Ms. Bulthuis stated that the petitioner is seeking to reduce the side yard setback from five feet to three feet to replace the single car garage (already removed from the site) with a two car garage. The petitioner's summary of hardship is as follows: "Our house is a walk out rambler style with a severe slope in the back leading to Moore Lake. Because of the severe slope, it is impossible to build a double garage in the back yard. Because of the way the house is situated on the lot and the steep slope in the back of the house, we have no other way to build a double car garage other than the way it is being proposed." APPEALS COMMISSION MEETING, AUGUST 22, 2001 PAGE 2 •� Ms. Bulthuis stated that the property is zoned R-1, as are all surrounding properties. The existing home was built prior to 1949, and a single stall garage that was constructed in 1955 was built over the side yard lot line by .67 feet. As a result, expanding the garage was not an option for the petitioners. The side yard lot line would need to be reduced in order to build an 18 foot by 29 foot two car attached garage that would extend four feet in front of the home. Staff has no recommendation as similar variances have been granted in the past. Variance, VAR #00-02, was granted at 1363 53`d Avenue to reduce the side yard setback to 2 feet 6 inches, for an accessory structure. Variance #99-17 at 7395 Van Buren Street was granted to reduce the side yard setback to 3 feet for an accessory structure. Ms. Jackson asked what the building permit covers exactly at the site. Ms. Bulthuis stated that it covers the addition to the back of the home including the garage. Mr. Kuechle asked what the possibility of reducing the side yard setback. from_. less. than five feet would be in the zoning code in the future. Ms. Bulthuis stated that staff and the Commissions are not looking at that right now, but might in the future with more direction from the City Council. The petitioners, Dennis and Carolyn Nolan, stated that the permit includes the garage. Ms. Nolan stated that the reason they wanted the attached two car garage and addition the way it is proposed is because there are no other options. The neighbors are very supportive and this would enhance the neighborhood. Ms. Jackson asked if there would be windows on the addition that would face the neighbors to the side. Ms. Nolan stated that there would not be. Mr. Nolan stated that the garage would have matching siding and the roof line would simply be extended. It is hard with a single car garage in the winter with a manual garage door. They both have disabilities. He had a fall in September breaking a hip, and Ms. Nolan has arthritis. Ms. Cathy Lawler, 5724 W. Moore Lake, stated that with the Nolan's medical problems, it is necessary for them to do this. Shoveling and chipping ice is not safe for them. MOTION by Mr. Jones, seconded by Ms. Jackson, to receive the two letters in support of this proposal from Tim and Mary Zeigler and Don and Ramona Zeigler. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRERSON KUECHLE DECLARED THE MOTION CARRIED UNANIMOUSLY. MOTION by Ms. Jackson, seconded by Ms. Jackson, to close the public hearing. It is reasonable and they are going with the bare minimum footage for a two car garage at 18 feet wide. He would recommend approval. The petitioner shall obtain all necessary building permits prior to construction. 2. The garage shall be architecturally compatible with existing home and finished with same siding and color scheme. 3. The existing home was built prior to 1949 and a single stall garage was constructed in 1955. The single car garage was built over the side yard lot line by 0.67 feet as a result expanding the garage was not an option for the petitioners. In order to build an 18 ft. by 29 ft. two car attached garage the side yard lot line would need to be reduced. The proposed garage will extend 4 ft. in front of the home. Existing home Due to the slope in the rear yard of the property, the petitioners are asking to construct an attached garage along the south side the house. As stated above the single car garage has already been removed from the property. Along with the proposed garage addition a 12 ft. by 25 ft. living addition is being constructed off the back of the house, which meets all setback requirements. City staff has received no comments from neighboring property owners. Location of the Proposed Garage RECOMMENDATIONS City Staff has no recommendation, as similar variances have been granted in the past. Garage shall not be used for home occupation or living area. HARDSHIP STATEMENT Our house at 5733 West Moore Lake Drive was built in the 1950's and a single car garage built a few years after that. This was back in the time when most women did not work outside of the home and there was no need for more than one family car. How times have changed since then Our single car garage sat on the property line, and in the almost twenty-five years that we have lived in this house, we have wanted a double car garage. Our house is a walk -out rambler style with a severe slope in the back leading to Moore Lake. Because of the severe slope, it is impossible to build a double garage in the back yard_ Because