Moravetz, Sr. Engineering Aide DATE: July 3, 1974 SUBJECT: Drainage South of Woody Lane Cul-de-sac The request made by Mr. Craig Willey for a variance to construct a dwelling on Lot 6, Block 1, Meloland Lakeview Addition will not cause a serious drainage problem if the existing drainage pattern is not altered allowing the surface water to continue to drain to the northwest corner of the property. Caution should be exercised when hauling in fill to accommodate the structure so as not to block the drainage from the east. (Generally the area west of Gardena Lane and north of Gardena Avenue) The Engineering Department contacted Mrs. Johnson and she informed us that she has water problems every year, especially during the spring season. Mr. Halland was contacted and he informed us that he is experiencing run-off problems from Woody Lane. The curbing on Woody Lane is the depressed "drive -over" type and during severe rain storms the catch basin on the south end of the cul-de-sac serves merely as an inter- ceptor. The Engineering Department recommends that a dirt berm be created in the boulevard on the south and east side of the cul-de-sac of Woody Lane to alleviate the apparent drainage problem experienced by Mr. Halland. We also recommend a ditch be created along the common property line of Lot 8 and Lot 7, Meloland Lakeview Addition, to alleviate the problem Mrs. Johnson is having (Lot 8). This ditch section would be approxi- mately 170 feet and will be located within an existing 30 foot drainage and utility easement. The Engineering Department further recommends that Mr. Willey be directed to maintain the drainage pattern to the northwest corner of Lot 6, causing the drainage to be channeled.into the above mentioned ditch. The Minutes of the Board of Appeals Subcommittee Meeting of June 25, 1974 Page 4 MOTION by Plemel, seconded by Gabel, to recommend to the Council, approval of the variance to construct a second pylon and to increase the sign area from 50 square $ n feet to 72 square feet, the maximum height to conform to the requirement of 25 r1 feet. Upon a voice vote, there being no nays, the motion carried unanimously. Chairwoman Wahlberg said the Board could not take any action on the wall sign at this time. Mr. Lawrence stated he understood that and he would bring this item up at the Council meeting to try and save some time. l X '\ 3. A REQUEST FOR A VARIANCE OF SECTION 205.053, 4A, FRIDLEY CITY CODE, TO REDUCE THE FRONT YARD SETBACK FROM 35 FEET TO 19 FEET TO ALLOW THE CONSTRUCTION OF A DWELLING TO BE LOCATED ON LOT 6, BLOCK 1, MELOLAND LAKEVIEW, THE SAME BEING 5928 WOODY LANE N E , FRIDLEY, MINNESOTA (REQUEST BY MR. G. CRAIG WILLEY, 3816 POLK STREET N.E., MINNEAPOLIS, MINNESOTA.) Mr. Willey was present to present his request. A survey showing the proposed house location, and a picture of the lot were shown to the Board. Mr. Willey showed the Board a topography drawing of the lot that he had made. He said he had make 92 elevation shots so that he would know where to best position the dwelling. He added the neighbor's house to the north is set back 19 feet, the same distance as he is asking for, and for the same reason. He said the reason he would like to set the house closer to the street is that from the edge of the cul-de-sac running westerly through his property, there is a grade change of 20 feet. He said the steepest point exists within the first 30 feet from the street so it he were to maintain the 35 foot setback from the property line, and keep the top of the foundation above the grade of the street, he would have to use excessive courses of block and additional fill. He said he has to have excessive courses of block as proposed, and even to stay back 25 feet, as suggested by Mr. Clark, would mean 2 to 3 feet of additional block and a lot of fill. He said there is a 6 foot boulevard for a sidewalk to be put in but he said he is not for a sidewalk and he didn't feel anyone else in the neighborhood wanted one put in either. He said he is asking for the variance on the basis that a sidewalk would not be needed. Mrs. Gabel asked if he intended to live in the house. Mr. Willey said that he did. Mrs. Gabel asked what type of a house was proposed. Mr. Willey said it would be rambler appearing from the front with a terraced down yard to expose one lower level window. He said the back will be a walk -out and most of the living area will be on this level. He said the garage will have a spancrete floor with a recreation room beneath it. He added it will be valued around $45,000.00. Mrs. Agnes Johnson and son, 5947 Central Avenue, and Mrs. Lyle Halland, 1207 Gardena Avenue came forward to voice their opinions of the request. Mr. Johnson stated because of the grade of the land, they have had trouble with