On Fab 15, 1978, an underground water pipe was frozen. City of Fridley was
unthawing with electric welder, therewas an electrical feed -back to plaintiff's
house which caused a volgage problem that burned out several appliances.

we would so advise the insurance company;"(2) Is there any way to avoid such
a claim in the future?

9/18/78 - Please be advised contact was made with Mr. Warren Birgel at NSP regarding the
referenced matter. Due to the fact that the majority of all electrical systems in
residential or-commercial/industrial structures are grounded to the water system, this
leads to a potential for changing the nature of the ground to reverse the current and allow
the current to proceed into a structure rather than out from a structure.
With the setting up of a power source, such as a welder, for the pruposes of thawing a
frozen water service, it is the nature of electrical current to proceed like water along
.the path of least resistance. If, in fact, a particular route for the current would be
easier going outside of the circuit set up in an attempt to thaw the water service, the
possibility exists for this current to stray toward that path of least resistance.
Though this happens very rarely, care must be taken to.ensure proper amounts of voltage
is being provided through the circuit. Voltage in excess of that actually required to
thaw the service could result in stray currents.
In order to provide proper protection it may be desirable to not only remove the water
meter from the house having'the frozen service, but any others that may be close enough
to receive stray current. This information will be passed on to the welding companies,
though this procedure has been followed in the past.
I checked with Minneapolis and St. Paul, and have come to the conclusion that thawing a
-service through use of an external power source, such as A welder, is the only way the
service can practicably be thawed, therefore, what must be done is to ensure proper pro-
cedures are followed to eliminate any damage to people not involved in the thawing operation.
In particular, emphasize to the contractor the proper amount of voltage and removal of the
water meters to eliminate damage through stray currents.

SUBJECT: McCULLOCH CLAIM
The Water Section personnel tried thawing out the waterline at
1510 Berne Road with hot water; and tried to force a plastic
tube down the copper line. We were only able to get.the tube
out near the curb stop. We could not get it past this point.
The men tried several times, with no luck. We then called a
welder to come out and thaw the line. When he arrived on the
job, there.were no Water Section men around; so he called the
weekend duty man, who explained to him where the standpipe was
and where we thought the line was frozen. The welder then
hooked up his machine from the standpipe to a gate valve on
the watermain. Ihis gate valve was in front of 1R
home at 1511tWindemere Drive.
The Water Section personnel had the water meter out of the
line at 1510 Berne Road, and the electrical ground wire was
also disconnected.
At the time of the electrical problem at Mr. McCulloch's home,
there were no Water Section people at the scene. The Water
Section does not advise the contractor thawing out the line
what amps to use. This is left up to the man running the wel-
der, and not up to the Water personnel.
In the twenty-one years I have been with the Fridley Water Sec-
tion, we have only had two other fires start in homes while
thawing out water lines. I believe the A.W.W.A. is trying to
get laws passed that will prohibit the electric companies from
using water lines for ground. This is not only dangerous for
starting fires in.homes when thawing out water lines; but it
is also dangerous to Water Section personnel possibly getting
electrical shocks that might endanger their health.

RE: Incident at 1510 Berne Road
FACTS: 1. Standpipe was approximately 75 feet from water
meter at 1510 Berne Road. The standpipe was found
by the Water Department and a key was left on it
for the welder to make his connection.
2. The ground wire and meter at 1510 Berne Road were
disconnected by the Water Department before we
left the premises.
3. The Water Department found the gate valve at
Windemere and Berne Road for the welder to make
his other connection. The gate valve was approx-
imately 70 feet from 1510 Berne Road water serv-
ice.
4. At approximately 7:00 p.m. on the night of February
15, 1978, we received a call from the welder asking
if the gate valve cover had an interlocking cover.
It didn't and so the welder hooked on to the. gate
valve and the standpipe at 1510 Berne Road.
S. At approximately 8:30 p.m. that evening, another
call was received stating that the frozen water
line was unthawed.
6. At 9:00 p.m. still another call was received from
the welder stating that the house at 1516 Windemere
had some electrical difficulties such as a blown
out television set, microwave oven and some other
small electric motors. The electrician that the
complainant called stated that the 200 AMP service,
conduit to the house was warm on his arrival,
which had been approximately at 8:50 p.m. and that
he thought the welder had something to do with it.
We were also told NSP would be at the complainant's
house.

