Mr. Tatting stated the petitioner is requesting a side yard setback to the north from 10 feet to 7 feet to allow the construction of a 16 foot X 26 foot addition on the west side of the existing home. The project also includes a bay which will extend an additional 2 feet to the north. Mr. Tatting stated the petitioner's hardship statement indicates the home was built in 1948 and set back 7 feet. The request is to match the existing home at the 7 foot setback. They are also requesting an additional 2 feet for a gas fireplace to serve as a supplemental heat source in the addition. The garage is to the south so they cannot expand in that direction. The property also has mature trees and they do not want to expand into the back yard area. APPEALS COMMISSION MEETING, MAY 27. 1998 PAGE _2 Mr. Tatting stated the property is zoned R-1, Single Family, with R-1, Single Family, zoning surrounding the property. There is a small area of R-2, Two Family, to the west and M-2, Heavy Industrial, across Main Street to the west. Mr. Tatting stated the R-1 zoning requires living areas to be a minimum of 10 feet from the side yard. The site is located in the Plymouth Addition where the average lot width size is 40 feet x 129 feet. This site is actually 60 feet wide. The existing house is 26 feet x 30 feet and is two stories high. The garage measures 20 feet x 20 feet. The proposed two-story addition is 16 feet x 26 feet. The addition would be located 7 feet from the north property line and a portion of the addition would be 5 feet from the garage. The existing structures plus the additions will result in 23% coverage which is below the 25% maximum. Mr. Tatting stated the Uniform Building Code (UBC) requires that structures less than 5 feet apart have additional standards regarding fire resistance. If the request is approved, a stipulation should be required for the area where the garage and the proposed addition are five feet apart so that it meets the building code requirements. Mr. Tatting stated the neighbor to the north, Janice Frakie, sent a fax to the city indicating she has no objection to the variance request. She expressed concern if a wood replaced the gas fireplace. He stated that the smoke stack for a wood stove would have to meet the manufacturer's and building code standards. Mr. Tatting stated the request is within previously granted variances; therefore, staff has no recommendation regarding the request. If the Appeals Commission chooses to approve the variance request, staff recommend the following stipulation: The petitioner shall comply with the Uniform Building Code for both the addition and the existing garage as appropriate. The Commission members had no questions of staff. Mr. Miller stated the neighbor likely raised the question about the fireplace because he had a wood burning stove before. This will be gas, not wood burning. They asked for a variance because visually it would best match the existing house plus they need the additional space. Dr. Vos asked if Mr. Miller had any problems with the stipulation about meeting the Uniform Building Code requirements. Mr. Miller stated he had talked with the inspector about that before requesting the variance. They built up on their house in 1982. At that time, they talked about that being a requirement. It is not a problem. Mr. Kuechle asked about the idea of offsetting the wall to break up the long line. When looking west past the house, the neighborhood has a tight look about it because the lots are narrow. When you look at the north side of the house and when the house is finished, it will look like a long wall. He cannot visualize how the bump -out will look. He thought it would make it worse. Bringing that wall of the bump -out in even six inches would improve the look. PPEALS COMMISSIQI�LM�ET1Nr MAY 27 1998 PAGE 3 Mr. Miller stated he thought the bump -out would break up the wall and provide more room inside. They have a hedge there as do the neighbors. Dr. Vos stated the bump -out takes up 10 feet of the 16 foot addition. From Second Street looking west, you will see three feet of the addition and then the bump -out so that will break up the long look of the building. There is also a fairly large tree in the front. Mr. Miller stated that in the summer, you can hardly see the house. They have two fairly large trees. Dr. Vos asked if the neighbor to the north was also set back 7 feet. Mr. Miller stated, yes. Dr. Vos stated there is 14 feet between the two structures which is two feet more than between two garages. MOTION by Dr. Vos, seconded by Mr. Jones, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:52 P.M. Dr. Vos stated the advantage for the petitioner is taking the existing structure and going straight back. The lot is small even with 1 1/2 lots. He did not see any other place to put an addition. He thought it met the spirit of the hardship. He did not know what to say about the length. He would vote for approval with the stipulation. Ms. Mau concurred. She did not see a problem. She agreed that it is a very long wall, but it is true there are not a lot of options for the placement of an addition. Mr. Jones agreed the wall is long but there is not much place to go. With the stipulation for the garage to meet the fire codes, he would be in favor of the request. Mr. Kuechle stated he was not sure whether the request should be for 7 feet or for 5 feet. How does that bump -out area affect the request? Mr. Tatting stated the bump -out area is considered a bay and can be closer to the property line. A bay can be 3 feet from the property line. The bay as proposed is 5 feet from the property line. APPEALS COMMISSIONMEETING, MAY 13, 1998 PAGE 6 Dr. Vos stated the fax regarding this request included a concern about venting the heater and the proximity of the two homes. Is that addressed in the Uniform Building Code? Mr. Tatting stated he believed this was in the Building Code. This could be included in another stipulation if approved. Ms. Mau stated the