A final inspection was conducted on December 28, 1987 of the above address
and the following items were noted which must be completed before the
structure can be finaled:
1. Provide sod in the front and side yards by June 1, 1988.
2. Secure the sump basket cover by January 15, 1988.
3. Clean up all construction debris from site by January 15, 1988.

Dear Clerk:
Please be advised that I have been retained to represent the in-
terests of Mr. and Mrs. Todd Bjerknes relative to problems they
have been having with a new home at 1444 Windemere Dr., Fridley,
MN.
The contractor who they dealt with, and who built the house, was
Mr. Jerry Tollefson, of Brandon Construction, Inc., 311 Sunrise
Lane, Champlin, MN. The permit for said construction was issued
October 2, 1987, as Permit No. 19224.
They closed on the property and moved into the house on December
28, 1987. There were a number of items yet to be completed, in-
cluding the final grading. On a number of occasions, the
Bjerknes's experienced water coming into their basement from out-
side. They were advised that the problem would be resolved when
the final yard grading could be done in the spring.
On or about May 8, 1988, when the Bjerknes's again experienced
water seeping into the basement, they called Mr. Tollefson. When
Mr. Tollefson came over and viewed the situation, he advised the
Bjerknes's that the house was built too low, that the family room
should have been ground level, and not excavated.
Although grading has been done, as of this date the Bjerknes's
are still experiencing problems with water coming into the base-
ment, and there are questions as to who may be responsible/liable
to them for damages arising out of this matter. Although we have
not yet ascertained that litigation will be necessary, there is a

possibility that the City of Fridley will be made a party defen-
dant to any litigation which might arise out of this matter, as
the plans were approved, the building permit issued, and ongoing
inspections made by Mr. Darrel Clark, the Fridley building in-
spector.
This letter is intended to meet any formal Notice of Claim re-
quirements under the Tort Liability Act, or as may be applicable
in this situation.

Dear Clerk:
Please be advised that I have been retained to represent the in-
terests of Mr. and Mrs. Todd Bjerknes relative to problems they
have been having with a new home at 1444 Windemere Dr., Fridley,
MN.
The contractor who they dealt with, and who built the house, was
Mr. Jerry Tollefson, of Brandon Construction, Inc., 311 Sunrise
Lane, Champlin, MN. The permit for said construction was issued
October 2, 1987, as Permit No. 19224.
They closed on the property and moved into the house on December
28, 1987. There were a number of items yet to be completed, in-
cluding the final grading. On a number of occasions, the
Bjerknes's experienced water coming into their basement from out-
side. They were advised that the problem would be resolved when
the final yard grading could be done in the spring.
On or about May 8, 1988, when the Bjerknes's again experienced
water seeping into the basement, they called Mr. Tollefson. When
Mr. Tollefson came over and viewed the situation, he advised the
Bjerknes's that the house was built too low, that the family room
should have been ground level, and not excavated.
Although grading has been done, as of this date the Bjerknes's
are still experiencing problems with water coming into the base-
ment, and there are questions as to who may be responsible/liable
to them for damages arising out of this matter. Although we have
not yet ascertained that litigation will be necessary, there is a

possibility that the City of Fridley will be made a party defen-
dant to any litigation which might arise out of this matter, as
the plans were approved, the building permit issued, and ongoing
inspections made by Mr. Darrel Clark, the Fridley building in-
spector.
This letter is intended to meet any formal Notice of Claim re-
quirements under the Tort Liability Act, or as may be applicable
in this situation.