Mr. Alschuler explained, if the City would go on an advanced request system,
which requires people to pre -plan their trips, it would not generate the same
user charges or demand levels. He explained the greater the demand, the more
efficient the system becomes..
Councilman Fitzpatrick stated, it seems. to him, that the shared -ride taxi has
two advantages. One, it might truly be a demonstration of the need; and
another, if at the end of the year, they should discontinue it, it would have
a different effect from discontinuing a bus line. He stated, however, if it
is. successful and the City wishes to continue the service, they are ultimately
faced with the decision of how it would be subsidized.
Mr. Boardman stated, if the Council proceeds with a paratransit system, they
will have to undertake a marketing campaign to get people to use the system.
Councilman Schneider questioned the impact on staff, if Council proceeded with
a paratransit system.
Mr. Qureshi, City Manager, stated the Council is well aware of the strain on
the financial resources over the last few years and this would be another step
in that direction. He pointed out, if it is not successful, ,you may have
citizens saying money was wasted. If it is successful, however, the question
is if the Council wants this to be one of the high priority items for funding.
He stated it would have to be reviewed on an overall prospective, as the City
is entering into a number of programs. Mr. Qureshi pointed out you are talking
more than $11,000 - $12,000 the first year since 90% would be financed by the
State.
Councilman Schneider stated, if the figures were correct, the net cost of the
system is more in the order of $100,000.
Mr. Qureshi stated another question is, if the system is successful, will the
State continue to fund at this level.
Mayor Nee felt the Highway Department is not going to return the $100,000 for
[ the system to the people, if it is not used in Fridley. He stated the rate
{ structure they are talking about is almost self-supporting. He felt, if it
[ can be demonstrated that this is feasible, the City could abandon it to a
totally private operation, once the market is developed. He stated he does,
however, havesome reservations on whether the system would work, but he didn't
think, with this plan, the City was looking at a long-term subsidy, but to show to
a private contractor that this is a viable system.
Mr. Qureshi, City Manager, pointed out the success ratio for these type of.
projects was not good and the question is if the Council can look to experimenting
and failing.
Councilman Hamernik stated he is looking at the total tax dollar, whether or
not it is city or state monies, and capitalization is a significant part of the
cost and that he had reservations with the system proposed.
MOTION by Councilman Hamernik to table this item to the Council meeting on
September 25, 1978. Seconded by Councilman Barnette. Upon a voice vote, all
voting aye, Mayor Nee declared the motion carried unanimously.

Mayor Nee reconvened the meeting at 9:37 p.m. All Council members were present.

Mayor Nee stated he received a phone call from Mr. McCulloch regarding this
claim and requested it be placed on the Council's agenda for consideration.

Mr. Boardman, City Planner, stated the Fridley Bus Company has shown an interest,
but he didn't know if the taxi companies were interested.
Mr. Alschuler stated he had contact with Columbia Height Taxi, Fridley Bus
Company and Spring Lake Park Bus Company, and the bus c mpanies seem to be more
interested.
Mayor Nee questioned the basis for their figures rega ding daily demand.
Mr. Alschuler stated this information was derived f m similar type systems
operating in Iowa and Connecticut:
Mayor Nee questioned how many trips the cab compa now makes in Fridley.
Mr. Alschuler stated they were unable to get thi information, however, their
impression was, at this time, the greatest majo ity of their service was service
to and from the airport.
Mayor Nee questioned what the City of Columbi Heights had approved.
Mr. Alschuler stated they have approved a sh red -ride taxi system with a heavily
subsidized fare.
Mr. Boardman stated he doesn't see the dem d, based on the economics in the
metropolitan area. He didn't feel the Ci would have that much of a ride demand
for the cost. Mr. Boardman didn't feel y u could compare Fridley with a town
in Connecticut and didn't think it would rovide the service the City wishes to
provide.
Councilman Hamernik questioned what was/happening with the Golden Valley proposal.
Mr. Bob Howdek of the Minnesota Departoent of Transportation stated they are
not going to accept Golden Valley's pr posal as there will be similar projects
in the area by the Metropolitan Tr S'
Commission. He stated the proposal for
Golden Valley was for one vehicle for the community and for their size, it is
not realistic. He stated, if Goldenalley chose to amend their proposal, the
Department of Transportation would g ve it consideration.
Councilman Hamernik asked what washe tie-in with the Metropolitan Transit
Commission in the Golden Valley and White Bear Lake operations.
Mr. Howdek stated the MTC is opera ing the White Bear project and proposing to
operate the Golden Valley project. He stated the contract is with the Metropolitan
Transit Commission.
Councilman Barnette pointed out at once the program gets started, the City
will ultimately have to subsidiz it. He stated most of the comments he received
were against any paratransit sys em that would cost the taxpayers money. He
j felt the question was if the peo le of Fridley really want to subsidize a
paratransit system.
Councilman Hamernik stated he i not convinced the citizens of Fridley are
ready to subsidize a transit sytem.
Mr. Alschuler explained the pa.atransit system would be a demonstration process
and the City would't have to p rticipate, after the first year, if they found it
wasn't working.
Councilman Schneider stated h was reasonably pleased with the shared -ride
taxi figures. He stated his oncern is if it would really be used to the
extent estimated. He felt, i 150 passengers are using this service daily,
with 30 of them being elderly or handicapped, it probably does serve some
public good. He stated he w s concerned that the system might have only two
or three people using it dai y.
Mr. Howdek stated a lot woul depepd on how this is set up with the contractor.
He explained you don't have ixed routes, therefore, if the demand isn't there,
you don't have the vehicles ut. He stated,•if there is a demand for this
system, it invariably doesn' change from day to day and after a certain
' amount of time, the operato can plan his schedule.