flooding basements for the past 5 years. He said they are just now getting this problem under control and feel that building this house will worsen their run off problem. He felt that a drainfield or something like that should be installed. Mrs. Gabel asked what is involved in resolving a run off problem. Mr. Mattson said it is a matter of landscaping and sodding but this would have to be worked out with the Engineering Department. Mrs. Halland stated the storm sewer on Woody Lane doesn't take care of all the storm water and she felt it sIould be checked. Chairwoman Wahlberg stated the problem of the storm sewer will have to be handled by the Engineering Department and the City Council. She said the Board is only authorized to act on the variance request. She asked if there was any objection to the variance itself. Mrs. Halland said her husband might have an objection but he had to work and could not be present. Chairwoman Wahlberg informed Mrs. Halland that her husband could come before the Council if he wanted to state any objections to the variance. Mr. Willey added he has purposely left 8 feet between his garage and the lot line so that he can put in a ditch drainage area for the roof run off. MOTION by Plemel, seconded by Gabel, to close the public hearing. Upon a voice vote, there being no nays, the motion carried. Mr. Plemel stated he could see no need for a sidewalk to ever be installed and considering that the house to the north is already set back 19 feet, and because this is on a cul-de-sac where the houses are not in line, he had no objection. Mrs. Gabel said she agreed%with Mr. Plemel. MOTION by Gabel, seconded by Plemel, to recommend to the City Council, approval of the variance to reduce the front yard setback from 35 feet to 19 feet. Upon a voice vote, there being no nays, the motion carried. MOTION by Plemel, seconded by Gabel, to recommend that the Council take notice of the drainage problems that exist in this area, as reported to the Board, and that this house might add to the problem, and to see if something can be worked out to alleviate the problem. He continued it is the motorcycles in the area that cause the majority of the problems. Councilman Starwalt again proposed that the three way stop be installed on Innsbruck North Drive and Matterhorn Drive with the addition of the proposed 30 mile per hour signs. The City Manager said the installation of the signs on East Danube Drive and North Innsbruck Drive could be within the second phase of the plan if this is needed. He said this would only allow the people to go one half a block. A resident of the area pointed out that North Innsbruck Drive goes straight to Silver Lake Road. MOTION by Councilman Starwalt to support the recommendation of the Administration with the additional 30 mile per hour signs, and the increased emphasis on Police enforcement of the area, and that three way stop signs be installed on North Innsbruck Drive and Matterhorn Drive and that a four way stop.be created on East Danube Road and Innsbruck North, and also that all crossings be painted i.f necessary. Seconded by Councilman Utter. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously. The City Manager said this requested action is what the Planning Commission had recommended be approved. He explained that the applicant had originally requested lot splits, and the City had suggested that this area be replatted and they had concurred with this request. He explained this action would just adjust some lot lines. Mayor Liebl asked if there was anyone present opposed to the proposed replat and there was no response. MOTION by Councilman Starwalt to close the Public Hearing. Seconded by Councilman Utter. CONSIDERATION OF A REQUEST FOR A FRONT YARD SETBACK VARIANCE FROM 35 FEET TO ALLOW THE CONSTRUCTION OF A DWELLING AT 5928 WOODY LANE N. E. BY G. CRAIG WILLEY TABLED JULY 1, 1974): The City Manager advised the Council that itC-uthi�tration }Administration recommendation that a ditch and some banks be created in theeas- lea of the property to curtail the flow of water. He explained the had been in contact with Mr.Wil ey and he agreed to these conditions which would be on the building permit when it is issued. Mayor Liebl asked if something could be worked out to take care of the drainage problems in this area. Mr. Clark said this could be done. Councilman Starwalt said before any decision on the matter is made he would like j some understanding on the type of ditch that was being talked about in this case. He asked if they were talking about a ditch with flowing water, or would this be a gentle Swale. Mr. Clark explained that this terminology should read a gentle swale. jMr. G. Craig Willey addressed the Council and said he had talked to Mr. Clyde Moravetz, Senior Engineering Aide, and also Mr. Qureshi, the City Manager, and the terms agreed upon by the City and himself meet with the requests of Mr. Johnson, abutting property owner. Councilman Starwalt said with the understanding that there will be cooperation between F.