WHEREAS, the Owner has requested that the City allow the placement of a 2 -foot retaining wall on the boulevard abutting the following described property: LOT 9, BLOCK 3, SHOREWOOD NOW THEREFORE, it is agreed as follows: 1. The City shall allow the Owner, at Owner's expense, to place a 2 -foot retaining wall across the boulevard of the above described property. 2. The Owner shall construct above said retaining wall and provide immediate and continued maintenance of the retaining wall, and property on either side of the wall, and shall eliminate thereon hazards to safety and conditions of disrepair and unsightliness and shall hold the City harmless of any liability of damages consequent upon, resulting from, growing out of, or in any manner connected with the construction or maintenance of the above mentioned retaining wall. 3.