Mr. Sobiech, Public Works Director, stated the City had a frozen service at
1510 Berne Road and they proceeded to call in a company to thaw out the service.
He stated the company went through the procedure to find the pipe to thaw out
the service and for some unknown reason, the current, in this particular Case,
proceeded into Mr. McCulloch's house and damaged some of his appliances.
Mr. Sobiech stated some precautions are taken with the house so to prevent a
current from entering the house where the problem is, however, in this case,
the current went elsewhere. He stated it is his understanding that this is
the second time in three years this has happened in the City.

Mayor Nee questioned if the welder attached at the points where he was told.
Mr. Sobiech stated he was told to come out and thaw out the service. He
stated it is hard to say exactly what took place among the crew members.
Mayor Nee asked if there was any evidence that the sub -contractor was negligent.
Mr. Sobiech stated, as far as the City knows, he followed proper procedure,
but they don't know why the current when into Mr. MrCulloch's home.
Mr. Herrick, City Attorney, stated if the City was negligent, the insurance
company should pay the claim, however if they weren't negligent, Mr. McCulloch
would have no claim against the City. He stated it may be that the individual
i who did the work did not do it properly or there may have been something faulty
on the plumbing or electrical work in Mr. McCulloch's home.
Mr. Herrick felt an attempt should be made by the staff to determine just what
did happen.

Councilman Schneider stated if the City doesn't get an explanation, the fact
remains that Mr. McCulloch is still out the cost for repairing his appliances.
He stated it appears less than a reasonable doubt, the City or sub -contractor
contributed to Mr. McCulloch's problem.
MOTION by Councilman Schneider to pay the claim in the amount of $507.31,
as filed by Mr. McCulloch, from the Utilities Fund. MOTION FAILED FOR LACK
OF A SECOND.
Mr. Qureshi, City Manager, stated the staff would check into this to try and
determine just what had happened.
Councilman Schneider felt staff should keep track of the costs involved for
investigating this matter.
CONSIDERATION OF REAPPROVAL OF MUNN'S HILLCREST ADDITION (P S. #78-05):
Mr. Sobiech, Public Works Director, stated the plat for Munn's Hillcrest
Addition was approved on July 17, 1978, with some stipulations and one was
that an agreement must be made with Burlington Northern Railroad to reconstruct
the ditch to insure a positive drainage outlet.
Mr. Sobiech stated Burlington Northern would not agree to this stipulation,
but did indicate an alternative would be to construct a pipe within their
right-of-way.
Mr. Sobiech stated Mr. Herrick, City Attorney, has forwarded correspondence to
Mr. Forbes, Attorney for Burlington Northern, to review this matter as there
is a question if the City has the right to use the drainage ditch as it exists.
He stated staff is awaiting a determination from Mr. Forbes if they concur
with the original recommendation or whether they would agree to some
maintenance or construction agreement.
Mr. Sobiech stated, if there is no reapproval of the plat, the petitioners
would like to proceed with just developing the five lots that were included
in the plat.
He stated the staff now has a hold on building on the five lots and a hold on
the plat waiting for word from Burlington Northern regarding the drainage ditch.

