11th day of October, 2000, on a petition for a variance pursuant to the City of Fridley's Zoning Ordinance, for
the following described property:
To reduce the front yard setback from 35 feet to 33.62 feet to recognize
an existing nonconformity on Lot 8, Block 3, Innsbruck 5h Addition,
generally located at 1508 Windemere Drive N.E.

Per Section 205.07.04.d.(1) of the Fridley Zoning Code, to reduce the front yard
setback from 35 feet to 33.62 feet to recognize an existing non conformity on Lot
8, block 3, Innsbruck 5t' Addition, generally located at 1508 Windemere Drive.
MOTION by Mr. Jones, seconded by Ms. Jackson, to waive the reading and open the
public hearing.

THE MOTION CARRIED AND THE PUBLIC HEARING OPENED AT 7:43 P.M.
Mr. Bolin stated that this petitioner is looking at expanding his home, so this non-
conformity needs to be recognized. The lot was platted in 1965, and the garage and
home were built in 1968. The property is zoned R-1, single family, as are all the
surrounding properties. The petitioner's hardship states: "1508 Windemere Drive was
built in 1968 and the garage was placed 1.3 feet too close to the street."
Mr. Bolin stated that it is hard to tell that the garage is nonconforming. Staff has no
recommendation as similar variances have been granted in the past. The front yard
was reduced to 31 feet at 369 Hugo Street (VAR #00-23), and to 32 feet at 191
Hartman Circle (VAR #00-18).
Mr. Kuechle asked how this discovery was made.
Mr. L'Heureux stated that he found this out in the process of trying to find out how much
room he had in the side lot to build a third garage stall.
Mr. Kuechle asked if there was enough space to add a third stall.
Mr. L'Heureux stated that they have ten feet exactly, which is enough.
Ms. Jackson asked if the third stall would be parallel with the other two.
Mr. L'Heureux stated that they were going to set the third stall back two feet so it would
be in the original requirements. The front of the new stall would be set back probably
37 feet. The builder does not have the plans laid out yet.
Mr. Kuechle asked Mr. Bolin about any response from the neighbors.
Mr. Bolin stated that he had a few inquiries as to what would be going on, but no
objections.

Mr. Jones stated that he does not see the real issue about the layout with the street and
the neighborhood, it looks fine. It is a hardship having the nonconforming house. They
have already looked into it and do not see a need to require a variance for their addition.
He would have to vote in favor of this.
Ms. Jackson stated that she does not think they should stop their improvements for
decisions made 32 years ago.
MOTION by Ms. Jackson, seconded by Mr. Jones, to approve Variance Request, VAR
#00-27 with two stipulations:
1. The petitioner shall obtain all necessary building permits prior to construction
of any addition.
2. Any addition shall be architecturally compatible to the existing home.

On October 11, 2000, the Fridley Appeals Commission officially approved a request for a
variance, VAR #00-27, to reduce the front yard setback from 35 feet to 33.62 feet to recognize an
existing nonconformity on Lot 8, Block 3, Innsbruck 50' Addition, generally located at 1508
Windemere Drive, with the following stipulations:
1. The petitioner shall obtain all necessary building permits prior to construction of any
additions.
2. Any addition shall be architecturally compatible with the existing home.
You have one year from the date of the Appeals Commission action to initiate construction. If
you cannot begin construction during this time, you must submit a letter requesting an
extension at least three weeks prior to the expiration date.

REQUEST
Petitioner is seeking to reduce the required front yard setback from 35' to 33.6' to recognize an
existing non -conformity. The existing home and garage were built in 1968. A corner of the
existing garage is only 33.6' from the front property line. The recognition of this non -conformity
is required prior to the issuance of any building permits to expand the home.

ANALYSIS
The property is located on Windemere. The lot is rectangularly shaped, with the home being

1968. Petitioner is seeking variance to recognize this non -conformity. City staff has received no
comments from neighboring property owners.
RECONUKENDATIONS