� PUBLIC HEARING MEETING OF JULY 8, 1974 PAGE 12 Mr. Willey and the other property owners in the area he would favor granting the variance. MOTION by Councilman Starwalt to grant the variance for the front yard setback from 35 feet to 19 feet as requested by Mr. G. Craig Willey, 5928 Woody Lane N. E., with the stipulation that a swale and some banks by installed to protect the abutting property owners from drainage problems. Seconded by Councilman Nee. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously. CONSIDERATION OF A REQUEST FOR A FRONT YARD SETBACK FEET TO MOTION by Councilman Nee to waive the reading of the Public Hearing Notice and open the Public Hearing. Seconded by Councilman Starwalt.- Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously and the Public Hearing opened at 9:20 P.M. Mayor Liebl asked if there was anyone present who opposed the variance and there was no response. MOTION by Councilman Nee to close the Public Hearing. Seconded by Councilman Starwalt. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously and the Public Hearing closed at 9:21 P.M. Councilman Nee said he had visited the.area and talked to the other property owners and felt they had no real opposition to the approval of the variance, but he would determine that, they may not have wanted to express this type of feeling. Councilman Nee indicated he felt it would be more satisfactory with the adjoining property owners if the garage were pulled back a little. He suggested the variance be granted for 20 feet rather than the 18 feet requested by the applicant. He asked if Mr. Roback his feelings on this proposal. Mr. Roback addressed the Council and said he would rather leave the plans for construction at the 18 foot setback line, but if he had to move the garage back he would. Councilman Nee explained he felt that this construction would be better received by the neighbors this way. He said he felt the people did not want to say no to the plan, but he thought they would oppose the larger variance. MOTION by Councilman Nee to grant the variance request by Mr. Michael Roback at 5465 Altura Road for a front yard setback of 20 feet rather than the 18 feet as requested. Seconded by Councilman Starwalt. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously. CONSIDERATION OF A REQUEST TO CONSTRUCT A 24' BY 24' ADDITION TO A PRESENT GARAGE T 250 67TH AVENUE N E., BY THOMAS EILERS TABLED JULY 1, 1974): The City Manager reiterated that there was some concern about the construction of this large of an addition which would be used for the purposes of paint storage. He further explained that the request had been tabled for the gathering of additional. information. Mr. Clark said he had been in contact with the applicant who had indicated the paint he planned to store would be latex paint and this would not create the hazard. as enamel would. Councilman Utter said this kind of -statement could be made today and later the property owner would store the oil base paints. He said there would have to be storage of some solvents. Mr. Clark said the petitioner had talked to Mr. Aldrich, Deputy Fire Chief, who had advised the applicant on what preventative measures would have to be taken to make this storage safe. Mr. Clark further explained that the construction would have to contain some fire walls and if Mr. Aldrich would feel that the fire walls are needed all the way around the construction, this would have to be done. He added, if lacquer is being stored, there would have to be the installation of a paint cabinet. E., FRIDLEY, MINNESOTA. RUE EQS Y MR. G. CRAIG WILLEY, 3916 POLK STREET Mayor Liebl asked if there was a drainage problem in the area. The City Manager said the building permit would not be issued until the drainage problems in the area had been taken care of. Mayor Liebl said he had received calls from some concerned people who had indicated. there was a problem in the area. He said he would like to know what the problem is and what they are faced with. He said he would like to see more details and the recommendation of the Administration. He said he would like to see what could be done to solve the problem. The City Manager said he would be able to give the Mayor more information. He explained that there is a large size catch basin in this area. The City Manager asked the Mayor who he had received calls from, they may see something the Administration does not see and this would be a method of solving the problems. He commented, a double catch basin may improve