petitioner is requesting a gas fireplace. Mr. Tatting stated that is correct, but that could be changed in the future. Mr. Jones stated he understood that the fire code requirement was on the existing garage because it is 5 feet. If this distance is 5 feet or less, would the petitioner have to do some work on the existing garage or just on that wall that is closest to the house? Mr. Tatting stated it is the garage wall itself. If the distance is 5 feet or less, they could not have any openings in that wall along that portion of the wall where the two buildings are 5 feet apart and would be required to install a fire -proof material on the inside of the garage for additional fire protection. The petitioner was not present at the meeting. MOTION by Ms. Mau, seconded by Ms. Beaulieu, to continue the public hearing to the next Appeals Commission meeting. Side Yard Setback Variance, 4540 2nd Street NE DESCRIPTION OF REQUEST: Mr. Greg Miller is requesting a variance to allow the reduction of the north side yard setback from 10 feet to 7 feet. The variance will allow the petitioner to build a 16 foot by 26 foot addition to the west side of the existing house. The project also includes a ten foot wide building projection that will extend an additional 2 feet into the north side yard. HARDSHIP STATEMENT: Currently our home (built in 1948) is setback seven feet and not the required ten feet. Our request (project) is to match our existing home at the seven foot setback. We are also requesting an additional 2 feet for a gas fireplace, which will serve as a supplemental heat source in the addition. Our garage is to the south of our house so we cannot go that direction. The trees and backyard space are also very valuable to our family and we do not want to destroy that area. We do have eight children and really need the additional living space. SUMMARY OF ISSUES: Section 205.07.03.D.(2a) of the Fridley Zoning Code requires living areas to be a minimum of 10 feet from property lines in the R-1, Single Family District. The existing house and proposed addition would be 7 feet from the property line. Section 205.04.06.A.(2) indicates that a building projection attached to a primary structure can project into the setback area, provided that it does not project more than 2 feet, and provided that the projection is not closer than three feet to the lot line. The proposed building projection will be 5 feet from the property line. The proposed addition will be five feet from the garage. In regards to fire protection, the wall of the garage and the proposed addition will have to meet the standards of the Uniform Building Code. RECOMMENDED ACTIONS: Staff has no recommendation due to the fact that this request is within a previously granted dimension. If the variance is approve, it would be appropriate to include a stipulation that the proposed addition and the existing garage shall meet the standards of the Uniform Building Code. SITE DESCRIPTION/HISTORY The Miller house is located in the Plymouth Addition. The average lot size of the addition was 40 feet by 129 feet. The Miller property is made up of 1 %Z of these lots. The house on the lot has a foot print of 26 feet by 30 feet. There is not a building permit for the house in the address file. The garage was built in 1950, which would indicate that the house was built at an earlier date. The following are the building permits that are in the address file for the property: 1950 - bldg permit - 20' x 20' garage 1992 - bldg permit - 30' x 26' 2nd story addition 1995- bldg permit - construct a 16' x 12' deck ADJACENT SITES North: Zoning: R-1, Single Family Land Use: Single Family Homes East: Zoning: R-1, Single Family Land Use: Single Family Homes South: Zoning: R-1, Single Family Land Use: Single Family Homes West: Zoning: R-1, Single Family Land Use: Single Family Homes and Duplexes R-2, Two Family ANALYSIS Section 205.07.03.D.(2a) of the Fridley Zoning Code requires living areas to be a minimum of 10 feet from property lines in the R-1, Single Family District. Section 205.04.06.A.(2) indicates that in no instance shall bays attached to primary structures be nearer than three feet from the lot line, therefore the bay does not need an additional variance. The addition is 16 feet by 26 feet, plus a 2 foot by 10 foot projection. The addition will be directly behind the existing house matching the house lines to the north and south. The bay will protrude toward the north property line. The footprint of the addition is 436 square feet. The buildings at the site will now cover 23% of the property. The maximum allowable lot coverage is 25%; the project meets this requirement. Staff Report: VAR #98-12 4540 2nd Street NE Page 4 The 2 foot by 10 foot projection or bay will be utilized to house a gas furnace and an entertainment center. The bay will be located under the proposed eaves and will not require the eaves to be extended further into the side yard. The proposed addition will be five feet from the garage. In regards to fire protection, the wall of the garage and the proposed addition will have to meet the standards of the Uniform Building Code. Janice Frakie, the neighbor to the north (4544 Second St NE), has provided the City with a letter indicating that she is not objecting to the variance. She has a concern regarding the furnace. The furnace is proposed as a gas furnace. If a wood burning stove were ever to replace the furnace, it would have to meet the manufacturer standards in regards to safety and chimney height. This request is similar to a previously granted variances for: Roger and Marilyn Roelofs, 150 Talmadge Way (April `98). They were granted a side yard setback of 4.4 feet for the reconstruction of an existing dwelling. Paul Litwinczuk, 6291 Central Ave. (Sept '95). Mr. Litwinczuk was granted a side yard setback of 3 feet for an addition to an existing dwelling. RECOMMENDATION Staff has no recommendation due that the fact that this request is within a previously granted dimension.