of the way the house is situated on the lot and the steep slope in the back of the house, we have no other way to build a double car garage other than the way it is being proposed We have always wanted to change the garage and build one that was more usable for our needs. We both work outside of the home and also have handicaps that having a single car garage makes worse. Last fall my husband fell and broke his hip. I have severe arthritis and fibromyalgia and need to use a cane. It is downright dangerous for either of us to park our cars outside during the winter. With Dennis falling last year on the ice and having osteoporosis and blood clot problems, the prospect of another winter like last year is very scary. We chose to stay here in Fridley rather than move. Out son will be a sophomore in Fridley High School. Our daughter and her husband live less than one mile away. We are active members of our community. Rather than move, we chose to spend more than $75,000 to make improvements on our home. It may have been cheaper and less stressful to move. I hope we have made the right decision Our neighbors are pleased to see us making these changes as it will only add to the value of the home and the neighborhood. This entire project started with wanting to change the outdated single car garage to an attached double car garage. As mentioned before, because of the slope of the lot and the way the house is situated on the lot, the only way to have a standard 18 foot double car garage is to go back only 3 feet from the property line. This still allows for plenty of room between our garage and the neighbor's house. K however, the City of Fridley insists that we must be 5 feet from the property line, there is no way to even have a double car garage at all. It defeats the whole point of this project and we are back to where we started. Only now, the original garage has been torn down, our entire yard is tom up, the deck is removed, and we out $75,000 toward this project! Originally we asked if we could add on to the existing garage. We were told "no" because it was on the property line. It had to be torn down, and the land surveyed at an additional expense to us. Having done all of this, and now having the cost of the garage project alone double from $15,000 to $33,000, is the City of Fridley going to deny us this home improvement? I hope not! We chose to stay here rather than move. This was back in the time when most women did not work outside of the home and there was no need for more than one facer car. How times have changed since them Our single car garage sat on the property line, and in the almost twenty-five years that we have lived m this house, we have wanted a double car garage. Our house is a walk -out rambler style with a severe slope in the back leading to Moore Lake. Because of the severe slope, it is impossible to build a double garage in the back yard. Because of the way the house is situated on the lot and the steep slope in the back of the house, we have no other way to build a double car garage other than the way it is being proposed. We have always wanted to change the garage and build one that was more usable for our needs. We both work outside of the home and also have handicaps that having a single car garage makes worse. Last fall my husband fell and broke his hip. I have severe arthritis and fibromyalgia and need to use a cane. It is downright dangerous for either of us to park our cars outside during the winter. With Dennis f to la�ng last year on the ice and having osteoporosis and blood clot problems, the prospect of another winter like last year is very scary. We chose to stay here in Fridley rather than move. Out son will be a sophomore in Fridley High School. Our daughter and her husband live less than one mile away. We are active members of our community. Rather than move, we chose to spend more than $75,000 to make improvements on our home. It may have been cheaper and less stressful to move. I hope we have made the right decision. Our neighbors are pleased to we us making these changes as it will only add to the value of the home and the neighborhood This entire project started with wanting to change the outdated single car garage to an attached double car garage. As mentioned before, becau of the f the lot and the way the house is situated on the lot, the only way to have aAe o e gage is to go back only 3 feet from the property line. This still allows for plenty of room between our garage and the neighbor's house. If the City of Fridley insists that we must be 5 feet from the property line, there is no way to even have a double car garage at all. It defeats the whole point of this project and we are back to where we started Only now, the original garage has been tom down, our entire yard is torn up, the deck is removed, and we out $75,000 toward this project. Originally we asked if we could add on to the existing garage. We were told "no" because it was on the property line. It had to be torn down, and the land surveyed at an. additional expense to us. Having done all of this, and now having the cost of the garage project alone double from $15,000 to $33,000, is the City of Fridley going to deny us this home improvement?