the capacity. He said..this item would be brought back to the Council. Mayor Liebl said some people in the area are concerned about the present problems and do not feel they should add to these problems. He stated this matter would have to be handled between the Ward Councilman and the Engineering Department, and they should come up with something for a solution. Councilman Starwalt said the catch basin is in the circle and the problems are not due to the catch basin. Councilman Starwalt referred to the agenda information on page 12-I. He said the lower left area is where the problems are and the concern is that the drainage of the area will be disturbed. He explained this area to be the Johnson and Holland properties. Councilman Utter questioned if this was south of the area in question and Councilman Starwalt said the Johnsons live on Central. The City Manager said the Administration would contact these property owners and come up with a solution to the problems. Mayor Liebl said the three abutting. property owners would like to have this problem solved. The City Manager asked if the applicant, Mr. G. Craig Willey was present and Mr. Willey responded. Mr. Willey said the main concern in.the area is for a solution to the storm water problems. Mr. Willey commented that he is aware of a solution and he had discussed this with the Board, and they had recommended he review this plan with the Engineering Staff. He said this plan would eliminate the problems with the storm water for these people. Councilman Utter said the area has a clay surface and when it rains, the water runs off of the surface to the cul-de-sac and into the peoples' back yards. He thought with some terracing, this problem would be taken care of. Mr. Willey said he had provided a topographical survey and he was aware of the problems. He said with the proposed plan, the water would be brought into the dedicated easement area and would.fall down to Central Avenue. He said some of the water on Woody Lane should be traveling on the lawns. The City Manager asked Mr. Willey if he owned the land being discussed and Mr. Willey said he owned the land. Councilman Starwalt said he had talked to Mr. Holland and he was in agreement as to what should be done and this was in agreement,with the proposal by Mr. Willey. Mr. Willey said Mrs. Holland was present at the meeting and she had a good under- standing of what should be done. MOTION by Councilman Utter to table the consideration of the variance request by Mr. G. Craig Willey for 5928 Woody Lane N. E. until the next Monday evening, Monday, July 8, 1974. Seconded by Councilman Starwalt. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously. REGULAR COUNCIL MEETING OF JULY 1, 1974 A A VARIANCE OF PAGE 10 { 5.053, 4A, FRIDLEY CITY CODE, TO REDUCE THE F 70 18 FEET TO ALLOW THE CONSTRUCTION OF A THE EXISTING DWELLING, LOCATED ON LOT 17, 4DDITION, THE SAME BEING 546E ALTURA ROAD Y MR__MICHAEL ROVACK, 5465 ALTURA ROAD N. E.. Mayor Liebl pointed out to the Council the drawing of the proposed construction of the garage on page 12-J of the agenda. Councilman Nee said he would have no objection to the variance, but would like ' an explanation of what is being proposed. Mr. Roback addressed the Council and explained that a considerable amount of back fill would be needed if the variance was not granted and he would not be able to move the garage forward. Councilman Nee asked if the garage would be in front of everyone else. Mr. Roback said yes, 10 feet. i Councilman Nee asked Mr. Roback if he would be agreeable to a delay of this action for a period of one week which would enable Councilman Nee to visit the area and look at the property. The City Manager said he would send notices to the area property owners to determine if there are any opposed to the variance being requested. Councilman Breider questioned if it was normal procedure to have a Public Hearing on such a matter at the Council level. MOTION by Councilman Nee to table any action until July 8, 1974, at the next meeting of the Council in regard to the variance request by Mr. Michael Roback. Seconded by Councilman Breider. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously. MOTION by Councilman Utter to receive the minutes of the Board of Appeals Meeting of July 25, 1974. The City Manager commented that there would be no problem with the review of the drainage plan, this is routine in this type of construction. The City Manager recommended the Council approve the request and authorize the Administration to issue the permit with the five stipulations. MOTION by Councilman Starwalt to approve the issuance of the building permit as requested by Strite-Anderson Company for 7585 Viron Road, with the five stip- ulations suggested by the Subcommittee.
