30 P.M. on Tuesday, July 24, 1973 to consider the following matter: A request for a variance of Section 45.053, 4A, Fridley City Code, to reduce the front yard setback from 35 feet to 24 feet to allow the construction of a dwelling to be located on Lot 12, Block 2, Innsbruck North 2nd Addition, the same being 5575 West Danube Road N.E., Fridley, Minnesota. The City Engineer .said he could recommend the variance he 12 feet, otherwise this would become too chase to the roadway. Mayor Li,ebl asked Mr. Sorenson if the variance being granted for 12 Poet would accomodate his needs. Mr. Sorenson said he could just get the driveway in with this amount of variance. OTION by`Councilman S�arwalt to grant the variance to Mr. Soren- °dn fdr 2 feet. Seconded b� Counctiman Nee. Upon a Y,oice vote, 11 vot g aye; Mayor tiebl declared the motion carried unanimous�ys W 0i owl_ I S iffim • I o._ FM- -nor -ZFEWAsh W �/I WREME nha1 -�11�s The City Engineer said the Board of Appeals had recommended the Council deny the request for the variance and the applicant had proceeded to construct toe dwelling according to the Fridley City Code and without the need for the variance, He said no action would be nocessary. REOUEST FOR AVAR:IANCB OF SECTION 45.0.53, 1B FRIDLEY CITY CODE, The City Engineer said the applicant had called him and requested the item be tabled until the next meeting of the Council when he could be in attendance. MOTION by Councilman Nee to concur with the Board of Appeals and deny the request for the variance of the Front yard setback by Mr. Fred S. Yesnes, Incorporated. Seconded by Councilman titter. Councilman Nee said all of the lots are substantially large and they had been picked up as tax1orfe1t lots. He said thW action if approved would set a pattern for the creation of 50 foot lota, where there have been none before. Councilman Nee continued by saying there is no hardship in the case, UPON A VOICE VOTE, all voting aye, Mayer Lieb1,d9cl4red the motion carried unanimously, REGULAR COUNCIL MEETING OF AUGUST 6, 1073 PAGE 27 Tho City Engineer said the request could be approved with the stipu- lation that the building be block and not metal, and this would make the construction more permanent, Mayor Liebl said this is the reason the request had come before the Council, first of all to make the operation a reasonable one, and secondly to require them to put up a decent building and to store the parts in the building. He said he would like the parts that are not needed to be hauled away. MOTION by Councilman Starwalt to table the request and consideration of construction of an office and warehouse by Central Auto Parts until the applicant is present, Seconded by Councilman Neo. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously, CONSIDERATION TO CONSTRUCT AN ADDITION TO THE PRESENT AUDITORIUMM, L MOTION by Councilman Starwalt to approve the request for the addi, tion to the present Gymnasium requested by School,Di.strict #14 to be located at 6000 West Moore Lake Drive. Seconded by Councilman Utter. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously. The City Engineer said there had been a request for the City to waive the permit fees and the Council could take action, to waive such fees, He said the State charge or the Electrical Inspection charge could not be waived, MOTION -by Councilman Starwalt to waive the inspection fees with the exception of the State or Electrical fees. Seconded by Council, man Nee, upon,a voice vote, all voting aye, Mayor Lieb! declared the motion carried unanimously. MOTION by Councilman Atter to receive the minutes of the Building Standards -Design Control Subcommittee meeting of July 26, 1973, Seconded by Councilman Nee.
