NOTICE OF PUBLIC HEARING
Notice is hereby given that the, -Appeals Commission of the City of Fridley
will conduct a Public Hearing in the City Council Chambers at 6431 University
Avenue Northeast at 7:30 p.m. on Tuesday, May 11 , 1982 in regard to the
following matter:
Consideration of a variance request,
pursuant to Chapter 205 of the Fridley
City Code, to reduce the side yard setback
on a corner lot from the required 17.5 feet
to 14 feet, to allow the construction of a
16 by 18 foot addition to the rear of the
dwelling, located on Lot 1 Block 5, Donnay's
Lakeview Manor, the same being 5744 West
Moore Lake Drive, Fridley.
Notice is hereby given that all persons having an interest therein will be
given the opportunity to be heard at the above time and place.

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.053, 4B, #5a, requires the side yard width on a street side
of a corner lot to be not less than 17.5 feet.
Public purpose served by this requirement is to maintain a higher degree
of traffic visibility and to reduce the "line of sight" encroachment into
the neighbor's front yard.
B. STATED HARDSHIP:
"The room we would like to add is a combination dining and sitting room,
as well as an extension of the kitchen. Without a variance, any kitchen
expansion is no longer feasible. To move the room further from the
street is not possible as a bedroom window is immediately adjacent to the
proposed addition and we would lose legal means of egress in case of fire."
C. ADMINISTRATIVE STAFF REVIEW:
The lot is on the southwest corner of West Moore Lake Drive and 58th Avenue
with the frontage on West Moore Lake Drive. The side of the existing
house (along 58th Avenue) is 14 feet from the side property line. The
proposed addition will extend the side of the house 18 feet toward the
rear lot line but will not come any closer to the side lot line than the
existing dwelling.
The dwelling on the adjacent lot to the rear of this. lot faces Jackson
Street so there would be no encroachment into the neighbor's front yard
if the variance for the addition was approved.
