It is apparent that the ties to the service location are either inaccurate or insufficient. Your complaint also made no mention of the 2 X 2 marker posts required by the specifications, so we must presume they were either not in- place or never placed. Both of these problems stem from either inaccurate information provided by Dunkley Surfacing which was required by the Contract, or from work from which he was released by binding arbitration. At this point we can only sympothize with you and sug- gest you contact Dunkley. Meanwhile it is apparent from our accounts that you owe us$597.57 including accumulated interest. Perhaps you could check into this and see if the as -built plans were in error, of if the error was made in supplying the information. I rather doubt that our insurance company will cover this case, but we will have to know the details before we send the claim on to the insurance company for processing. For your information, the City cannot guarantee these locations since the as-builts were prepared by a consulting engineer for the City who themselves do not guarantee the locations. Therefore.it was up to -the contractor to make preliminary investigations to make sure he is aware of the utility locations. Additional information is that our P.W. Water Division did provide assistance in locating the various services. Location of the sewer and water hook-up was 25' to the.South of the location specified by the City of Fridley officials. Plus or minus 5' off specified location is acceptable, but 25' is very unreasonable. The $1,046.50 is an abnormal expense I will not incur. I therefore expect the City of Fridley to reimburse me for $1,046.50 as shown on the attached two pace bill. Clearing this matter up by April 15, 1978 can only be beneficial to both of us. In the Public Works review of the plans, sewer and water locations are noted on the certificate of survey. The certificate of survey also notes that the City of Fridley is not liable for the accuracy of the locations. (We have previously forwarded a copy of the building permit to you.) 2) The consulting engineering firm on the original utility project was: Suburban Engineering, Inc. 6875 Highway #65 NE Fridley, MN 55432 3) The contractor who constructed the project was: Dunkley Surfacing Co., Inc. 3737 East River Road Fridley, MN 55421 4) The City's part in the original utility project was owner, which means that the City retains the consulting engineer to actually put in the project for them. 5) The consulting engineer, in his professional judgment, is the party who determines the sewer and water service locations. 6) The consulting engineer, through their inspectors on the site, are responsible for determining that the sewer and water services are in Mr. R. Peterson -2- 5/.17/78 approximately the location as noted on the consultant's plans. It is the contractor's responsibility to place them in the location that was determined by the consultant. 7) It is the responsibility of the consultant engineering firm to approve and accept the final locations as installed by the contractor. 8) The contractor is responsible for preparing as -built drawings for the review and approval by the consultant. 9) As far as can be determined from the project files, there were no discrepancies noted pertaining to the sewer and water locations. Attached for your use is information pertaining to the original project, together with portions of the plans and specifications relating to the various responsibilities for utility project construction.