.Mr. Sobiech stated he would recommend they not proceed with the plat until all
avenues have been exhausted regarding the drainage ditch.
Mayor Nee asked if the area would drain without the ditch improvement.
Mr. Sobiech stated if there isn't a positive outfall, the result will be a
storage basin that would be marginal. He stated, at present, in order for
this area to overflow in the ditch, the water has to rise a considerable amount.
Mr. Herrick felt the position Burlington Northern has taken is unreasonable.
He felt if they could discuss it, the City should be able to convince them
they have some obligation and are not incurring a risk in allowing reconstruction
of the ditch.
He stated he was not able to get in touch with Mr. Forbes, as he was out of
town, but hoped the matter could be resolved when the information sent was
discussed with Burlington Northern representatives.
Mr. David Libra, attorney representing the petitioners, pointed out that the
problem regarding use of the drainage ditch involves further delay. He stated
the petitioners have contacted Burlington Northern directly and attempted to
obtain their approval and offered to pay for the complete reconstruction of the
ditch.
Mr. Libra stated Burlington Northern's Head Engineer has declined and raised the
possibility regarding their legal liability and also discussed the possible
expansion of their tracks. He stated, at this point, it looks like their decision
is irrevocable, at least for purposes of this development..
Mr. Libra stated they are proposing to lift the temporary hold on issuance of
building permits for development of the five existing lots. He stated this
would not involve any subdivision and would not affect the existing drainage
in the area. He stated, if Council feels development of the street is necessary, p
the right-of-way exists and Council could order that improvement following normal a
procedures.
Mr. Libra stated, at this time, it becomes a question of economic feasibility
{ and, therefore, requested the hold on the building permits for the five lots
be lifted and the property developed in accordance with the original plat for
the property.
Mr. Libra stated the point Burlington Northern made regarding the alternative
to construct a pipe within their right-of-way would involve nine lots and it
would be impossible to economically spread the cost of the pipeline on the
proposed lots.
Mr. Herrick asked if a delay of two weeks to attempt to work this out with
Burlington Northern's Legal Department would seriously affect the development.
Mr. Libra stated contractors, who have agreed to construct this development,
are holding time open for this project. He stated he would propose approval
of the five lots, subject to solving the problem of the ditch, at which time,
reapproval of the plat would be considered again.
Councilman Fitzpatrick stated his chief concern in the development of this
land is that they don't have direct access onto East River Road. He felt
whatever development is there, some portion of Hillcrest should be constructed
as part of the plat and traffic routed to the signalized intersection.
Mr. Libra stated there shouldn't be any linkage between the issuance of the
{ building permits and improvement of Hillcrest.
l! Mr. Qureshi, City Manager, stated, he felt, if building permits are issued,
there is some obligation for a solution to the drainage problem.
Mayor Nee asked if approval was not received from Burlington Northern, if it
would be staff's recommendation to proceed with the five lots.
Mr. Sobiech stated he believed the property could be developed by putting in
' the pipe. He felt this would cost from $18,000 - $20,000 and, therefore, raise
the cost about $2,000 more per lot.

Dear Mr. McCulloch:
Attached is a letter dated August 24, 1978.from the City's -insurance
company, Western Insurance Company. They have denied the claim for
damage to appliances at your home, 1516 Windemere Drive.
I have also discussed this matter with our City Attorney. Our
suggestion is that you file a claim in Conciliation Court for the
damages. It costs $5.00 to -file a claim for amounts up to $500, and
$10.00 to file a claim for amounts in excess of $500. The filing
fee can be added to the amount you are asking to recover.
If you prove your case in Conciliation Court, the City will have a
basis for paying the claim. You can name the Western Insurance
Company and the City of Fridley jointly in the claim if you so desire.
The purpose of your going through Conciliation Court is, that it is
extremely difficult, if not impossible, for the Council to pay a claim
if in our insurance company's judgment the'City is not liable. We do
carry insurance for the purpose of protecting the City's interest in
the event the City is liable. In the opinion of the insurance company
in this particular ingtance, the City is not liable.

