Fridley, MN 55421 December 14, 1999 Missy Daniels Code Enforcement Officer Fridley Municipal Center 6431 University Ave NE Fridley, MN 55432 Dear Ms. Daniels: This correspondence presents a summary of the upgrading activities which have taken place since receiving your Sept 30,1998 letter of directives on bringing my lawn area in compliance with the city ordinances. The weeds were cut back within the ten day period and were eradicated completely in the spring of 1999. In late October 1999, professional landscape work was completed, in accordance with the proposal presented in Exhibit I. Item 4 of Exhibit I, concerning the complete sodding and re- sodding of all remaining exposed area on the landscape,was delayed until spring, partially for reasons which will be explained later. Exhibit II and Exhibit III show the work completed on the lawn, thus far. Exhibit IV gives an overview perspective of my lot at 1523 Windemere Drive, NE (LOT 15) of the Innsbruck 5TH Addition with the surrounding lots. Prior to landscaping the lawn, a licensed surveyor surveyed the boundary lines of my lot at 1523 Windemere Drive NE (LOT 15, Innsbruck 5th Addition + 1/2 LOT 14) and the adjacent lot lines in December 1998. Refer to Exhibits V and V-A. Exhibit V, the Certificate of Survey of LOT 15 is supplied with a duplicate copy. According to the Certificate of Survey a retaining wall from the adjacent property (LOT 16 ; 1527 Windemere Circle E., NE: Owners, Roger & Virginia Schnabel) was extended over into my property, LOT 15, in the northeast area of the lot. The retaining wall was constructed in the spring/ summer period of 1998. (Refer to Exhibit VII) A section of the retaining wall is situated on my LOT 15 property, such that: the overlapping land is exclusive to the non -owner's use; and non -inclusive to the owner's use. This unauthorized inclusion is far beyond the usual neighborly accommodation. Exhibit VI shows a photo of the boundary line between my lot, LOT 15, and the neighbor's LOT 16 in the northeast section along the overextended retaining wall. The red markers on the photo show the Surveyor's pin positions for the boundary between LOT 15 and LOT 16. The photo is a graphic description and Exhibit V , the Certificate of Survey, gives the measured extent of the intrusion. Also the photo of Exhibit VI confirms unequivocally that -- at the time of your initial inspection there were no weeds emanating from my property, LOT 15, along the boundary line and intruding into the neighbor's property, LOT 16. However, there were"5- inch to 8- inch high weeds buttressed on a line about 1 & 1/2 feet from the LOT 15 / LOT 16 boundary line. I respectfully request that your offices convey to the owners of LOT 16 an interpretation of the rules concerning property obligations. As the only way that the owner can ensure compliance with the code ordinance, it is necessary to move the retaining wall section beyond the land area of LOT 15. In.the spirit of maintaining the neighborly relations, I would permit the owners of LOT 16 to traverse lightweight construction equipment (such as a small Bobcat) across the unfinished section of the LOT 15 landscape and remove the retaining wall section with minimum inconvenience to their finished adjoining landscape. Any construction work from the LOT 15 boundary side would have to be done in the early spring. This would allow time for a re -survey of property boundaries by others. I would have to receive a clear prior notification before any construction equipment can enter onto LOT 15. As the owner of LOT 15, I have a contractual commitment which will be completed in the spring of y2K for sodding coverage of the exposed landscape. Shortly after the retaining wall section is removed, the entire landscape will be maintained in strict compliance with city ordinance. My request for the guidance of your good offices in communicating these matters may be unusual, but please consider the following: (1) If the owners of LOT 16 have made a concerned inquiry to your office about any of the matters discussed, I believe they should be entitled to some response with interpretation from you. (2) The use of suggested City Code Enforcement Enabling Entities (such as County offices, regional agencies,etc..) are bureaucratic and cumbersome, and would probably not be in the interest of good neighborly relations. (3) The property of (LOT 15 +1/2 LOT 14) should be maintained intergral and uncluttered, by the owner. (4) The property of (LOT 15 + 1/2 LOT 14) is being prepared for possible transfer. (LOT 10: 1522 Berne Road) From 1969 to about the mid- nineties the back end was open. I believe in the mid- nineties, the drain -off level was blocked and effectively raised, causing a dam effect or a land locked situation for LOT 15. Water has been back filling in a pool increasingly in recent years. As I have previously stated, the issue of encroachment over a private property line is not under the scope of the City to take official action. It is a civil matter between private property owners. As a courtesy call, however, we have contacted the neighboring property owners and informed them of the issue. You should contact them directly, though, to move matters forward and hopefully come up with a solution for your dilemma. Secondly, to address the drainage issue, a storm water project could be done in your neighborhood that would alleviate backup problems. In order to initiate such a project, a petition of all affected property owners should be submitted to the Public Works Director, John Flora. The petition must come from all affected properties because the properties will be assessed for the cost of the project, which is typically $1,000 per property. Due to the cost, a simpler solution may be for you to contact your neighbors and see if a plan can be worked out to alleviate the problem. I will file all of the information you sent with your address file, which includes the history of your property such as building permits, etc. If you cannot solve the drainage problem and you and your neighbors would like to initiate a storm water project, simply submit a petition requesting such to John Flora, Public Works Director, Municipal Center, 6431 University Avenue, Fridley, MN 55432. I have asked about the neighbor's attempts to resolve the concerns in a neighbor -like fashion. He indicated that there have been several attempts to discuss resolution, but that you don't both share the same willingness to seek a resolution. Councilman Harris commented that Shorewood Shopping Center was represented previously when it was agreed that it was to be bricked on the three sides. Mr. Becchetti explained that they plan on adding on the east and south sides, but they do not know exactly when. The City Engineer pointed out that there were a number of other waivers granted when the plot plan was adopted. Councilman Sheridan said that in taking out the building permit, the stipulations were accepted, now another waiver is being requested. If Mr. Saliterman were to come in with a plan for the expansion, possibly this could be considered. Mr. Becchetti said that they will be ready, maybe, with plans in the spring. Councilman Harris pointed out that without the brick, the building permit may not have been granted. He asked when the Sears store will be occupied. Mr. Becchetti said in about 4 weeks. It is just a matter of putting up brick veneer and finishing the flooring and heating. Mr. Becchetti said that the loading ramp is in the southeast corner. The City Engineer asked how there could be expansion without elimination the service entrance. Mr. Becchetti said that the expansion would go right up to the service entrance. The service door faces south. Councilman Harris wondered what would be -done about the parking requirements in that case. Councilman Liebl commented that he felt that three years is too long, and that the Council has already granted one waiver in the brick in leaving off the east side. Councilman Sheridan suggested that if Mr. Saliterman comes in with a plan for expansion by April, then the brick on the south side could be waived, except that portion that the expansion would not affect, and if not the stipulation would have to stand. Councilman Harris added that if he were to come'in:with a plan, he would have one year from the time the permit is given before it would become invalid.