Dear Yx . Brunsell:
We are aware, from your previous enclosures, that the City
called the welder. It would not have made any difference
which welder was called, or who called him. The welder
would be the one, and by that I mean Brooklyn Center.
Welding, who negligently carried out their assignment and
they would be found, ultimately, liable if this matter
were to go to court. Naturally, the City could be included
as a defendant in a legal action, but, of course, the
welder would be brought in and very likely the City let
out of any legal action.
This situation would not be any different than, for instance,
if someone were to take their car to a garage, to have it
repaired or some body work as a result of a accident, and if
the body shop, for instance, found it necessary to have
another shop straighten the frame, as they usually do, and
the frame was straightened improperly, the responsibility
would be the frame straightening company's and not the body
shop. A clear sub -contractor arrangment here.

City to inform -us that there was no insurance coverage for
this loss by their insurance carrier.

RL: Incident at 1510 Berne Road
FACTS: 1. Standpipe was approximately 75 feet from water
meter at 1510 Berne Road. The standpipe was found
by the Water Department and a key was left on it
for the welder to make his connection.
2. The ground wire and meter at 1510 Berne Road were
disconnected by the {Vater Department before we
left the premises.
3. The Water Department found the gate valve at
Windemere and Berne Road for the welder to make
• his other connection. The -gate valve was approx-
imately 70 feet from 1510 Berne Road water serv-
ice.
•.4. At approximately 7:00 p.m. on the night of February
15, 1978, we received a call from the welder asking
i£ the gate valve cover had an interlocking cover.
It didn't and so the welder hooked on to the gate
valve and the standpipe at 1510 Berne Road.
5. At approximately 8:30 p.m. that -evening, another
-call---.was received stating that. -the. -.frozen water
f line was unthawed.
-----.-.----- -- -- — fi. At 9:00 p.m. -still another call -was received from
the welder stating that the house at 1512 Windemere
-- —
had some electrical difficulties such as a blown
V! out television set, microwave oven and some other
small electric motors. The electrician that the
complainant called stated that the 200 AMP service
conduit to the house was warm on his arrival,
which had been approximately at 8:50 p.m. and that
he thought the welder had something to do with it.
We.were also told HSP would be at the complainant's
house. _

Re: Swimming Pool Construction at 1516 Windemere Drive N.E."
Dear Sirs:
This letter is to make clear this department's requirements for
the swimming pool construction at the above address.
1. As indicated, one (1) skimmer approved by the National
Sanitation Foundation will be provided.
2. As indicated, one (1) inlet of approved design for fresh
and/or repurified water will be provided.
3. The filter and pump shall be approved by the N.S.F. and be
of sufficient capacity to provide a minimum turnover of at
least two (2) times in 24 hours. This department recommends
a turnover rate of 6 - 8 hours.
4. A deck of at least three (3) feet wide, measured from the
pool waters edge, shall be provided which extends completely
around all private residential pools. Above ground private
residential pools may be provided with decking of a minimum
size of 4 feet by 4 feet at pool entry points and provided
that such decking has the approval of the City.
5. Fencing or other effective means including but not limited
to walls or buildings, acceptable to the City, shall be
provided to positively control all access to public and
private residential swimming pools. Fencing shall meet the
following criteria:
a. The fencing shall prevent the entrance of children and
be without hand or foot holds that would enable a person
to climb over it.
b. The fencing shall be at least 6 feet high and entrances
shall be equipped with self-closing and self -latching
gates capable of being locked.
C. Self-closing and self -latching devices shall be placed
at the top of the gate or otherwise inaccessible to
small children.
d. The opening between the bottom of the fence and the
ground or other surface shall be not more than four
inches.

6. An automatic chlorinator should be provided with a suitable
test kit.
7. All electrical and plumbing installations shall be inspected
and approved by the City Inspection Department.
8. All overhead electrical lines must be a minimum of 10 feet
horizontally from the pool surface and 18 feet straight line
distance from the waters edge. An alternative is to bury
said lines.
9. The pool fill spout must be protected by a vacuum breaker or
air -gapped.
10. Suitable safety equipment to include but not limited to a
ring buoy and rope that is 1 1/2 times the pool diameter, and
shepherds crook pole must be provided and maintained with the
pool at all times.
Furthermore, these and any other requirements must meet the
provisions of the Fridley City Code, Section 115, Swimming pools.
The building permit is approved contingent on final inspections
and approval by the City.
